About this file

This document contains additional terms and conditions for construction contracts issued by the West Virginia Division of Corrections and Rehabilitation. The document establishes mandatory requirements for all contractors bidding on public improvement construction projects in West Virginia, including licensure, drug-free workplace compliance, labor sourcing, and wage rate standards. Contractors must obtain a West Virginia contractor's license prior to contract award and include their license number in bid submissions. For projects valued over $100,000, vendors must submit a signed and notarized drug-free workplace affidavit confirming they maintain a written drug-free workplace policy compliant with West Virginia Code 21-1D. Construction contracts exceeding $250,000 for building or structural improvements require submission of a subcontractor list within one business day of bid opening, detailing all subcontractors performing over $25,000 of work and their respective license numbers. Apparent low bidders who fail to provide required documentation—including contractor license numbers, drug-free workplace affidavits, or subcontractor lists—are given one business day to comply before disqualification.

Additional significant requirements include mandatory compliance with green building energy standards for new public construction projects per ICC International Energy Conservation Code and ANSI/ASHRAE/IESNA Standard 90.1-2007. The document establishes a seventy-five percent local labor market hiring requirement for public improvement projects exceeding $500,000, with civil penalties of $250 per employee per day for initial violations and $500 per employee per day for continued violations after fourteen calendar days. Davis-Bacon wage rates apply to applicable federal funding scenarios. Contractors must submit annual certified drug-free workplace reports documenting employee education, drug testing results by category, and laboratory information. AIA Documents govern construction contracts completed with architectural services under West Virginia Code Chapter 5G, with amendments prohibiting general condition charges and requiring contractors to mitigate delay costs through specific, concrete identification rather than average daily rate calculations.
