This is an AIA B101-2017 Standard Form of Agreement between Owner and Architect executed on March 4, 2024, between the West Virginia Department of Transportation (Owner) and McKinley Architecture and Engineering (Architect) for the District Two Headquarters Renovations and HVAC Replacement project located at 801 Madison Avenue, Huntington, WV 25704. The project scope includes renovation of DMV spaces, relocation of DMV offices, renovation of a first-floor parole area with controlled entry, and comprehensive plumbing, mechanical, and electrical system upgrades to accommodate the renovations. The initial construction budget is $11,600,000. Design phase completion is targeted for September 4, 2024, with construction commencement six weeks thereafter. Substantial completion is anticipated eighteen months after the Notice to Proceed, with delays in lead time and delivery of mechanical and electrical equipment factored into the construction duration. The procurement and delivery method is Design-Bid-Build. The Architect's representative is Thom Worlledge, AIA, Senior Architect. The Owner's representative is Bill Murray, PE. The Architect shall provide Structural, Mechanical, and Electrical Engineer services. Supplemental services designated as the Architect's responsibility include programming, multiple preliminary designs, measured drawings, site evaluation and planning, civil engineering, landscape design, architectural interior design, value analysis, detailed cost estimating, on-site project representation, conforming documents for construction, as-designed record drawings, and post-occupancy evaluation.
The Architect's compensation consists of a fixed fee of $650,260 per the attached Fee Schedule Addendum B, with compensation structured as follows: Schematic Design Phase (20%), Design Development Phase (25%), Construction Documents Phase (30%), Procurement Phase (5%), and Construction Phase (20%). Supplemental services are compensated on an hourly basis or mutually agreed basis between Owner and Architect. Additional services during construction may require Owner notification and written authorization. Reimbursable expenses include transportation and travel, long distance services and communication, permitting fees, printing and reproductions, renderings and presentation materials, professional liability insurance, taxes on professional services, site office expenses, registration and certification fees, and other project-related expenditures, compensated at fifteen percent (15%) above actual cost. The Architect shall maintain Commercial General Liability insurance of $1,000,000 per occurrence and $2,000,000 aggregate, Automobile Liability of $1,000,000 per accident, Employers' Liability of $1,000,000 per accident and $2,000,000 policy limit, and Professional Liability of $1,000,000 per claim and $2,000,000 aggregate. The agreement is governed by West Virginia law and includes supplementary conditions modifying the standard AIA B101-2017 form, with the State of West Virginia supplementary conditions taking precedence over other AIA documents. Payment is due within thirty days of invoice receipt. The agreement was approved by the West Virginia Attorney General's office and the West Virginia Department of Transportation Division of Highways.
