About this file

This is an exhibit detailing canceled contracts requirements for the SCEIS Modernization solicitation (No. 5400026039) issued by the South Carolina Department of Administration. The exhibit establishes guidelines for offerors to disclose any contracts that have been canceled or prematurely terminated within the past six years. Offerors must provide comprehensive information for each canceled contract, including the client name, title, and contact number; a description of services provided; details on the reason for cancellation; the offeror's position relative to the cancellation; final resolution details; and information regarding any associated lawsuits or settlements. If responding as a prime vendor and subcontractor partnership, the offeror must specify which company was involved in the specific cancellation and provide contact information for individuals who can address questions about the cancellation.

Failure to fully disclose a canceled contract within the required six-year timeframe may result in offeror disqualification from the solicitation process. If the non-disclosure is discovered after contract award, the contract may be terminated, and the service provider becomes liable for all costs associated with re-procurement, including any increased costs for the originally awarded services. If an offeror has no canceled contracts within the specified timeframe, the offeror must provide an affirmation statement to that effect in the exhibit response. The exhibit provides a table format with three rows for contract entries, though offerors are instructed to add additional rows as necessary to accommodate all canceled contracts within the required six-year period.

Offeror GuidelinesOfferor shall provide the name, title, and contact number for a client, and description of services provided for that client, for any contract that was canceled or prematurely terminated in the past six years. If responding as a Prime vendor and Subcontractor partnership, Offeror must specify the company for the specific cancellation. Offeror shall include details on the reason for the cancellation and the Offeror’s position relevant to the cancellation, including the final resolution and any lawsuits or settlements of the contract cancellation. Offeror shall add additional rows as necessary to provide all canceled contracts within the required timeframe.

Offeror shall provide contact information for individuals able to address questions concerning the cancellation. Failure to fully disclose a canceled contract within the scope of this requirement may result in disqualification. If the failure to disclose is not learned until a Contract has been awarded to the Service Provider, the Contract may be terminated. In the event of such termination, the Service Provider shall be liable for all costs associated with the re-procurement, including any increased costs for the services originally awarded.

Exhibit J.2.5 (Canceled Contracts) Solicitation No. 5400026039 If there are no canceled contracts, the Offeror shall affirm such in this section.
