The purpose of this Amendment is to:
1) Provide a summary of responses to questions/clarifications submitted by potential bidders.
2) Provide missing Section E plan sheets E-14 thru E-27.
3) Provide Pre-Bid Meeting Minutes.

Questions/Clarifications
Bidders can send written questions or inquiries for clarification to: eflhd.contracts@dot.gov.
Questions can be submitted at any time, but questions submitted within 7 days of the bid opening may not be answered in time for the bidder to properly incorporate the responses into their bids.
The following questions and issues were submitted via email. The Government response or clarification is provided. Due to the repetitive nature of several questions and issues, the wording of the questions may have been revised and some questions have not been included.
The Government’s direct response to the sender may also have been updated below for better clarity.
1. Please confirm if sheet piling is, or is not allowed to be used during the construction of this project.
Response: The environmental compliance documents do not allow sheet piling to be used for either the permanent wall construction or for the temporary construction of a cofferdam. Sheet piles may be used for miscellaneous items that are permitted by the environmental compliance documents, such as underground utility installations.
2. Must the professional engineer that stamps the final plans for the retaining wall be licensed in the U.S. Virgin Islands or will a U. S. State Certification suffice? Subsection 104.03(b)(2) of the Special Contract Requirements (SCRs) indicates that wall drawings are to be submitted by a “proficient engineer”.
Response: According to Subsection 104.03(b)(2) of the SCRs and the definition of a professional engineer (PE) in Subsection 101.04 of the FP-03 (standard specifications book), the plans for the modular block wall are to be signed by a PE who is proficient in the pertinent design field of the work and is certified in the United States or its territories.
3. Can the “lifting loops” used to handle the concrete retaining wall blocks be galvanized (as opposed to stainless steel)? The “lifting loops” are not a structural reinforcement item. Sheet W- 2, Note 8 of the Wall Profiles package indicates that “reinforcing steel” shall be stainless steel.
Response: The lifting loops must be stainless steel also.
4. Sheet W-2, Note 12 of the Wall Profiles package calls for “integral color” to be added to the concrete mix. Would it be acceptable to utilize the integral color in just the front 12 inches of the face of the block and then use uncolored concrete for the balance of the block? There would NOT be a “cold joint” between the two different colors of concrete. The second pour of the uncolored concrete would take place right after the first 12 inches of colored concrete is placed.
Response: Using integral color for just the front 12 inches of the concrete face of the block will not be acceptable. The concrete mix must be uniform throughout the block.
5. There will be a significant portion of the retaining wall that will be buried below the scour line. Would it be acceptable that retaining wall blocks that will be buried below grade have no mailto:eflhd.contracts@dot.gov integral color added? Would it be acceptable that the retaining wall blocks that will be buried below grade have no “architectural” face surface, but rather be smooth formed concrete?
Response: Yes, it would be acceptable to provide blocks without integral colored concrete and/or provide blocks without an concrete face architectural surface provided they are entirely below grade.
6. Sheet W-3, Note 4 refers to Sheets U-1 to U-15 for additional Wall Details. Where are these Sheets?
Response: The note in question reads “See Hardscape Plans, sheet U-1 to U-15 for additional wall details.” The intention of this note is to direct contractors/bidders to the hardscape plans, which are part of Section U of the plans and contain information of items that are to be built on top or in the vicinity of the wall. For example, sheet U-12 provides the details for the concrete bollards that are built on top of the wall.
7. Subsection 257.05 of the SCRs (RFP / Solicitation, page 135 of 212) indicates that there must be a field representative of the wall manufacturer on site during wall construction. Does this mean on site for the entire duration of the construction? Can you confirm that the “wall manufacturer” is the entity that actually manufactures the blocks (as opposed to a representative of the entity that has designed the block being utilized on the project)?
Response: The wall manufacturer field representative does not have to be on the project throughout the entire duration of the construction of the wall. The wall manufacturer is to be onsite during critical wall placement operations, such as leveling the blocks and coming up out of water, in order to ensure proper installation of the wall.
The Contractor must provide a representative from the wall manufacturing or design company that can provide insights and recommendations regarding the installation of the wall and can handle difficulties that occur during installation of the wall to ensure its proper installation.
8. Subsection 720.02(c) of the SCRs (RFP / Solicitation, page 172 of 212) says that the retaining wall blocks must be finished on the front face with “class 1 finish”. What is this? The blocks will have an architectural finish that is a part of the production process.
Response: Class 1 finish is an ordinary surface finish, which is explained in Subsection
552.16 of the FP-03.
9. Subsection 720.02(f)(3) of the SCRs (RFP / Solicitation, page 173 of 212) says that surface defects on smooth concrete cannot be greater than 1/8” and on the face no greater than 5/16”. Is a bug-hole (a naturally occurrence with concrete, especially on the vertical sides of a form) considered a defect? If so, this will be hard to achieve and at a minimum require the use of self-consolidating concrete.
Response: A bug-hole could be considered a defect if it does not comply with the concrete finish specifications. Appropriate concrete mix design, concrete admixtures, concrete form materials and form releases, and concrete placement will minimize the size and frequency of bug-holes or eliminate bug-holes.
10. Will bidders be allowed to contact Parsons Brinkerhoff for questions?
Response: No. All questions must be submitted in writing to EFLHD.Contracts@dot.gov.
11. We would like to request a bid extension of 4 weeks so that we may be able to provide the best possible bid submittal.
Response: We cannot provide an extension at this time. All proposals are due August 4, 2017 as stated in the solicitation.

Pre-Bid Meeting Minutes
Project VI DPC 34(1) Improvements to Route 30 (Veterans Drive)

Introduction
I want to start by welcoming you to the pre-bid meeting for the VI DPC 34(1) project, Improvements to Route 30 (Veterans Drive) form Hospital Gade to the intersection between Longbay Road and W.G. Lane.
Thank you for all being here today and showing interest in our project. Today, we will be providing a project overview, we will go over the different Bid Documents, and briefly go over the proposal instructions.
Project Overview
The VI DPC 34(1) project consists of the reconstruction and widening of 0.46 miles of Veterans Drive (Route 30) from west of Hospital Gade to Long Bay Road in the city of Charlotte Amalie, St. Thomas, USVI.
This is the first phase of the overall improvements to Veterans Drive which will be done from Kronprindsens Tvaer Gade to the Long Bay Road/ W.G. Lewis Lane intersection (approximately
1.38 miles).
Veterans Drive will be widened towards the bay to add 2 additional traffic lanes, medians, and a promenade, among other features.
The work includes roadway excavation, embankment, aggregate base, asphalt pavement milling, hot asphalt concrete pavement, reinforced concrete pavement, concrete curb and gutter, concrete, brick, and cobblestone sidewalk, precast modular block retaining walls, drainage, utility (water, telephone, sewer, power, and irrigation) adjustments and replacements, traffic signal and street lighting replacements, and other miscellaneous work.
The purpose of this project is to alleviate the existing traffic congestion, provide additional roadway capacity, improve safety for motorists and pedestrians, enhance the aesthetics of the waterfront, and enhance cultural and historical features.
We estimate the price for this project will be greater than $25 million.
Bid Documents
Let’s discuss the bid documents that are available on the Federal Business Opportunities Website.
The documents that are available are:
1. Request for Proposal – The request for proposal contains many clauses related to the contract and the procedures on how to submit a solicitation. It includes the following sections:
- Notice to Offerors – which contains information the offerors need to be aware of. For example, some of the items discussed in this section are:
o The prime contractor need to perform with its own forces work equivalent to at least 35% of the contract;
o A reminder to review Subsection 109.05 of the FP, which discusses direct and indirect payment under a pay item in the bid schedule;
o Information about the location on where the RFP documents are located and where to send your questions to. If you have any questions remember to email them to eflhd.contracts@dot.gov. Also, remember that the contractor is solely responsible for monitoring the web pages noted above for all changes to the solicitation and acting on said changes; and o The DBE Subcontracting goal for this project is 15% of the total contract amount and that the contractor must submit a subcontracting plan, among other items.
- Checklist for Offer Submittals – which is a checklist of items included in the proposal package that are required to be completed and returned to the address in Block 7 of the Standard Form 1442 (Solicitation, Offer, and Award) or be filled online. This checklist is for informational purposes only and is not required to be filled out by the bidder. Remember that failure to submit a complete bid may be cause to reject your bid.
- DBE Commitments Forms – include these with your bids.
- SF-1442 Solicitation, Offer, and Award.
- Proposal Schedule Instructions (which we will discuss in detail later).

After these sections, the RFP has the Federal Acquisition Regulation & Transportation Acquisition Regulation Solicitation Provisions & Contract Clauses sections, which includes:
- Index to Federal and Transportation Acquisition Regulations – which are clauses that are included in the contract by reference and can be accessed electronically as indicated in the document.
- Representations and Certifications (OCRA online) – this section discusses items such as business sizes.
- FAR and TAR Instruction to Bidders – contains information such as that the contract will be a firm-fixed price contract, the bid guarantee that is to be 20% of the bid price or $3M (whichever is less), information about protests, and site visits, among other information. It is important to point out that Jomo McClean is the point of contact for site visits and visits can be arranged during normal duty hours, but he is not available for answering any questions. All questions must be directed to EFLHD at eflhd.contracts@dot.gov.
- Socioeconomic Program Requirements – this section contains information about socioeconomic requirements such as the Buy American – Construction Materials, Buy American – Construction Materials under trade agreements, Nondiscrimination because of age policy and other socioeconomic requirements.
- Minimum Wage Schedule – if these rates change before award, the wage schedule will be updated in the contract.
- FAR and TAR Clauses General Contract Requirements – this section includes general contract clauses such as Contractor Employee Whistleblower Rights and Requirement To Inform Employees of Whistleblower Rights, Performance and Payment Bonds – Construction, and Value Engineering – Construction, among others.
- FAR and TAR Construction Contract Requirements – this section includes FAR and
TAR clauses that apply to construction contracts, such as Commencement, Prosecution, and Completion of Work, Liquidated Damages, Variations in Estimated Quantity, and the Post Award Evaluation of Contractor Performance, among others.
- Special Contract Requirements (J-Pages) – these are requirements that amend and supplement the Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects (FP-03). This is a good time to remember the hierarchical order of our contract documents. This is FAR, TAR, Special Contract Requirements, Plans, and lastly the standard specifications. This means that the information in this pages are requirements that supersede or supplement what is in the plans and standard specifications, so understanding them is important to provide an accurate bid and properly perform the work.
- FAR and TAR Representation and Certifications Clauses (Section K) – includes the
Certification Regarding Responsibility Matters, Information Regarding Responsibility Matters, Compliance with Veterans’ Employment Reporting Requirements, Prohibition on Conducting Restricted Business Operations in Sudan— Certification.
2. Plans – broken down into Sections (A, B, C, D, E, F, G, H, M, N, R, S, T, U, V, and W).
3. FP-03 – standard specifications.
4. FP-03 Errata – corrections made to the specifications.
5. DPW and WAPA Supplemental Specifications
a. These two supplemetal specifications contain special requirements for applicable
DPWs and WAPA work.
6. Reports
a. Environmental Assessment – there are reports within the Environmental
Assessment that were not broken down into separate reports. These includes reports such as the SWPPP and the Asbestos and Lead Containing Materials Survey Report.
b. Finding of No Significant Impact (FONSI)
c. Traffic Management Plan
d. Traffic Report (2008)
e. Geotechnical
f. Costal Engineering

It is important to remember that these reports and other bid documents may contain requirements or information that will be necessary to successfully complete the work. For example, the EA, FONSI, and Environmental Permits may contain requirements that are not directly specified in plans or specifications, but must be met regardless.
Request for Proposal Procedures
The Proposal Instructions in the RFP were discussed with the attendees after the general discussion of the bidding documents. The proposal due date is August 4 at 2:00 p.m.
We encourage everyone to submit technical questions in writing to eflhd.contracts@dot.gov by July 23. This date is set, because after this date we cannot guarantee that your questions will be answered with sufficient time for you to be able to take action. This doesn’t mean that a question cannot be submitted after this date.
