About this file
This is Amendment No. 2 of a Question and Answer Document issued by the Mississippi Oil and Gas Board (MSOGB) for Solicitation No. 3160008150, dated August 24, 2026, addressing contractor inquiries regarding the plugging, remediation, and reclamation of orphaned wells. The document clarifies the scope of work and cost allocation methodology for ten orphaned well sites located in Adams and Walthall Counties, Mississippi. Key clarifications address NORM disposal and remediation, fluid disposal and cleaning of inaccessible vessels and tanks, fishing for rods and tubing, removal of landowner personal items blocking site access, and remediation of oil-contaminated soil at specific well locations including Fernwood #6, Fernwood 27-15, and Fernwood #1. The MSOGB confirms that contractors must conduct pre-bid site visits to assess accessible well sites and include all remediation costs in their proposals where feasible.
The MSOGB establishes that costs for unforeseen or unforeseeable work will be handled through Change Orders utilizing one of three methods: fixed-price adjustment agreed upon before work commencement, Time and Materials (T&M) rates specified in the contract, or cost allocation based on actual costs plus appropriate profit or fee. Contractors are required to submit T&M rate sheets within their bid proposals to address contingencies. For inaccessible sites during pre-bid visits, contractors must identify these locations and propose accordingly. The MSOGB has confirmed that no personal items require removal from the Fernwood #6 project site, though some items may need temporary relocation for access. All work must comply with Mississippi Oil and Gas Board regulations and Infrastructure Investment and Jobs Act requirements, with funding provided through a Formula grant from the U.S. Department of the Interior.

Question and Answer Document
Amendment No. 2
Question No. Section No. Page No. Question MSOGB Response
1 Please confirm Norm disposal & cleaning will be handled via
Change Order (or increase bid to address worse case scenario)?
To the extent possible, include an estimated total price for NORM disposal and remediation, in addition to T&M rates as applicable. MSOGB recognizes that the level of NORM contamination located on a particular project site varies and is difficult to quantify prior to undertaking work on a said project site. MSOGB will work alongside the contractor in order to ascertain and determine the costs associated with
NORM disposal and remediation; an associated executed contract will provide for cost determination: 1) by agreement on a fixed price adjustment before commencement of the additional performance; 2) by Time & Materials
(T&M) rates specified in the contract; or, 3) by the costs attributable to the event or situation covered by the clause, plus appropriate profit or fee, all as specified in the contract.
Any work associated with the disposal and remediation of NORM will be handled via
Change Order.
2 The vessels & tanks were inaccessible during the site visits. Please confirm fluid disposal & cleaning (if needed) will be handled via Change Order
(or increase bid to address worse case scenario)?
In order to account for costs associated with the remediation of vessels and tanks which were inaccessible during the site visit, an associated executed contract will provide for cost determination: 1) by agreement on a fixed price adjustment before commencement of the additional performance; 2) by Time & Materials
(T&M) rates specified in the contract; or, 3) by the costs attributable to the event or situation covered by the clause, plus appropriate profit or fee, all as specified in the contract.
Any work associated with the remediation of these vessels and tanks will be handled via
Change Order.
Within its bid proposal, contractor should identify any well site that was inaccessible during the pre-bid site visit. All accessible well sites that should include the costs required to remediate all vessels and tanks located on site.
3 Please advise if fishing for rods and/or tubing is to be included in the Bid or addressed via change order.
To the extent possible, a firm price for fishing for rods and/or tubing should be included in the bid proposal.
In the event unknown or unforeseeable issues arise during the plugging (if applicable), remediation, and reclamation of a particular project site, any adjustment in contract price may be made by agreement on a fixed price adjustment before commencement of the additional performance, by Time and Materials (T&M) rates specified within this Contract, or by costs attributable to the event or situation necessitating the need for cost adjustment.
Contractor should include a Time and
Materials (T&M) rate sheet within its bid proposal.

Please clarify what we are to do with the landowners trash/treasures located all around the site (and blocking access)
Please advise what we are to do with the landowner’s metal shed he has placed on the pump jack concrete pad
Prior to starting work on a particular project site, the contractor should discuss with the landowner any items that appear to be personal in nature to the landowner and which are located on or adjacent to the well site, especially those blocking access to said well site. It may be necessary to move these items temporarily in order to complete the work.
Contractor should also discuss with the landowner the metal shed located on the concrete pad.
If the landowner desires for any items to remain on site, contractors should obtain a letter from the landowner identifying what items are to remain. This would include documenting the landowner’s desire to keep the metal shed located on the concrete slab.
MSOGB Field Inspectors will assist the contractor as needed with the above.
If the landowner decides they want the contractor to haul off and dispose of the particular items located on or adjacent to the well site, MSOGB and contractor will discuss the disposal of these items individually. Such removal and disposal will be handled via Change Order.
UPDATE: MSOGB has been in contact with the landowner and has confirmed that no personal items need to be removed from the project site. There may be items that need to be moved to the side for access.
