The purpose of this Amendment is to:

2) Revise the Solicitation Bid Schedule (B Pages) to correct a pay item description and quantity.

3) Revise the Plans to update pay items, utility plan, and temporary traffic control plan.

4) Include updated Building, CZM, and USACE Permits.

1) Provide a summary of responses to questions/clarifications submitted by potential bidders.

The RFP Proposal Package (both Technical and Price proposals) due date of August 4, 2017, at 2:00 p.m. will remain the same.

Questions/Clarifications

Bidders can send written questions or inquiries for clarification to: eflhd.contracts@dot.gov.

Questions can be submitted at any time, but questions submitted within 7 days of the bid opening may not be answered in time for the bidder to properly incorporate the responses into their bids.

The following questions and issues were submitted via email. The Government response or clarification is provided. Due to the repetitive nature of several questions and issues, the wording of the questions may have been revised and some questions have not been included.

The Government’s direct response to the sender may also have been updated below for better clarity.

1. Special Contract Requirement Subsection 204.10(e)(3)(c)(2) anticipates a settlement monitoring period of 60 days from completion of the surcharge and preload fill placement. If the settlement criteria is not achieved in the anticipated 60 day time period, will the Contractor be eligible for a compensable time extension per FP-03 Subsection 108.03?

Response: The period of 60 days is an approximate and is provided for guidance. If this period takes longer than anticipated, it would not be considered as a compensable time extension.

2. Will the existing riprap need to be processed into a smaller size before it can be used in front of the block wall? What size riprap will be required for use in front of the block wall?

Response: We do not expect that the existing riprap will have to be processed to be placed in front of the wall.

3. Demolition plans direct the Contractor to remove portions of the stone masonry wall.

Demolition Note 13 on Plan Sheet A-09 directs the Contractor to remove the wall in conflict with the road base. The measurement for this pay item by the square yard. Please provide details of the stone masonry wall and the limits of removal so that the Contractor can accurately quantify the volume and deflective cracking of the roadway is avoided.

Response: The stone masonry wall limits are shown on the Demolition Plan (plan sheets A- 24 to A-28). The structure is to be removed to a depth that eliminates conflicts with the placement and compaction of the roadway subbase as approved by the CO.

4. Refer to plan sheet A-09 Note 3. Where is the cost of removing the sanitary line to be paid?

Also, indicate where the sanitary line removal begins and ends.

Response: This work is included under pay item 20304-5000 Removal of Building (Existing Pump House). The limits will be as needed to properly build the proposed work. Please refer to Demolition Plan Sheet.

5. Where is the cost of removing the electrical service to the pump house is to the to be paid?

Also, indicate where the electrical utility removal begins and ends.

Response: This work is included under pay item 20304-5000 Removal of Building (Existing Pump House). The limits will be as needed to properly build the proposed work. Please refer to Demolition Plan Sheet.

6. Hardscape Plan Sheet U-12 references civil drawings for the concrete bollard rebar design, bulkhead, substrate details. Please provide details for this work.

Response: Information about the reinforcement for these items can be found in Section W of the plans. Plan sheets W-01, W-14, W-15, and W-16 provide specific information about the bollards, coping, and steps.

7. Hardscape Plan Sheet U-10 calls out brick pavers to be placed on a concrete base. Plan Sheet B-02 shows the Sidewalk Brick Border Detail with the brick placed on 1.5-inch bedding sand on 4-inch compacted subgrade. Please confirm if the brick pavers are to be placed on a concrete base.

Response: Most brick pavers will be placed on a concrete base as shown in the “Eurocobble/Brick Pavers Installation Detail” on plan sheet B-02. The “Sidewalk Brick Boarder Detail” only applies to brick pavers used as a border between sidewalk panels (refer to plan section U, Hardscape Plans).

8. Is the concrete slab under the Eurocobbles and Brick Pavers incidental to those pay items?

Response: No. The 10-inch concrete slab underneath the Eurocobbles within the roadway prism will be paid under pay item 50101-1500 Reinforced Rigid Pavement, 10-inch, Type C Smoothness/Roughness. The 4-inch concrete slab underneath the Eurocobbles and Brick Pavers will be paid under pay item 61501-0100 Sidewalk, Concrete 4-inch.

9. Plan Sheet M-05 calls out ‘Constr. Temp 15” Pipe’. How is this work paid?

Response: This is an error in the plans. There shouldn’t be a temporary 15-inch pipe at this location. This should be a permanent 18-inch pipe installation, which would be paid under pay item 60201-0600 18-inch Pipe Culvert (RCP). Also, see plan sheet E-05.

10. Drainage Plan Sheets direct the contractor to desilt existing storm pipe and structures. What are the limits of desilting and how is this work paid?

Response: The limits of this work is an “as needed” quantity to ensure proper drainage.

This work would be incidental to structures connecting to the existing structures to be desilted.

11. Utility Plan Sheet G-01 direct the Contractor to install 4 - 4-inch electrical conduits to supply Legislature. The limits of this work are beyond the roadway construction limits. Will these conduits be placed in a duct bank? How will this work be paid and what are the allowable installation methods at this intersection?

Response: This work will be paid under pay item 63610-2800 Conduit, 4-Inch, PVC, Schedule 40 in Duct Bank (Underground). An additional 180 feet will be added to cover this amount.

12. Utility Plan Sheet G-02 requires the removal of a 24-inch watermain. How will this work be paid and what are the limits of removal?

Response: This watermain is to be plugged with concrete at both ends and abandoned in place.

13. Some of this work will not be done for 3 to 4 years after the bid date, and without an escalation clause, are we to guess the unit rates of these items or can this project have some sort of escalation clause in it (eg. plantings, pavement markings, concrete…)?

Response: A escalation clause is not part of this contract.

14. It is anticipated that the existing subbase will not be suitable - if this is the case, will the excavation and removal from site be paid under "Roadway Excavation" or should it be included in the "Subbase Grading" unit price?

Response: If the existing subgrade is not suitable and needs to be subexcavated, the additional material excavated will be paid using pay item 20401-0000 Roadway Excavation in accordance with Subsection 204.16(a)(1)(c) of the FP-03. The material used to backfill these subexcavated areas will be paid using pay item 20420-0000 Embankment Construction, in accordance with Subsection 204.16(c)(1)(b).

15. The USVI Supplemental Specification for sod, Section 02934, Subsection 1.5(E)) states "Sod shall be delivered no more than 36 hours after harvesting. All sod delivered shall be installed within 18 hours of delivery to the job site. Any sod not installed within 18 hours shall be rejected." This would be impossible to get material here in this time constraint from Florida.

Puerto Rico growers could not meet other requirements listed on sod specifications such as 'Growers Certification', ASPA Grade...

Response: These specifications are correct.

16. The USVI Supplemental Specification for sod (Section 02934) are for that of a golf course.

This is extreme overkill for a project such as this and any Contractor is going to have a tough time adhering to these requirements as they are not realistic.

Response: These specifications are correct.

17. Refer to USVI Supplemental Specifications 02934 “Sodding” and Section 02950 “Trees, Shrubs, and Groundcovers”. Does sod maintenance and mowing end at: (a) the final project completion date (Subsection 3.4(C) of Section 02934), or, (b) on the date of substantial completion which is after a 60-day period of maintenance (Subsection 3.8(F) of Section 02950)?

Response: Sod maintenance and mowing will end at the later of these dates.

18. We cannot find section -2240 - Earthwork. What is the composition and depth of the subsoil for sodded areas? What depth is planting mix A installed for sod areas?

Response: For the sodded areas, clear and grade the existing subsurface. In addition, cultivate, disk, harrow, or otherwise loosen the grade to a depth of at least 4 inches.

Remove surface stones not passing 1-inch sieve, sticks, stumps, and other surface debris interferes with sod placement or subsequent growth.

The planting mix A should be placed to a depth of 6 inches.

19. The Coastal Engineering Report and Plan Set W outline the hydrostatic and dynamic wave forces that should be used in the design of the retaining wall. Within both documents, there are two dynamic conditions that appear in the tables: Wave Crest and Wave Trough. On Plan Set W, page W-2 Section 6, Note B states: “Assume the dynamic wave trough elevation and pressure shown above for the static pressure on the front side of wall. Assume the water level on the retained side of wall is equal to the wall height.”

(a) Is the elevation (negative value in table) that is given for the wave trough, measured below the MLLW?

Response: Yes.

(b) If we assume that the answer to Question (a) is yes and we include the requirements of Note B, this would result in approximately 10.7-feet of water pressure differential and a net hydraulic load acting on the back of the wall. The Coastal Engineering Report, on page 44, mentions this condition may occur during Wave Trough.

1. Is our interpretation of the potential differential water pressure at Wave Trough correct?

Response: This is probably for a specific location where the height differential between the coping (above MLLW) and the top of wave for trough condition (below the MLLW) is 10.7 ft.

2. In review of the Structural Design Final Calculations Report, it does not appear that the Wave Trough dynamic loading condition was included. Will you be issuing additional calculations showing the impact of this load and the effect on the overall block depths?

Response: No. The global stability of the wall was checked for a rapid draw down condition that would result in a net hydraulic load behind the wall (see the geotechnical report). The internal stability of the wall is the responsibility of the contractor. The wall should be designed to withstand lateral earth pressure, water pressures, including earth pressures induced from live, surcharge, seismic loads, as required by the provided contract documents. As indicated on page 7 of the Structural Design Final Calculations document, the block, height, width and depth will vary depending on the proprietary design.

20. Has the design for the coping been finalized as shown in the plans or is the coping design the responsibility of the wall designer?

Response: The design for the coping is finalized as shown in the plans. Adjustments may be needed depending on the geometry of the wall.

21. Assuming the Extreme Event of wave trough must be considered in the analysis of the retaining wall, is it acceptable to use the full dead load of the block above the trough elevation and the buoyant dead load of the block below the trough elevation?

Response: Yes.

22. Neither the “Structures Design Final Calculations” document or “Plans Section W” mention any type of uplift force being applied to the retaining wall as a result of wave action. Is it acceptable to assume that the 5-foot deep block, shown at the top of the wall in the cross sections found in Plan Section W, is sufficient to resist any uplift forces that may be applied?

Response: The uplift force due to wave action should be considered in the wall design.

NOTE: The term "you" and its derivatives, as used in this permit, means the permittee or any future transferee. The term "this office" refers to the appropriate district or division office of the U.S. Army Corps of Engineers (Corps) having jurisdiction over the permitted activity or the appropriate official of that office acting under the authority of the commanding officer.

You are authorized to perform work in accordance with the terms and conditions specified below.

Project Description:

Widening of a 1.38 mile long section of Veterans Drive along Charlotte Amalie’s waterfront. Veterans Drive is currently a four-lane roadway with no median. The proposed Veterans Drive is a tree-lined four-lane roadway divided by an 11 foot raised median. Additionally, in order to enhance the aesthetics of the roadway and waterfront, a four foot landscaped buffer along with a 26 foot promenade will be developed. The proposed promenade width between Palm Passage and Tolbod Gade will vary from 30 foot to 50 foot to allocate space for a double tree row. The project will be accomplished by placing a new seawall and an approximately 50 foot (average) wide section of fill into the harbor along the existing shoreline. The widening of Veterans Drive will be conducted in three (3) phases. Phase I limits extend from the Long Bay Road intersection to Hospital Gade, a distance of approximately 0.46 miles. Phase II limits extend from Hospital Gade to Kronprindsens Tvaer Gade (Windward Passage Hotel), an approximate distance of 0.92 miles. Phase II will comprise Phase IIA from Hospital Gade to Tolbod Gade and Phase IIB from Tolbod Gade to Kronprindsens Tvaer Gade.

The construction of the entire project is expected to be completed by the year 2023 with a total cost of approximately $140 million.

The project will require dredging approximately 39,252 cubic yards of sediments from the bottom of Charlotte Amalie Harbor along the shoreline. Dredging will be done from a barge using a clamshell dredge. Dredge spoils will be dewatered on the barge and then transferred to trucks on shore for disposal in uplands in an existing landfill. Excess water from the barge will be discharged back into the harbor. The dredged area will be

PERMITTEE: U.S. Virgin Islands Department of Public Works then filled to achieve the necessary ground levels and conditions. Approximately 8.57 acres of Charlotte Amalie will be filled for the roadway expansion. The project will result in permanent impacts to approximately 4.45 acres of muddy sea bottom, 1.15 acres of seagrass beds, and 2.97 acres of coral colonized hard bottom in the Charlotte Amalie Harbor. In addition, approximately 0.32 acres of seagrass, 0.69 acres of mud bottom, and 0.27 acres of colonized hard bottom will be temporarily impacted during project construction by barge spudding, anchoring of turbidity barriers, and sediment resuspension within the area between the new wall and the turbidity barriers. The majority of the work necessary to complete the project will be performed from the water using spud barges in the harbor. During construction, temporary marker buoys will be installed along the seaward limits of the in-water work footprint. Also, turbidity barriers will be placed around all in-water work prior to commencement of any dredging or fill discharges.

The seaward side of the roadway expansion will be a quay block wall with granular backfill of different sizes to allow a gradation and stabilize the fill. Dewatering of the area behind the wall in order to complete the fill placement for the roadway expansion will be done in a controlled manner through turbidity barriers using pumps. The dewatering rate will be controlled to ensure there are no turbidity plumes outside the work area, which will also be verified through the implementation of a water quality monitoring plan. Any piles or sheet piles necessary for the construction of the project and its new sea wall shall be installed with the use of a vibratory hammer. Impact hammer could be used if required by substrate conditions, but only after appropriate coordination with the pertinent agencies, per the conditions of this permit.

The design of the roadway expansion around the Legislature Building and the U.S.

Coast Guard (USCG) facilities also requires modifications to the USCG dock. The dock will be modified such that the eastern section will be replaced with the new roadway and the western section will be connected to the new promenade.

The work described above is to be completed in accordance with the 28 pages of drawings (Attachment 1), as well as the additional attachments affixed at the end of this permit instrument.

Project Location: The project site is located in a 1.38-mile corridor along the shoreline of Charlotte Amalie Harbor, from west of Kronprindsens Tvaer Gade (Windward Passage Hotel) to Long Bay Road/W.G. Lewis Lane/Lovers Lane (Route 314), Charlotte Amalie, St. Thomas, U.S. Virgin Islands.

Directions to site: From the St. Thomas Airport head east on Route 302 approximately ¾ miles and turn right onto Route 30. Head east on Route 30 for about

1.5 miles to reach the start of the project corridor.

Permit Conditions

General Conditions:

1. The time limit for completing the work authorized ends on . If you find that you need more time to complete the authorized activity, submit your request for a time extension to this office for consideration at least one month before the above date is reached.

2. You must maintain the activity authorized by this permit in good condition and in conformance with the terms and conditions of this permit. You are not relieved of this requirement if you abandon the permitted activity, although you may make a good faith transfer to a third party in compliance with General Condition 4 below. Should you wish to cease to maintain the authorized activity or should you desire to abandon it without a good faith transfer, you must obtain a modification of this permit from this office, which may require restoration of the area.

3. If you discover any previously unknown historic or archeological remains while accomplishing the activity authorized by this permit, you must immediately notify this office of what you have found. We will initiate the Federal and State coordination required to determine if the remains warrant a recovery effort or if the site is eligible for listing in the National Register of Historic Places.

4. If you sell the property associated with this permit, you must obtain the signature and the mailing address of the new owner in the space provided and forward a copy of the permit to this office to validate the transfer of this authorization.

5. If a conditioned water quality certification has been issued for your project, you must comply with the conditions specified in the certification as special conditions to this permit. For your convenience, a copy of the certification is attached if it contains such conditions (Attachment 2).

6. You must allow representatives from this office to inspect the authorized activity at any time deemed necessary to ensure that it is being or has been accomplished in accordance with the terms and conditions of your permit.

Special Conditions:

1. Reporting Address: The Permittee shall submit all reports, notifications, documentation and correspondence required by the general and special conditions of this permit to the addresses listed below. The Permittee shall reference permit number SAJ-1996-01459 (SP-JCM), on all submittals.

For the Corps:

2. Commencement Notification: Within 10 days from the date of initiating the work authorized by this permit, the Permittee shall provide a written notification of the date of commencement of authorized work to the Corps.

3. Self-Certification: Within 60 days of completion of the work authorized by this permit, the Permittee shall complete the attached “Self-Certification Statement of Compliance” form (Attachment 3) and submit it to the Corps. In the event that the completed work deviates in any manner from the authorized work, the Permittee shall describe the deviations between the work authorized by this permit and the work as constructed on the “Self-Certification Statement of Compliance” form. The description of any deviations on the “Self-Certification Statement of Compliance” form does not constitute approval of any deviations by the Corps.

4. Agency Changes/Approvals: Should any other agency require and/or approve changes to the work authorized or obligated by this permit, the Permittee is advised a modification to this permit instrument is required prior to initiation of those changes. It is the Permittee’s responsibility to request a modification of this permit from the Corps.

The Corps reserves the right to fully evaluate, amend, and approve or deny the request for modification of this permit.

5. Assurance of Navigation and Maintenance: The Permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structures or work herein authorized, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the Permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration.
