About this file
This is a Standard Professional Services Contract template from San Bernardino County for a consultant to conduct a cellular tower feasibility study in the Mount Baldy area. The County seeks to designate a qualified consultant through a competitive Request for Proposals (RFP) process to analyze and assess potential locations for cellular tower construction that will support safety personnel, public communications, and major commercial cellular carriers. The consultant must identify a minimum of three search rings meeting specified requirements and complete all deliverables within 120 calendar days. The project is organized into three phases: Phase I involves initial scoping and baseline requirements analysis with current cellular coverage mapping; Phase II requires identification of three search rings of approximately one-mile radius with feasibility analysis including site characteristics, environmental considerations, fiber connectivity, and cellular coverage mapping with Assessor's Parcel Number information and owner contact details; Phase III includes rough order of magnitude pricing for tower construction, Letters of Interest to property owners, and consultation during public exploration of potential parcels. The consultant must attend a minimum of three community meetings and conduct three mandatory site visits with a County-designated community outreach liaison, and coordinate all external project communications with the County.
Compensation for services is established based on the consultant's Cost Proposal attached as Exhibit A, with payment made on a percent-of-task-completed basis as determined by the County's satisfaction. The consultant shall submit itemized monthly invoices within twenty days of month-end, with County payment due within sixty working days of invoice receipt. The contract is subject to American Rescue Plan Act (ARPA) Coronavirus Local Fiscal Recovery Fund (CLFRF) requirements outlined in Exhibit B, which supersedes conflicting contract provisions. The consultant must comply with prevailing wage laws if applicable, maintain Workers' Compensation insurance with $250,000 employer's liability limits, carry General Liability Insurance of $1,000,000 per occurrence, and obtain Professional Liability Insurance of $1,000,000 per claim and $2,000,000 aggregate. All work products, reports, and data generated under the contract become County property upon payment. The contract term is effective for the specified period and may be extended for two additional one-year periods by mutual agreement. The County reserves the right to terminate the contract for any reason with thirty days' written notice, and the contract is non-exclusive, with no guarantee of minimum work volume or compensation.
