About this file
This is a Certification of Contractor document required by the Tennessee Department of Environment and Conservation, Recreation Educational Services for contractors receiving funding through state and local grant programs such as the Local Park & Recreation Fund (LPRF), Land & Water Conservation Fund (LWCF), or Recreation Trail Program (RTP). The certification serves as a material representation of fact that must be incorporated into the grant agreement between the grantee and contractor. The contractor must acknowledge compliance with multiple regulatory requirements before execution of the contract.
The certification mandates contractor compliance with six key provisions: (1) conflicts of interest restrictions prohibiting payments to state employees or officials in exchange for services; (2) lobbying certifications requiring disclosure of any non-federally appropriated funds used for influencing government officials, with submission of Standard Form-LLL when applicable; (3) nondiscrimination assurances protecting individuals from exclusion based on handicap, disability, age, race, color, religion, sex, national origin, or other protected classifications; (4) public accountability requirements including establishment of grievance systems and display of comptroller hotline notices in public service areas; (5) public notice requirements mandating inclusion of state funding attribution in all project-related communications subject to state approval; and (6) recordkeeping obligations requiring maintenance of documentation for a minimum of five years following final payment in accordance with GASB or FASB standards and OMB Uniform Administrative Requirements, with records subject to audit by the state agency, Comptroller of the Treasury, or their representatives. The contractor must also establish internal controls utilizing the COSO Internal Control-Integrated Framework model.
