The purpose of this Amendment is to:

1) Add FAR Clause 52.229-4 -- FEDERAL, STATE, AND LOCAL TAXES (STATE AND LOCAL ADJUSTMENTS) -- FEB 2013 to the Contract Clauses Index.

2) Provide a summary of responses to questions/clarifications submitted by potential bidders.

Questions/Clarifications

Bidders can send written questions or inquiries for clarification to: eflhd.contracts@dot.gov.

Questions can be submitted at any time, but questions submitted within 7 days of the bid opening may not be answered in time for the bidder to properly incorporate the responses into their bids.

The following questions and issues were submitted via email. The Government response or clarification is provided. Due to the repetitive nature of several questions and issues, the wording of the questions may have been revised and some questions have not been included.

The Government’s direct response to the sender may also have been updated below for better clarity.

1. Can you please give us the specifications for the recycled riprap that can be placed at the backfill toewall?

Response: Miscellaneous Note 2 on plan sheet W-2 indicates that “upon approval of the CO rip rap and boulders along the existing wall may be reused in front of the wall as shown in the contract drawings at no additional cost to the Government. Riprap that does not meet with the CO’s approval shall be disposed of in accordance with specification section 203.05”. Section 251 of the FP-03 (standard specifications book) and the Special Contract Requirements (SCR - J Pages of the solicitation booklet) contains specifications for riprap.

2. How will the Contractor be paid for removal, disposal, and replacement of riprap that does not meet the CO’s approval?

Response: This work would be paid under pay item 20305-3000 Removal of Boulder (Riprap). Also, refer to Demolition Note #5 on plan sheet A-09 and the summary of quantities on plan sheet C-06.

3. Can you please describe the location of where these 8 cubic yards of placed riprap (pay item number 25101-0000) are to be placed?

Response: Plan sheet C-09 indicates that the 8 CUYD of riprap will be placed at Station 259+72 at an offset of 37’ LT, however the note should say RT. Plan sheets D-05, E-08, and E-26 show riprap being placed at the outfall pool from Station 259+63.86 to Station

259+86.96 RT.

4. Does the landscape subcontractor provide dumpsters for their phase of the contract?

Response: This type of item would be part of the agreement between the prime contractor and the subcontractor.

5. Is a landscape subcontractor responsible for traffic control and signage and safety fence around palm holes?

Response: This type of item would be part of the agreement between the prime contractor and the subcontractor.

6. We would request additional time for the technical and cost proposal preparation. Please consider extending the submission date until August 25, 2017.

Response: All proposals are due August 4, 2017 as stated in the solicitation and there is no intention of providing an extension at this time.

7. Regarding the Technical Proposal Factor 3 – Qualifications and Past Performance. Please confirm that key subcontractor experience can be included as part of the Offeror’s past performance example projects to comply with the 3 project within the past 10 years requirement.

Response: Key subcontractor experience can be included as part of subfactor (a) “Example Projects” of Factor 3 – Qualifications and Past Performance of the Technical Proposal if the subcontractor is included as part of the proposed project team in subfactor (b) “Proposed Team”. The Offeror (prime contractor) will still be required to submit the “Offeror's Qualifications Form” as part of the Government’s determination of being a responsible contractor.

8. There is a possibility that tipping fees may be implemented at the landfill in the coming months. Although this has been talked about for years, it may happen within the timespan of this project. To make it a “level playing field” for all bidders, can we base our bid on the conditions ‘as is’ right now with no tipping fees, and should tipping fees be implemented, then this will be considered as a change order? Since this is a Government project, will these fees be waived or should they be included in the pricing?

Response: Do not including “tipping fees” in your bid prices. FAR Clause “52.229-4 Federal, State, and Local Taxes (State and Local Adjustments)” is being added to the contract and states, “The Contractor shall promptly notify the Contracting Officer of all matters relating to Federal, State, and local taxes and duties that reasonably may be expected to result in either an increase or decrease in the contract price and shall take appropriate action as the Contracting Officer directs. The contract price shall be equitably adjusted to cover the costs of action taken by the Contractor at the direction of the Contracting Officer...”.

9. Will the Contractor be required to submit signed and PE stamped design documents for the wall?

Response: Yes, please refer to Subsection 104.03(b)(2) of the SCR (page J-4).

10. If the wall blocks are manufactured without rebar will Stadium Testing be required?

Response: No, only reinforced concrete requires the Stadium modeling to be performed.

Please refer to Subsection 552.03 of the SCR (page J-68) for further explanation.

11. Please clarify why Subsection 720.01 of the RFP (page J-100) indicates that the Precast Modular Block Material should “conform to Section 552”.

Response: Section 552 of the FP-03 and the SCR (page J-68) contains other concrete mix requirements that apply the precast modular block wall.

12. Please clarify Subsection 552.03 of the RFP (page J-68) which reads “Furnish a reinforced concrete that will have a minimum 75-year service life prior to failure as determined by a computer simulation program that predicts service life of reinforced concrete exposed to chlorides. Acceptable programs are: …”.

Are the blocks that have no reinforcing steel in them subject to the provisions of Section 552 and the need to model a 75-year life? Obviously, they will have the required minimum 4000 psi concrete, conform to other QA requirements, and be made of Class A(AE) Concrete.

Is corrosion inhibitor required for the retaining wall blocks and coping? If so what is the dosage rate?

Response: Subsection 552.03 contains different requirements concerning the structural concrete mix. All the concrete blocks for the precast modular block wall are subject to the requirements in Section 552 as applicable.

Regarding the requirement requiring the use of the computer simulation program that predicts the service life of reinforced concrete exposed to chlorides, it only applies to the concrete mix for the blocks that contain reinforcing steel in them. Furthermore, if the reinforcing steel utilized for the wall steps, bollards, and coping is either Type 2304 Duplex Stainless Steel or Type 316L Stainless Steel, the requirement will be waived. For more information, please refer to Subsection 552.03 of the SCR.

The need to use and the dosage of a corrosion inhibitor is to be proposed by the Contractor during construction as part of the 75-year service life design for review and approval by the CO.

13. On Sheet W-2, Note 8 refers to “Stainless Steel” rebar. Can you clarify where this is to be used?

Response: This note refers to the steel reinforcement which is shown in Section W of the plans. Stainless steel rebar is to be used for the steel reinforcement of the wall coping, steps, and bollards. See plan sheets W-14, W-15, and W-16.

14. Is there a permitted offshore disposal site for the spoils from the wall excavation?

Response: No.

15. With reference to the 11,810 cubic yards on Sheet C-07 labeled “Wall Disposal Material”, can you please describe what this refers to as opposed to the “Structure Excavation”?

Response: The “Wall Disposal Material” and the “Backfill Toe Wall” quantities are portions of the “Structure Excavation” item and are provided for informational purposes only. The “Wall Disposal Material” is the amount of structure excavation material that is estimated to be disposed of and the “Backfill Toe Wall” quantity is an estimate of the amount of the structure excavation material that could be used to backfill in front of the wall as approved by the CO. Refer to plan sheets W-13 and W-14.

16. In evaluation of all permitted environmental compliance documents issued with the bid documents, references were made to the use of temporary sheet piles for dewatering to construct the seawall in the Environmental Assessment. Please specify where the use of temporary sheet piles for the construction of a cofferdam is prohibited for construction of the precast modular block seawall.

Response: The coordination for the Environmental Assessment was done with the assumption that the construction of the wall would not require pile driving and therefore, the review of the document and the answers provided by the reviewing and approving agencies took this into consideration. The project description section of the Environmental Assessment (page 11) indicates “Dewatering is neither required nor proposed for the construction of the new quay block wall. At this time, the project does not include pilings;

however, the contractor may require the use of driven piles and dewatering to assist with installation of specific underground utilities.” Other statements in the Environmental Assessment that refer to this are located on pages 177, 204, 249, 251, 1073, and 1075. Page 251 even makes a reference that the project was modified eliminating pile driving for temporary or permanent sea wall construction.

Incorporating the use of sheet piles for a cofferdam or for permanent wall construction would require the modification of the Environmental Assessment, which could be a lengthy process and there is no guarantee that it would be approved by the approving agencies.

Therefore, changing the solicitation to allow for the use of driving sheet piles for the wall construction is not possible at this time.

For the purposes of this RFP, Offerors must bid the wall as described in the solicitation documents without the use of sheet piling for its construction. During construction, the Contractor may submit a Value Engineering proposal in accordance with FAR 52.248-3 and Subsection 103.03 of the FP-03 for the Government’s consideration. Bidders are cautioned that submission of a Value Engineering proposal does not mean that it will be approved. Bidders are also cautioned that if a Value Engineering proposal requires the modification of the Environmental Assessment, then final approval of the Value Engineering proposal depends on the Contractor being able to modify the Environmental Assessment, update the existing permits, perform the necessary coordination, and obtain the necessary approvals, so the Value Engineering proposal is in line with the revised Environmental Assessment.

17. Will the Government consider alternatives wall systems that provide a cost-effective solution while maintaining structural and architectural integrity?

Response: For the purposes of this RFP, Offerors must bid the wall described in the solicitation documents. During construction, the Contractor may submit a Value Engineering proposal in accordance to with FAR 52.248-3 and Subsection 103.03 of the FP- 03 for the Government’s consideration. Submission of the Value Engineering proposal does not mean that it will be approved.

18. The Structures Design Final Calculations document references four proprietary Precast Modular Blocks (PMB) that were reviewed for this project. Please provide the names of the additional PMB manufacturers.

Response: The names of the manufacturers referenced in the document are Recon, Redi- Rock, Ultrablock, and Old Castle Precast. By providing this information, the Government is not sponsoring any specific manufacturer or indicating that the submission of a proposal from any of these manufacturers will guarantee approval. Other manufacturers that are not in this list that meet the contract requirements may be acceptable as well.

19. Does the manufacturer of the wall blocks need to be PCI certified?

Response: No.

20. Subsection 257.03 requires soil testing after the foundation is graded and prior to placement of the leveling pad and blocks. What are the preferred testing methods for verifying the bearing pressure of the soils under water?

Response: Subsection 257.03 also indicates “Soil testing methods for verification of soil bearing pressure may include a weighted steel probe or pocket penetrometer. Alternate testing methods may be submitted for approval of the CO.”

21. Plan Sheet W-2, Note 12 reads that the Contractor shall provide a sample of standard colors for the selection by the Owner as part of the wall shop drawings. There is a substantial difference in price depending on the color selected by the owner and the amount of tinting. Please provide a standard color and tint level which all bidders can base their pricing.

Response: This is information is not available. Different color samples are required for the selection of a final color by the Owner as stated in the plans.

22. Does the block wall need to be completed before the surcharge is applied? If not, what is the minimum length of wall that needs to be completed prior to surcharging?

Response: The construction of the wall is required to follow the wall manufacturer’s construction requirements as approved by the CO.

23. Will the fill materials behind the block wall that are below the water line need to be compacted?

Response: Yes. Section 4.4 “Earthwork” of the Geotechnical Report recommends the use of vibro-compaction or a similar method to compact the select granular backfill behind the wall below the water level. The Geotechnical Report indicates that if vibro-compaction or other methods are not feasible, an alternative is to place gravel or crushed stone backfill to the water level behind the retaining wall structures. Please refer to Section 4.4 of the Geotechnical Report for additional information.

24. Sheet U-25 lists several ornamental plants that are not on the plant list provided on sheet C- 18? Do I need quantities of these materials? Is there a layout drawing missing of these ornamental materials listed on sheet U-25?

Response: Some of plants shown in this sheet were included because they were part of the standard symbol and abbreviation templates. The plants to be provided are shown in the plans and listed on plan sheet C-18. No ornamental plants will be required.

25. Sheet U-22 is listed on Sheet U-1 as being 'Landscape Details & Plant List' Plant List is missing.

Response: The required plants are listed in the legends on plan sheets U-16 to U-21.

26. Can you please confirm that the “Shrubs” and “Groundcovers” referenced on Sheet U-25 are only required in the medians?

Response: Shrubs and groundcovers are not required.

27. In Florida, Empire Zoysia is the standard Zoysia which would be shipped in refrigerated trailers. Manila Zoysia is grown in Puerto Rico which produces a substandard project. Can we substitute Emerald Zoysia for the Manila Zoysia?

Response: No.

28. Can manufactured sand produced in St. Thomas be used as the sand and coarse sand component in planting soil mixes?

Response: No.

29. Can a plastic tree ring, which would remain in place be used instead of the “topsoil berm” (Subsection 3.4.A.9, page 31 of the Public Works Technical Specifications)?

Response: Yes.

30. Will the lead based paint found in the building need to be removed off-island by a specialist contractor? Refer to Note 9 on Sheet A-09.

Response: All abatement is required to conform to applicable laws and regulations regarding disposal of hazardous materials.

31. Can “Smooth Wall Polyethylene Pipe” be used instead of the “Concrete Pipe” specified?

Response: No.

32. Would you consider a Catch Basin No. 3 instead of the Type P5 specified as an alternate?

Response: No.

33. The cabinets specified are not the same as what has been specified by the VI PWD and Federal Highway on recent projects. Would it not be better to make them compatible with the other intersections?

Response: No. The intent is to install the specified cabinets.

34. Precast light poles have not been used on any other project here in St, Thomas. Would it not be better to make them similar to the Main Street and Market Square projects?

Response: No. The intent is to install the specified precast light poles.

35. Can you specify the manufacturer of the lighting fixtures detailed on Sheet T-16?

Response: The manufacturer of the lighting fixtures is Steinberg Lighting (Sheet T-18).

36. Is the rebar detailed on Sheet T-19 for the light pole bases to be epoxy coated?

Response: Yes.

37. The 6-inch depth for the hot asphalt pavement item (40201) specified may not be adequate -all other Federal Highway jobs call for 8-inch depth. Is this asphalt section correct?

Response: Yes, the asphalt section noted for the widening and reconstruction segments showing a total 6-inch asphalt depth is correct.

38. The Schedule of Values for Item 61904-0000 reads that the Bollard is 18-Inch x 18-Inch x 4-Inch H. Should this be revised to read 4-Feet H?

Response: Yes, the item should read as 18-inch x 18-Inch x 4-Foot H. The detail for the bollard is shown on plan sheet U-12.
