L.4 AMS 3.9.1-3 PROTEST (October 2011)

AS A CONDITION OF SUBMITTING AN OFFER OR RESPONSE TO THIS SIR (OR

OTHER SOLICITATION, IF APPROPRIATE), THE OFFEROR OR POTENTIAL

OFFEROR AGREES TO BE BOUND BY THE FOLLOWING PROVISIONS

RELATING TO PROTESTS:

(a) Protests concerning Federal Aviation Administration Screening Information Requests

(SIRs) or awards of contracts must be resolved through the Federal Aviation Administration (FAA) dispute resolution system at the Office of Dispute Resolution for Acquisition (ODRA) and must be governed by the procedures set forth in 14 C.F.R. Parts 14 and 17, which are hereby incorporated by reference. Judicial review, where available, will be in accordance with 49 U.S.C. 46110 and must apply only to final agency decisions. A protestor may seek review of a final FAA decision only after its administrative remedies have been exhausted.

(b) Offerors initially should attempt to resolve any issues concerning potential protests with the Contracting Officer. The Contracting Officer should make reasonable efforts to answer questions promptly and completely, and, where possible, to resolve concerns or controversies. The protest time limitations, however, will not be extended by attempts to resolve a potential protest with the Contracting Officer.

(c) The filing of a protest with the ODRA may be accomplished by mail, overnight delivery, hand delivery, or by facsimile or if permitted by order of the ODRA, by electronic filing.. A protest is considered to be filed on the date it is received by the ODRA during normal business hours. The ODRA’s normal business hours are from 8:30 am to 5:00 pm Eastern Time.

(d) Only an interested party may file a protest. An interested party is one whose direct economic interest has been or would be affected by the award or failure to award an FAA contract. Proposed subcontractors are not "interested parties" within this definition.

(e) A written protest must be filed with the ODRA within the times set forth below, or the protest must be dismissed as untimely:

(1) Protests based upon alleged improprieties in a solicitation or a SIR that are apparent prior to bid opening or the time set for receipt of initial proposals must be filed prior to bid opening or the time set for the receipt of initial proposals.

(2) In procurements where proposals are requested, alleged improprieties that do not exist in the initial solicitation, but which are subsequently incorporated into the solicitation, must be protested not later than the next closing time for receipt of proposals following the incorporation.

(3) For protests other than those related to alleged solicitation improprieties, the protest must be filed on the later of the following two dates:

Page L-3

(i) Not later than seven (7) business days after the date the protester knew or should have known of the grounds for the protest; or

(ii) If the protester has requested a post-award debriefing from the FAA Product Team, not later than five (5) business days after the date on which the Product Team holds that debriefing.

(f) Protests must be filed at:

(1) Office of Dispute Resolution for Acquisition, AGC-70, Federal Aviation Administration, 800 Independence Ave., S.W., Room 323, Washington, DC 20591 Telephone: (202) 267-3290, Facsimile: (202) 267-3720; or

(2) Other address as specified in 14 CFR Part 17.

(g) At the same time as filing the protest with the ODRA, the protester must serve a copy of the protest on the Contracting Officer and any other official designated in the SIR for receipt of protests by means reasonably calculated to be received by the Contracting Officer on the same day as it is to be received by the ODRA. The protest must include a signed statement from the protester, certifying to the ODRA the manner of service, date, and time when a copy of the protest was served on the Contracting Officer and other designated official(s).

(h) Additional information and guidance about the ODRA dispute resolution process for protests can be found on the ODRA Website at L http://www.faa.gov.

Page L-6

L.11 COMMUNICATION WITH OFFERORS

The FAA may, at any time, communicate with Offerors on an individual basis to explain or clarify particular aspects of the competition, to negotiate as appropriate the terms and conditions of the proposed contract, or to seek clarification or additional information regarding Offerors’ submissions. Communication with potential Offerors may take place throughout the source selection process. The purpose of communications is to ensure mutual understandings between the FAA and the Offerors on all aspects of the procurement, including the Offerors’ proposals. Communications with one Offeror do not necessitate communications with other Offerors. Information disclosed as a result of oral or written communication with an Offeror may be considered in the evaluation of an Offeror’s proposal. The FAA also reserves the right to allow Offerors to revise their proposals.

To ensure that Offerors fully understand the intent of this SIR, the FAA may hold one-on-one meetings with individual Offerors as it pertains to their Offers. One-on-one communications may continue throughout the process, as required, at the FAA’s discretion. Meetings with one Offeror do not necessitate meetings with other Offerors.

All communications will be conducted through the FAA Contracting Officer. Each Offeror must provide in its submission cover letter a point of contact, telephone number, and email address for purposes of initiating all communications.

L.12 NON-GOVERNMENT PERSONNEL PARTICIPATION

Offerors are advised that individuals from support contractor organizations (including employees, consultants, and subcontractors) may support the evaluation of proposals.

These organizations will not be eligible to participate on an NVRP Offeror team. The FAA currently intends for the following companies to participate in the evaluation but reserves the right to include others:

CEXEC

Cobec Consulting LS Technologies, LLC Noblis.

Individuals employed by these firms will be required to sign nondisclosure agreements (NDAs) and will be authorized to access only those portions of the proposal data, communications, and evaluation materials that are necessary to enable them to provide the required support. If an Offeror objects to the disclosure of information to these non- Government individuals, it must notify the CO in writing no later than 15 calendar days after SIR release and must include a detailed statement of the basis of the objection. The exclusive responsibility for source selection remains with the FAA.

Page L-7

L.13 NUMBER OF AWARDS

The FAA anticipates making one award resulting from this Screening Information Request (SIR). The FAA reserves the right to make multiple awards or not to make an award.

L.14 DISPOSITION OF PROPOSALS

Proposal files will not be returned and a copy of each proposal will be retained in the official contract file.

L.15 GENERAL SIR INSTRUCTIONS

a) Proposals must be provided on standard letter size 8-1/2 by 11 inch paper. The font for text must be Times New Roman, size 12 point, with one inch margins for the left, right, top and bottom of each page. The font for graphics, illustrations, and charts must be eight point or larger. The Offeror may use oversize pages (which must be 17” x 11”) where appropriate to contain complex or extensive graphic presentations. Oversize pages count as 2 pages and margin and font size requirements apply to all oversize pages.

Proposals must be complete and conform to the instructions in this section; incomplete proposals or proposals that contain significant deviations may be excluded from further consideration. Proposals must contain comprehensive, concise, and factual information.

General statements that the Offeror understands the requirements of the work to be performed or simple rephrasing or restating of the Government’s requirements will not be considered adequate. Similarly, submittals that containing omissions or incomplete responses to the requirements of this SIR, that merely paraphrase the Statement of Work, or that use nonspecific phrases such as "in accordance with standard procedures" or "well-known techniques" will also be considered inadequate. Deficiencies of this kind will render the proposal non-responsive and may be cause for rejection of the offer.

b) Any trade secrets, copyright data, or financial information that the Offeror or proposed subcontractors do not want disclosed must be marked in accordance with AMS clause 3.2.2.3-16, Restricting, Disclosing and Using Data (July 2004).

c) The proposal must be signed by an official who is legally authorized to obligate the Offeror to a contract.

d) Each Volume must be contained in a separate file and must be separate and complete in and of itself so that evaluation of one may be accomplished independently of the other.

A cover page must be affixed to each volume that clearly identifies each volume title, volume number, solicitation number, and Offeror’s name. Whenever practical, enclosed headings, subheadings, titles, sequences of material and a number identification system must be used. Information not in its appropriate section or not appropriately referenced may be assumed to have been omitted and potentially not evaluated.

Page L-8

L.16 OVERVIEW OF EVALUATION PROCESS

Small Businesses (SDVOSB)

Each Offeror may submit an NVRP unique subcontracting plan or may make use of its corporate or other applicable, U.S. Government-approved commercial subcontracting plan. If an existing plan is submitted, it must meet the FAA minimum goals stated herein. The four bullets above must be explicitly addressed in any corporate or other applicable, U.S. Government-approved commercial subcontracting plan that you may propose.

An non-small-business Offeror that fails to submit an acceptable subcontracting plan or to correct deficiencies within the time specified by the CO may be ineligible for award.

L.17.8 VOLUME VI MISCELLANEOUS

The following items must be included in Volume VI:

1) Standard Form (SF) 33, "SOLICITATION, OFFER AND AWARD”

Provide a completed Standard Form (SF) 33, "SOLICITATION, OFFER AND AWARD”, with blocks 13 through 18 completed by the Offeror. The representative who signs this form must be authorized to contractually bind the company providing the offer.

Page L-18

An Offeror must also be found responsible by the Contracting Officer prior to the award of any resultant contract. As a minimum, to be determined responsible a prospective contractor must:

• Have adequate financial resources to perform the contract, or the ability to obtain those resources;

• Be able to comply with the required or proposed delivery or performance schedule, taking into consideration all other business commitments;

• Have a satisfactory record of integrity and business ethics;

• Have a satisfactory performance record;

• Have the necessary organization, experience, accounting and operational controls;

and

If any team member is so identified, the Offeror must describe the relevant circumstances.

5) Tailored Contract Response - Sections A through J of this SIR are a “model contract”.

The “model contract” permits Offerors the opportunity to suggest changes to the contract that may improve clarity with respect to the proposed product and corresponding service.

The Offeror’s response to the model contract must be submitted as edits in the Microsoft Word file using strike through for deleted items and bold italicized font style for added

Page L-19 items. If remarks are necessary to explain changes, they should be included in separate pages with reference to the area of the contract being addressed. Alternatively, changes and explanations may be submitted in a separate listing keyed to contract sections and paragraphs addressed. The Government reserves the right and sole discretion to reject any or all proposed changes. The final result is award of a tailored contract to the Offeror that has been selected by the FAA. The tailored contract will reflect the Offeror’s specific approach to the procurement. Accepted changes proposed by one Offeror are exclusively for that Offeror.

Although Section C and the Specification contain minimum technical requirements, changes in language may be proposed for clarity as long as functional and performance requirements are not compromised. Section C or Specification language may be changed to reflect equipment capabilities that exceed requirements.

Each Offeror’s submission to this SIR must include any changes required to reflect alternative approaches provided by the Offeror that meet stated requirements, particularly if these changes would offer a price advantage.

L.18 OPERATIONAL CAPABILITY DEMONSTRATION (OCD)

For those Offerors that are selected to continue to Phase II, an Operational Capability Demonstration (OCD) will be conducted. The OCD is estimated to be 1 month in length and requires that each Offeror deliver one (1) of its proposed systems to the FAA Mike Monroney Aeronautical Center (MMAC) in Oklahoma City, OK, in accordance with a schedule to be provided. The required configuration for the NVRP used during the OCD is:

1. A 72 channel NVRP system logger including a Workstation

2. GPS Time Source

3. An UPS for the 72 channel system

4. Standalone Workstation

5. Vendor proposed Site spares

Items 1, 2, and 3 must be rack-mounted.

Offerors will be permitted to stage and set up equipment in a secure space at the laboratory test bed. Following installation and checkout of the system, Offerors will provide a one-day demonstration to acquaint Government personnel with its proposed product. This is intended to be an interactive process in which information is exchanged to ensure the FAA gains the most complete understanding of the Offeror’s proposed capabilities. The Offeror may demonstrate areas of its written proposal through presentations and demonstrations. Offerors must not include any new concepts or components that were not included in the written proposal but may only elaborate on information contained in the written proposal.

Page L-20

Demonstration Overview

The Offeror must introduce its proposed team of subcontractors and address its organizational structure and how it contributes to meeting program objectives. The demonstration must include an overview of how the system is operated. The topics below must be addressed during the demonstration:

Topics:

• Features the Offeror is proposing that meet the SIR requirements

• Features the Offeror is proposing that are in addition to the SIR requirements

• Channel expansion capability

• Approach to conduct production planning and current production capability.

The Offeror should clearly identify which topic is being satisfied by each individual demonstration including traceability to the SOW and Specification when appropriate.

Offerors may also demonstrate any specific areas that are addressed in their written proposals but not covered by the topics above that might contribute to a better presentation of their products’ capabilities. The FAA reserves the right to pursue any area it deems appropriate for further investigation or explanation. These areas will be communicated to the Offeror as soon as practicable.

The Government reserves the right to videotape or take still photography of any portion of the OCD activities. The Offeror must designate an OCD Coordinator who will serve as the Government’s point of contact on all matters concerning the OCD. The Offeror must provide the name, mailing address, business telephone number, and email address of the designated coordinator.

At the conclusion of the Demonstration day, the Offerors will leave their equipment in the Government facility for approximately 4 weeks for further Government assessment.

The OCD will be operational in nature, assess functionality, effectiveness, and operational suitability in the environment and will include FAA personnel and support contractors. The FAA Assessment will be conducted using a verification checklist.

During the assessment, the FAA team will complete the verification checklist noting

Page L-21 whether each item assessed was acceptable or unacceptable.

Each Offeror is required to provide an on-call technical representative, either locally or at its home office, who can be paged or contacted by telephone within 30 minutes during normal working hours (8:00 a.m. to 5:00 p.m.), to answer any questions or address any problems encountered during the OCD period.
