About this file
This document is a Federal Funding Accountability and Transparency Act (FFATA) Certification Form (Form 8040-A) issued by the Texas Health and Human Services Commission (HHSC) as a required certification document for state and local contract opportunities. The form establishes material facts that HHSC relies upon when reporting contractor information to the federal government in compliance with federal law. Contractors are required to certify the accuracy of all statements contained within the form and must provide immediate written notice to HHSC if any certification becomes erroneous at any point during the contract term.
The certification form requires contractors to answer three primary questions regarding federal funding thresholds: whether the organization had gross income from all sources of less than $300,000 in the previous tax year; whether the organization received 80% or more of its annual gross revenue from federal awards during the preceding fiscal year; and whether the organization received $25 million or more in annual gross revenues from federal awards in the preceding fiscal year. If contractors answer affirmatively to both questions A and B, they must complete question C regarding public access to compensation information for highly compensated officers and senior executives. Contractors answering no to either question A or B skip question C and proceed to the signature section. The form includes a signature block requiring the duly authorized representative to certify the truthfulness and completeness of all statements, along with fields for the date of signature and applicable HHSC contract number(s). Contractors unable to certify all statements must provide written notice to HHSC detailing which statements cannot be certified and the reasons why.
