About this file
This document is the Veteran Heroes United in Business (VetHUB) Subcontracting Plan policy and forms for The University of Texas at Austin, establishing requirements for vendors bidding on state contracts valued at $100,000 or more. The policy mandates that all responding vendors—whether prime contractors or self-performing entities—submit a completed subcontracting plan demonstrating good faith effort to recruit and utilize Texas-certified service-disabled veteran (SDV) businesses. Vendors must divide contract work into reasonable lots or portions and notify a minimum of two certified VetHUBs for each subcontracting opportunity in writing, allowing at least seven business days for response. The subcontracting plan becomes part of the awarded contract and may not be modified without prior written approval from UT Austin's Vendor Management Office. Responses lacking a completed subcontracting plan are rejected as material failures to comply with solicitation specifications.
VetHUB certification requires at least 51 percent business ownership, management, and operation by service-disabled veterans with minimum 20 percent service disability ratings as verified by federal military departments, with the business primarily based in Texas and meeting Small Business Administration size standards. Prime contractors must notify all selected subcontractors within ten working days of contract award, specifying the contracting agency name, contract award number, scope of work, dollar value, and expected percentage of total contract value. Prime contractors are required to submit a Prime Contractor Progress Assessment Report (PAR) with each payment application, documenting all first, second, and third-tier subcontractor payments; submission of the PAR is a condition of payment. The university's Vendor Management Office coordinates VetHUB compliance, and violations to the subcontracting plan may result in contract breach enforcement and potential debarment from state contracting.

POLICY ON UTILIZATION OF
Veteran Heroes United in Business (VetHUB)
Introduction The Veteran Heroes United in Business (VetHUB) program is a state of Texas initiative to increase the opportunities available to businesses owned by service-disabled veterans (SDV) in the area of state procurement and contracting.
Accordingly, The University of Texas at Austin is fully committed to the Good Faith Effort to:
• enhance the opportunity of VetHUBs to compete for contracts and purchases
• increase the number of contracts awarded to VetHUB firms
• create a fair and open competitive market
• improve community awareness regarding VetHUBs
A state of Texas Veteran Heroes United in Business (VetHUB) Certification requires at least 51 percent of the business be owned, managed, and operated by owner(s) who meet the qualified requirement as a service-disabled veteran (SDV) (with at least a 20 percent service disability as identified by the federal military department). The business must be primarily based in Texas. The business must also meet the Small Business Administration (SBA) size standards set forth in the business categories of 13 CFR, section 121.201.
The university has designated a staff member to serve as the Veteran Heroes United in Business (VetHUB) coordinator for the agency. The VetHUB coordinator assists the university with the development of the agency's procurement specifications, Subcontracting Plans, and evaluation of contracts for compliance. The VetHUB coordinator also assists state agencies and the state comptroller with VetHUB compliance, facilitating compliance with the agency's good-faith effort criteria, VetHUB reporting, contract administration and marketing and outreach efforts for VetHUB participation.
B. State of Texas Regulations Governing the Veteran Hereos United in Business Program (VetHUB)
In accordance with the Texas Government Code, Title 10, Subtitle D, Chapter 2161., state agencies, including institutions of higher education, must make a good-faith effort to use VetHUBs in state contracts, including contracts for construction, services, and commodities.
In accordance with the Texas Administrative Code, Title 34, Part 1, Chapter 20, each state agency must make a good-faith effort to use VETHUBs in purchase contracts for construction, services (including professional and consulting services), and commodities.
UT Austin Administration Subcontracting Plan (SP)
All Texas State agencies and institutions of higher education are required to make a good faith effort to include service-disabled veterans (SDV) in their procurement opportunities. The State of Texas uses the term Veteran Heroes United in Business (VetHUB) to distinguish State certified SDV businesses.
Statement of Probability - Subcontracting Opportunities are probable in connection with this solicitation.
Responses that do not include an SP shall be rejected as a material failure to comply with advertised specifications in accordance with the request for qualifications.

https://mycpa.cpa.state.tx.us/tpasscmblsearch/tpasscmblsearch.do
Notification to Awarded Subcontractors The successful respondent will provide notice as soon as practical to all subcontractors (VetHUBS and Non-VetHUBs) of their selection as a subcontractor for the awarded contract. The notice must specify at a minimum the contracting agency’s name, point of contact for the contract, contract award number, scope of work to be performed, approximate dollar value of the scope, and expected percentage of the total contract that the subcontracting opportunity represents. A copy of the notice must be provided to the Vendor Management Office (utvethub-hsp@austin.utexas.edu) for the contract no later than ten (10) working days after the contract is awarded.
Changes to the Plan Once the Subcontracting Plan has been submitted, any changes to the SP must be approved in writing by the UT Austin Vendor Management Office prior to any work commencing by the new subcontractor. Once the contract has been awarded the SP is considered part of the contract. Violations to the SP may be deemed a breach of contract by UT Austin.
Reporting – After Award Prime contractor payment requests shall include: the State of Texas Prime Contractor Progress Assessment Report (PAR) identifying all 1st, 2nd, and 3rd tier subcontractor payments. It is a condition of payment to report VetHUB subcontracting expenditures. The PAR Form is included as part of Exhibit H.

Other Requirements
Rev. 5/26
State of Texas Subcontracting Plan When is a subcontracting plan required?
A subcontracting plan is required for state of Texas contracts when the contracting agency has determined that subcontracting opportunities are probable with prospective vendors certified by the Texas Comptroller through the Veteran Heroes United in Business (VetHUB) program, for a contract with an expected value of $100,000 or more. (Texas Government Code Chapter 2161, Subchapter F; 34 Texas Administrative Code Section 20.285.)
When a state agency requires a subcontracting plan as part of the contract solicitation, a bid, proposal, offer or other applicable expression of interest must contain a completed plan to be considered responsive.
Who completes a subcontracting plan?
Every responding vendor — whether a prime contractor or self-performing with no subcontractors — must submit a complete subcontracting plan.
A vendor who intends to use subcontractors must demonstrate their good faith effort to recruit certified VetHUBs, whether or not they ultimately award business to them. A state agency will not use the subcontractors’ VetHUB status to select the winning vendor. All subcontractors must be listed in the subcontracting plan.
A self-performing vendor who will not subcontract any of the work on the contract must indicate that it will complete the con-tract with its own resources and submit the completed subcontracting plan.
Does a subcontracting plan have to be followed?
The subcontracting plan forms part of the contract. Subcontractors may not be dropped or replaced without amending the subcontracting plan with approval by the agency. A self-performing contractor may not use subcontractors without amending the subcontracting plan.

Section 2: Declaration of Self-performing or Subcontracting After dividing the contract work into reasonable lots or portions to the extent consistent with prudent industry practices and taking into consideration the scope of work to be performed under the proposed contract, including all potential subcontract-ing opportunities, the respondent must determine what portions of work, including contracted staffing, goods and services will be subcontracted. 34 Texas Administrative Code Section 20.282 defines a “Subcontractor” as an entity that contracts with a prime contractor to work or contribute toward completing work under a purchase order or other contract. The term does not include employees of the contractor but includes contracted workers who will work on the contract.
