About this file
This is a Question and Answer Document Amendment No. 2 for Solicitation No. 3160008150 issued by the Mississippi Oil and Gas Board (MSOGB) on August 26, 2026, addressing contractor inquiries regarding the plugging, remediation, and reclamation of ten orphaned well sites located in Adams and Walthall Counties, Mississippi. The solicitation requires bidders to submit individual plugging and remediation plans for each well, separate unit pricing per well, and a total project bid, all subject to MSOGB approval before work commences. Mandatory pre-bid site inspections were conducted July 30-31, 2026, with proposals originally due August 24, 2026 at 4:00 p.m. CDT. The contract is firm fixed-price and turnkey, with a contract period running from October 7, 2026 through September 30, 2027. Work scope includes site access preparation, NORM surveys, cement plug installation at specified depths including 100-foot plugs at the base of the Underground Source of Drinking Water, casing removal and cutting, well cap installation, and complete site reclamation in compliance with Mississippi Oil and Gas Board regulations and the Infrastructure Investment and Jobs Act Orphan Well Program.
The amendment clarifies that costs for unforeseen contingencies including NORM disposal and remediation, inaccessible vessel and tank remediation, fishing for rods and tubing, soil contamination remediation, and disposal of landowner items blocking site access shall be handled via Change Order rather than included in the base bid, with pricing to be determined by fixed-price adjustment, Time and Materials rates, or cost allocation methods specified in the contract. Contractors must submit Time and Materials rate sheets in their bid proposals and identify any well sites that were inaccessible during the pre-bid site visit. Minimum qualifications require five years of experience in orphaned well plugging and remediation services and a valid Mississippi business license. Insurance requirements include Workers Compensation, Commercial General Liability of $1-2 million, Pollution Liability of $2-4 million, and Motor Vehicle coverage of $1-2 million. All materials and products must comply with Build America, Buy America Act requirements. Funding derives from a Formula grant to the MSOGB under the Infrastructure Investment and Jobs Act from the U.S. Department of the Interior, with anticipated award notification scheduled for September 1, 2026.

Question and Answer Document Amendment No. 2
Question No. Section No. Page No. Question MSOGB Response 1 Please confirm Norm disposal & cleaning will be handled via Change Order (or increase bid to address worse case scenario)?
To the extent possible, include an estimated total price for NORM disposal and remediation, in addition to T&M rates as applicable. MSOGB recognizes that the level of NORM contamination located on a particular project site varies and is difficult to quantify prior to undertaking work on a said project site. MSOGB will work alongside the contractor in order to ascertain and determine the costs associated with NORM disposal and remediation; an associated executed contract will provide for cost determination: 1) by agreement on a fixed price adjustment before commencement of the additional performance; 2) by Time & Materials (T&M) rates specified in the contract; or, 3) by the costs attributable to the event or situation covered by the clause, plus appropriate profit or fee, all as specified in the contract.
Any work associated with the disposal and remediation of NORM will be handled via Change Order.
2 The vessels & tanks were inaccessible during the site visits. Please confirm fluid disposal & cleaning (if needed) will be handled via Change Order (or increase bid to address worse case scenario)?
In order to account for costs associated with the remediation of vessels and tanks which were inaccessible during the site visit, an associated executed contract will provide for cost determination: 1) by agreement on a fixed price adjustment before commencement of the additional performance; 2) by Time & Materials (T&M) rates specified in the contract; or, 3) by the costs attributable to the event or situation covered by the clause, plus appropriate profit or fee, all as specified in the contract.
Any work associated with the remediation of these vessels and tanks will be handled via Change Order.
Within its bid proposal, contractor should identify any well site that was inaccessible during the pre-bid site visit. All accessible well sites that should include the costs required to remediate all vessels and tanks located on site.
3 Please advise if fishing for rods and/or tubing is to be included in the Bid or addressed via change order.
To the extent possible, a firm price for fishing for rods and/or tubing should be included in the bid proposal.
In the event unknown or unforeseeable issues arise during the plugging (if applicable), remediation, and reclamation of a particular project site, any adjustment in contract price may be made by agreement on a fixed price adjustment before commencement of the additional performance, by Time and Materials (T&M) rates specified within this Contract, or by costs attributable to the event or situation necessitating the need for cost adjustment.
Contractor should include a Time and Materials (T&M) rate sheet within its bid proposal.

• Please clarify what we are to do with the landowners trash/treasures located all around the site (and blocking access)
• Please advise what we are to do with the landowner’s metal shed he has placed on the pump jack concrete pad
Prior to starting work on a particular project site, the contractor should discuss with the landowner any items that appear to be personal in nature to the landowner and which are located on or adjacent to the well site, especially those blocking access to said well site. It may be necessary to move these items temporarily in order to complete the work.
Contractor should also discuss with the landowner the metal shed located on the concrete pad.
If the landowner desires for any items to remain on site, contractors should obtain a letter from the landowner identifying what items are to remain. This would include documenting the landowner’s desire to keep the metal shed located on the concrete slab.
MSOGB Field Inspectors will assist the contractor as needed with the above.
If the landowner decides they want the contractor to haul off and dispose of the particular items located on or adjacent to the well site, MSOGB and contractor will discuss the disposal of these items individually. Such removal and disposal will be handled via Change Order.
UPDATE: MSOGB has been in contact with the landowner and has confirmed that no personal items need to be removed from the project site. There may be items that need to be moved to the side for access.

To the extent possible, contractor should provide a firm cost associated with the remediation of contaminated soil located on site.
In order to account for unforeseeable circumstances or greater than expected contamination, a Change Order may be executed 1) by agreement on a fixed price adjustment before commencement of the additional performance; 2) by Time & Materials (T&M) rates specified in the contract; or, 3) by the costs attributable to the event or situation covered by the clause, plus appropriate profit or fee, all as specified in the contract.
In accordance with the Public Procurement Review Board, Office of Personal Service Contract Review Rules and Regulations, Section 5.3.3 Questions and Answers, the MSOGB shall create a register of all questions along with their corresponding answers. The register of all questions and answers shall be issued as an Amendment to the IFB.
