About this file
This is a Conflict of Interest disclosure document related to a Human Resources Suite procurement by Tempe Union High School District No. 213 in Arizona. The document establishes conflict of interest policies and procedures that bidders and contractors must comply with when responding to or executing the contract. The disclosure requirements apply to all proposed contractors, subcontractors, and their respective officers, directors, employees, and agents who will be involved in the performance of the Human Resources Suite contract. Bidders must certify their compliance with conflict of interest standards prior to contract award, and the District reserves the right to reject any proposal or terminate any contract if conflicts of interest are discovered or if required disclosures are not provided. The policy ensures that no individual or entity with financial interests, family relationships, or other affiliations that could compromise objectivity or create improper influence participates in the procurement or contract performance process.
The document requires full transparency regarding potential conflicts, including but not limited to employment relationships, financial interests in competing vendors, and prior business dealings with District personnel or board members. Failure to disclose known conflicts or providing false information in conflict of interest declarations may result in proposal rejection, contract termination, and potential legal action. The District's conflict of interest policy aligns with Arizona statutes and standard procurement regulations governing public contracts. All contractors and bidders must acknowledge their understanding and acceptance of these conflict of interest requirements as a condition of proposal submission and contract award for the Human Resources Suite project.

CONFLICT OF INTEREST FORM - DISTRICT PURCHASES FROM EMPLOYEES
Employees cannot sell to the District without complying with A.R.S. § 38-503(C); procurements between school districts and their employees must follow the School District Procurement Code’s competitive bidding procedures regardless of a procurement’s total cost.
Arizona Revised Statutes A.R.S. § 38-503(C) requires public competitive bidding whenever a school district purchases goods or services from district employees, regardless of whether payment is made with student activities monies or extracurricular activities and character education program contributions.

Per Tempe Union High School District No. 213 Governing Board Policy GBEAA Staff Conflict of Interest;
The District is required to follow the school district procurement rules for all purchases of goods or services from District employees regardless of dollar amount. The District may acquire equipment, material, supplies, or services from its employees only under an award or agreement let after public competitive bidding [A.R.S. 38-503; Arizona Attorney General’s Opinion I06-002]. The requirement applies to any purchase using District monies, including extracurricular activities fees, tax credit contributions, and monies held in trust by the District such as student activities monies, when a District employee acts as the vendor. Oral and written quotations do not satisfy the public competitive bidding requirements.
