C. DESCRIPTION/SPECIFICATION/STATEMENT OF WORK

Introduction

This is a Performance Based Service Contract and the success of the Contract depends on the satisfaction of the requirements, but also the satisfaction of our shared customer. Rather than a mere list of activities, this is a written expression of the GSA’s expectation of the service to be performed by the Contractor. A higher level of effective communication between the Government and Contractor is essential for partnering and for the performance based service contract to succeed. The success of this Contract is shared between the Government and the Contractor.

More emphasis is placed on the Contractor’s self-management of quality, not the usual external inspection by Government Inspectors, although that is a part of this Contract as well. All parties should act proactively to reduce service cost, therein providing an incentive for the Contractor.

The Contractor, through innovation, technology, or other means, shall perform the required maintenance of these facilities by following the Guiding Principles for Sustainable Existing Buildings:

I. Employ Integrated Assessment, Operation and Management Principles

a. In conjunction with the Contract Officer (CO) or designee establish operational performance goals for energy, water, material use and recycling, and indoor environmental quality, and ensure incorporation of these goals throughout the life of this Contract.

b. Ensure that operating decisions are carried out with regard to sustainable operations.

c. Meet ASHRAE standards as noted throughout the SOW for thermal comfort and indoor air quality.

d. Use low emitting materials Volatile organic compounds (VOC) or other for maintenance. In particular, use products that have low pollutant emissions, adhesives, sealants, and solvents.

e. Use products meeting or exceeding EPA’s recycled content recommendations for building maintenance. For other products such as ceiling tiles, use materials with recycled content. For more information, see EPA’s Comprehensive Procurement Guideline website.

f. Use materials with the highest content level per USDA’s bio-based content recommendations for maintenance of or use in the building.

g. Use environmentally sustainable products that have a lesser or reduced effect on human health and the environment. See the Green Products Compilation.

h. Provide salvage, reuse and recycling services for waste generated from building operations, maintenance, and repair and discarded equipment.

i. Eliminate the use of ozone depleting compounds where alternative environmentally sustainable products are available consistent with the Clean Air Act.

II. Optimize Energy Performance – GSA is in the process of optimizing energy performance through advance metering and monthly reporting. Operate all equipment to optimize efficiency to reduce energy use and otherwise seek operating costs reductions wherever possible.

III. Protect and Conserve Water where possible inside and outside. Metering systems may be already installed or will be installed in government buildings to aid in reducing consumption. Where available, use EPA’s Water Sense-labeled products or other water conserving products.

IV. Be aware that the building(s) and management involved with this Contract may be in the process of establishing new initiatives, instituting plans, and operational procedures to meet energy efficiency goals either through receiving an ENERGY STAR rating, Smart Building/ GSALink technology, or comparable programs. The Contractor will play an integral part of obtaining these goals and should be aware of the programs and processes.

V. The purpose of partnering is to adopt procedures wherein the Scope of Work where the Contractor and Government can work together in achieving Contract objectives. Partnering involves the development of a cooperative management team that seeks to identify common goals and objectives.

See Exhibit E20 – Performance Work Statement for details of Scope of Work to be performed.

c. Within thirty days of award, the contractor will receive the first e-mail that annotates contract registration containing user account information and evaluation module assigned.

d. Once the evaluation is completed by GSA, the contractor will receive a second email notifying them that the evaluation is ready for their review and comment. f. Contractors are encouraged to visit the following website to sign up for the free on-line Contractor Overview training targeted to contractor users who will provide Past Performance Evaluation comments on the evaluations.

G.2 The Role of Government Personnel and Responsibility for Contract Administration

Individuals will no longer be identified in contracts. All changes to the individual(s) designated in the role of CO, COR, and/or COTR will be issued by modification or letter to the Contractor, identifying the new name, address and phone number, with copies to the official contract file and to the person who has been appointed.

G.2.2 IDIQ Contracting Officer (CO): The IDIQ Contracting Officer has the overall responsibility for the administration of this IDIQ contract. The CO alone, without delegation, is authorized to take actions on behalf of the Government to amend, modify or deviate from the contract terms, conditions, requirements, specifications, details and/or delivery schedules. The CO makes final decisions on disputed contract terms or deductions for nonperformance or unsatisfactory performance, termination for convenience or default, and issues final decisions on contract questions or matters under dispute. However, she/he may delegate certain other responsibilities to her/his authorized representatives.

G.2.3 IDIQ Contract Specialist (CS): The IDIQ Contract Specialist may be assigned a contract project, but does not have signatory authority. The CS handles contract administration responsibilities and is the first point of communication for contractual issues. The CS will be responsible for preparing options, updating past performance records and obtaining updated qualifications, and all other actions at the base contract level.

G.2.4 IDIQ Contracting Officer’s Representative (COR): The Contracting Officer's Representative shall assist in the discharge of responsibilities when the CO is unable to be directly in touch with the contract work. The authority of the COR is strictly limited to the duties set forth in the letter of appointment of each individual task order. determining the adequacy of performance by the Contractor in accordance with the terms and conditions of this contract; acting as the Government’s representative in charge of work at the site; ensuring compliance with contract requirements insofar as the work is concerned; and advising the CO of any factors which may cause delay in performance of the work. G.6 Excusable Delay https://www.finance3.gsa.gov/ mailto:fw-customersupport@gsa.gov

This contract may not be cancelled if nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence such as acts of God or the public enemy, acts of the Government in its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, and delays of common carriers. The Contractor shall notify the CO in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the CO of the cessation of such occurrence.

G.7 Performance Improvement Plan (PIP) Process

In the event work is performed unsatisfactorily, the Contractor will be requested in writing, with a copy to the local NISH representative to correct the deficiencies. This process will include having partnering meetings that include the CO, COR, NISH representative and contractor representatives to try and resolve issues. A corrective action plan will be developed to layout the specific areas that need to be addressed with specific dates for additional inspections, or additional meetings. This may include the rewrite of the quality control plan or revisions to that document.

If the corrective action plan fails, the NISH Performance Improvement Plan (PIP) will be implemented. The CO will issue a letter to NISH Northwest documenting requesting the Contractor to be placed on a PIP immediately. NISH NW will be required to submit within 10 days of receipt of the letter a copy of the PIP reflecting the timeframes for improvement. Failure to submit the PIP within 10 days or to correct deficiencies within the period allowed may result in cancellation of the contract and reallocation of the project to another nonprofit agency.

G.8 Cancellation of Contract

In the event that the Contractor fails to comply with the terms of this contract, the Government shall notify the Contractor and NISH NW of such failure. If the Contractor does not correct the failure or provide an acceptable plan to improve its performance within 10 days (or more if authorized in writing by the CO) after receipt of the notice from the CO specifying the failure, the Government may cancel this contract; provided, however, that the Government shall give advance notice to the Committee before it issues a final notice. In the event of cancellation, the Government will notify NISH and request that another nonprofit agency be found to perform the service. If another nonprofit agency is not available to perform the contractual requirements, then the Committee will grant a purchase exception permitting a commercial solicitation.
