About this file
This is Exhibit L of a FEMA-related contract document outlining additional provisions and compliance requirements for contractors undertaking federally-funded projects. The exhibit does not specify particular products, services, quantities, response dates, site visits, or bidder conferences, as it functions as a comprehensive set of mandatory contractual clauses rather than a project statement of work. Instead, it establishes the regulatory and compliance framework that all contractors must follow when performing work funded through FEMA assistance.
The document imposes extensive federal compliance obligations on contractors, including Equal Employment Opportunity requirements under Executive Order 11246, Copeland Anti-Kickback Act compliance, Contract Work Hours and Safety Standards Act provisions requiring overtime compensation at time-and-a-half for hours exceeding forty per week with liquidated damages of $10 per calendar day for violations, Clean Air Act and Federal Water Pollution Control Act adherence, suspension and debarment certifications under 2 CFR Parts 180 and 3000, Byrd Anti-Lobbying Amendment certifications for contracts exceeding $25,000, and procurement preferences for EPA-designated recovered materials products. Additional requirements include providing access to records and work sites for audit purposes, prohibiting unauthorized use of DRS seals or logos, compliance with all applicable federal law and FEMA policies, and acknowledgment that the federal government assumes no liability under the contract. Contractors must flow these requirements down to all subcontractors, and breaches may result in contract termination, debarment, and other federal remedies.

The contractor will take such action with respect to any subcontract or purchase order as the administering agency may direct as a means of enforcing such provisions, including sanctions for noncompliance: Provided, however, That in the event a contractor becomes involved in, or is threatened with, litigation with a subcontractor or vendor as a result of such direction by the administering agency the contractor may request the United States to enter into such litigation to protect the interests of the United States."
