About this file

This file is an exhibit describing a capital construction project for West Virginia University Athletics. The MPS West Tower Project involves the construction of a new premium seating and amenity facility at Milan Puskar Stadium to replace an existing 1980-era tower. The new facility will encompass approximately 75,000 gross square feet across five levels and will include a 1,000-person club space, corporate mega-suite, eight Founders Suites, sixteen luxury suites, press accommodations, coaches' areas, and various premium seating options including loge boxes and ledge seats. The project utilizes a Construction Manager at Risk delivery method under ConsensusDocs 500 contract terms with Barton Malow and March Westin serving as joint venture construction manager and Nation's Group (Legends Global) as owner representative. Design documents are scheduled for completion by Fall 2026, with early GMP packages phased between May 2026 and January 2027 for electrical, structural steel, demolition, MEP/utilities, and foundations work. The existing tower is planned for demolition immediately following the 2026 football season, with temporary facilities in place for the 2027 season. Full construction is scheduled to commence in December 2026 and extend through June 2028, with substantial completion targeted for June 30, 2028.

The project structure employs a Cost-Plus Fee with Guaranteed Maximum Price (GMP) format for financial accountability and risk management. Early GMP packages are phased to allow concurrent design and construction activities, with final GMP development scheduled for February 2027 prior to full construction mobilization. The related state and local contract opportunity indicates that West Virginia is seeking construction auditing services to provide financial oversight of this CM at Risk project, ensuring compliance with the cost-plus-fee-with-GMP contract structure and protecting the University's financial interests throughout the project delivery.

Exhibit B – MPS West Tower Project Overview:

West Virginia University (“WVU”) Athletics is building a new tower on the west side of Milan Puskar Stadium. The Athletic Department is committed to maintaining a competitive edge within our conference and nationally by strategically expanding and diversifying revenue sources through premium seating opportunities. The existing tower was built in 1980 with a series of renovations and expansions through the years and is approximately 30,355 gross square feet. The current tower has twelve (12) premium suites, press accommodations, two (2) coaches booths, two (2) radio booths, a television booth, officials booth, announcers’ booth, game day control center and additional spaces if deemed necessary during design. Due to the age and limitations of the existing tower, the new facility would provide fans with additional opportunities for club seats, ledge seats, loge boxes, and various tiers of luxury suites. The new West Tower could include five (5) levels for fan amenities, premium spaces, media spaces, team coaching spaces and operations totaling approximately 75,000 gross square feet. Through an athletic facility master plan and a market study the following programming and recommendations were provided.

The new tower is expected to include the following:

• Concourse: includes VIP curbside lobby with elevators to each premium level and dedicated corporate suite entry.

• Club: includes a 1,000-person club space, with access to Loges, Ledge, and new chairback seating for club- member patrons.

• Founders: include a Corporate Mega-Suite, and eight (8) Founders Suites.

• Suites: including sixteen (16) luxury suites.

• Press needs: include press, visiting and home coaches’ areas, and the WVU Athletic

Director suite.

The intent is to demo the existing tower immediately after the 2026 football season with the understanding that temporary facilities for overall event operation and some fan seating will need to be in place for gamedays during the 2027 football season.
