About this file
This is a Type I Categorical Exclusion (CE) Memorandum prepared by Kimley-Horn and Associates, Inc. for the Florida Department of Transportation (FDOT) District Four and the City of Dania Beach regarding the NW 1st Street Local Agency Program (LAP) project in Broward County, Florida. The project proposes constructing ADA-compliant sidewalks and associated crosswalks, as well as milling, resurfacing, and regrading the existing roadway along approximately 0.80 miles of NW 1st Street from South Bryan Road to South Federal Highway. The project is federally funded under FDOT's LAP and has been classified as a Type I Categorical Exclusion (Category #3) under the Project Development and Environment Manual. A field reconnaissance was conducted on November 19, 2025, and the project advertisement was displayed on the City of Dania Beach's website on March 24, 2026, with no public comments received to date. The project will result in temporary lane closures during construction, which will be managed through implementation of a Temporary Traffic Control Plan (TTCP) and Maintenance of Traffic (MOT) Plan. Long-term benefits include improved pedestrian and bicycle safety and mobility along the corridor. No property relocations or right-of-way acquisitions are required. The Statewide Transportation Improvement Program (STIP) shows total project funding of $3,099,356, with preliminary engineering costs of $380,369 and construction costs of $2,718,987.
The memorandum confirms that this project will not induce significant impacts to planned growth, land use patterns, air or water quality, or community cohesiveness. Environmental analysis determined that no wetlands, essential fish habitat, or prime farmland will be impacted. A National Pollutant Discharge Elimination System (NPDES) permit will be required from the Florida Department of Environmental Protection prior to construction due to the project area exceeding one acre. Six potential contamination sites were identified within 500 feet of the project area; however, project activities will not impact these sites. The project area falls within consultation areas for several endangered and threatened species, but the only species with potential habitat impact is the eastern indigo snake, for which a "Not Likely to Adversely Affect" determination was made with implementation of standard protection measures. Three Section 4(f) resources (CW Thomas Park, Frost Park, and Arts Park) are located near the project; a portion of work will occur within CW Thomas Park's right-of-way, requiring coordination with the Official with Jurisdiction and FDOT Office of Environmental Management. A Cultural Resource Assessment Survey identified seven previously recorded resources within the project area, with two resources (FEC Railway and Dixie Highway segments) recommended as eligible for National Register of Historic Places listing; however, SHPO concurred on December 15, 2025, that the undertaking will result in no adverse effects to historic properties. Environmental justice analysis indicates that 81.88% of the project study area population is minority and 23.83% of households fall below the federal poverty level, but the proposed improvements will not disproportionately adversely impact these populations. All temporary construction impacts will be minimized through implementation of Best Management Practices for dust and runoff control, with equipment staging prohibited in private and residential right-of-way.

SUBJECT: Type I Categorical Exclusion Memorandum
Name: Dania Beach NW 1st LAP
FM Number: 443949-1-58-01
Federal Aid Project Number: D423-005-B
County: Broward County
Limits: From South Bryan Road ending at South Federal Highway, along North
West (NW) 1st Street.
The City of Dania Beach’s NW 1st Street project is a federally funded project administered by the Florida
Department of Transportation (FDOT) under their Local Agency Program (LAP). This project has been reviewed and the Environmental Class of Action for this project is a Type I Categorical Exclusion (CE)
(Category #3), as described in Part 1, Chapter 2, Class of Action Chapter of the Project Development and
Environment (PD&E) Manual.
The project corridor extends approximately 0.80 miles along NW 1st Street, from South Bryan Road ending at South Federal Highway (see Appendix A, Figure 1 – Location Map and Figure 2 – USGS Quadrangle
Map). The proposed project includes constructing ADA-compliant sidewalks and associated crosswalks, as well as milling, resurfacing, and regrading the existing roadway.
Residential, institutional, and recreational land uses primarily surround the project. A photographic log of the project corridor is included in Appendix B.
Kimley-Horn and Associates, Inc. staff conducted a field reconnaissance on November 19th, 2025. Based on results from field reconnaissance and database research the following has been verified:
✓ This action will not induce significant impacts to planned growth or land use for the area; travel patterns; involve significant air or water quality impacts; or cause substantial controversy on environmental grounds.
✓ The action will not cause changes in interchange access control; result in major traffic disruptions due to the construction of temporary access; or the closure of existing road, bridge, or ramps.
Local Traffic Patterns
The proposed scope of work will result in temporary lane closures. A Temporary Traffic Control Plan
(TTCP) and/or Maintenance of Traffic (MOT) Plan will be implemented during lane and sidewalk closures to minimize short-term impacts to motorized and pedestrian traffic patterns. There will be a long-term improvement to safety for pedestrians traveling along the project corridor. Therefore, this project will improve mobility along NW 1st Street.
Dania Beach NW 1st LAP 2 April 2026
Property Access and ROW Acquisition
The proposed scope of work does not include any impacts on local property access, changes to existing cross-slopes, longitudinal slopes, or profiles, and does not require any residential or business relocations.
Following the most recent version of the FDOT Standard Specifications for Road and Bridge Construction, access to adjacent properties will be maintained during construction.
Community Cohesiveness
The proposed project is surrounded by residential neighborhoods, recreational facilities, and institutions.
The proposed scope of work includes constructing ADA-compliant sidewalks and associated crosswalks, as well as milling, resurfacing, and regrading the existing roadway. These enhancements will improve mobility and safety for bicyclists and pedestrians within the project area and strengthen connections to nearby neighborhoods and community resources. As such, no adverse effects on planned community growth, land use patterns, or community cohesiveness are anticipated.

Although these facilities are located near the project area, no ROW or access changes will occur to these facilities as a result of this project. Temporary construction impacts on these resources, such as noise and air in the form of dust from earthwork, may occur as a result of this proposed project. These impacts will be minimized through the implementation of Best Management Practices (BMPs) to control dust and runoff, and construction during daylight hours to the extent practical. Access to the adjacent facilities will be maintained throughout construction. Additionally, no staging of equipment will take place within these
Dania Beach NW 1st LAP 3 April 2026 facilities, as the staging of vehicles and equipment is prohibited within private/residential ROW. The
Contractor will provide the locations of staging equipment.
Socioeconomic Impacts
An analysis of minority and low-income populations (Environmental Justice [EJ] or Potential EJ populations) was conducted through a review of census data, field reconnaissance, and public meetings.
The study area for reviewing the demographics included those census tracks/blocks that overlap the project and field review of those populations living immediately adjacent to the project improvements. Per the
2019-2023 American Community Survey (ACS) Census data (Table 1), the residential population in the study area is approximately 81.88% minorities.

ACS estimates indicate that the median household income of the study area is approximately $40,820 with approximately 23.83% of households having incomes below the federal poverty level. In comparison, the median household income for Broward County is $74,534 with approximately 12.91% of households having incomes below the federal poverty level.
The percentage of persons with limited English proficiency for the entire study area is 5.87%.
The proposed improvements will not result in adverse impacts to minority, low-income households, elderly or limited English proficiency populations. There will be temporary construction impacts from noise and travel within the project area, but the impacts would be the same for all persons that use the sidewalks within the project area and thus not disproportionately adverse. The project is expected to enhance mobility and safety within the project area and between existing communities.
No minority or low-income populations have been identified that would be adversely impacted by the proposed project, as determined above.
Dania Beach NW 1st LAP 4 April 2026
Planned Community Growth/Land Use Patterns
The corridor is comprised of residential, commercial, institutional, and recreational facilities. The proposed scope of work does not include any impacts on planned community growth or land use patterns. Therefore, adverse impacts on planned community growth are not anticipated.
Land use within the project corridor was classified using the Florida Land Use, Cover, Forms, and

Section 4(f) of the Department of Transportation
Section 4(f) of the Department of Transportation Act governs the use of land from publicly owned parks and recreation areas, wildlife and waterfowl refuges, and publicly or privately owned historic sites by
Federal Aid Highway projects (federally funded projects).
Three Section 4(f) resources are found within the 1,320-foot buffer of the project area:
• CW Thomas Park
• Frost Park
• Arts Park
A portion of the proposed work will occur within the City of Dania Beach right-of-way associated with
C.W. Thomas Park. As such, a Section 4(f) form has been prepared for this resource, along with an exhibit for review (Appendix C). Coordination will occur with the Official with Jurisdiction (OWJ), City of Dania
Beach, to obtain approval for this project. An OWJ concurrence letter is required to support submittal of the Section 4(f) form. Upon receipt of OWJ concurrence, the Section 4(f) form will be transmitted to the
FDOT Office of Environmental Management, and this section will be updated to document the submittal date and concurrence date.
Section 6(f) of the Land and Water Conservation Fund Act (LWCFA)
According to a review of the ETDM EST, CW Thomas Park, Frost Park, and Arts Park were not funded by the Land and Water Conservation Fund Act (LWCFA). Additionally, neither of these parks are part of the
National Park Projects. Therefore Section 6(f) does not apply.
Dania Beach NW 1st LAP 5 April 2026
Air Quality and Noise
Because the proposed project is not a capacity improvement, no long-term air quality or noise impacts are anticipated. The project is in an area that is designated attainment for all the National Ambient Air Quality
Standards under the criteria provided in the Clean Air Act. Therefore, the Clean Air Act conformity requirements do not apply to the project. No noise impacts are expected as per 23 CFR 772 and a noise study is not required.
Water Quality
One (1) South Florida Water Management District (SFWMD) canal system was noted within the project area (see Appendix A, Figure 4 – FLUCFCS Map.), SFWMD C-10 Canal. However, no work in, on, or over this canal will occur as a result of the proposed project, and impacts on the SFWMD C-10 Canal will be avoided. A Stormwater Pollution Prevention Plan (SWPPP) will be developed and included in the plans.
The Contractor will also follow BMPs and comply with the FDOT Standard Specifications for Road and
Bridge Construction to minimize impacts on water quality.
A National Pollutant Discharge Elimination System (NPDES) permit will be required from the Florida
Department of Environmental Protection (FDEP) due to the project area being more than one (1) acre. This permit will be obtained by the Contractor prior to construction.
Wetlands
Kimley-Horn and Associates, Inc. staff conducted field reconnaissance November 19th, 2025, and reviewed the National Wetlands Inventory (NWI) map of the project vicinity for wetlands. The project area was visually screened for the presence of wetlands as defined in the “Corps of Engineers Wetlands Delineation
Manual," Technical Report Y-87-1. Based on the field review, no wetlands were identified within the project area; however, one (1) South Florida Water Management District (SFWMD) canal system was noted within the project area (see Appendix A, Figure 4 – FLUCFCS Map.) No impacts to this canal is proposed with this project. As a result, no work in, on, or over the SFWMD C-10 canal will occur. Based on the above considerations, the project will be exempt from state or federal permitting requirements as no wetland or surface water impacts are proposed.
Indirect and temporary impacts associated with project construction will be avoided with the proper use of
BMPs.
Coastal Barrier Resources
The project is not located within a Coastal Barrier Resource System (CBRS).
Farmlands
According to the United States Department of Agriculture (USDA), Natural Resources Conservation
Service (NRCS) prime farmlands GIS data, no areas of Farmland of Unique Importance are located within the project area. Therefore, no impacts on prime farmland will occur from this project.
Special Designations
Based on GIS data available from FDEP; http://www.dep.state.fl.us/gis/datadir.htm), and the University of
Florida GeoPlan Center (www.fgdl.org), no National or State Wild and Scenic River Systems, Outstanding
Dania Beach NW 1st LAP 6 April 2026
Florida Waters (OFW), or Aquatic Preserves occur within the project area. Therefore, no impacts on wild or scenic rivers, OFWs, or aquatic preserves will occur.
Floodplain Encroachment
Federal Emergency Management Agency (FEMA) Flood Insurance Rate Maps (FIRM) available from the
FEMA website (http;//fema.gov) were reviewed to determine if the project area is located within a flood zone. According to FEMA FIRM Panel 12011C0567J the project area is within Zone AE (Inside Special
Flood Hazard Area), Zone AH (1 Inside Special Flood Hazard Area), and Zone X (Outside Special Flood
Hazard Area) (see Appendix A, Figure 5 – FEMA Flood Zone Map). Though the project area is located within FEMA Flood Zones AE and AH, based on the scope of work, this project will not affect flood heights or base floodplain limits, result in increased or new adverse environmental impacts, increase flood risks, or damage or significantly change the potential for interruption or termination of emergency service or emergency evacuation routes. Therefore, this project will not encroach upon the base floodplain, as defined in Part 2, Chapter 13 of the PD&E Manual.
Endangered and Threatened Species
Based on GIS data available from the United States Fish and Wildlife Service (USFWS;
http://www.fws.gov), Florida Fish and Wildlife Research Institute (FWC; http://myfwc.com/research/gis/), and the University of Florida GeoPlan Center (www.fgdl.org), the project is located within USFWS
Consultation Areas for the Florida scrub-jay (Aphelocoma coerulescens) and Atlantic Coast Plants. These species will be discussed below.
A Florida Natural Areas Inventory (FNAI) Biodiversity Matrix Report was collected to review possible listed species occurrences within the project area (See Appendix D – FNAI Report). The project area falls within Matrix Units 68636, 68775. According to FNAI, the Florida burrowing owl (Athene cunicularia floridana) was documented within Matrix Unit 68636. This species will be discussed further below. No occurrences of threatened/endangered species were documented within the corridor during field reconnaissance.
The project area falls within the USFWS Consultation Area for the Everglade snail kite (Rostrhamus sociabilis plumbeus); however, no suitable habitat exists within or adjacent to the project area for the
Everglade snail kite. As the project will not be impacting habitat for this species, the project will have No
Effect on the Everglade snail kite.
The project area falls within the USFWS Consultation Area for the American crocodile (Crocodylus acutus); however, no suitable habitat exists within or adjacent to the project area for the American crocodile.
As the project will not be impacting habitat for this species, the project will have No Effect on the American crocodile.
The project area falls within the USFWS Consultation Area for the Florida bonneted bat (Eumops floridanus), and suitable habitat was observed during field reconnaissance. However, the proposed project will not be trimming or removing any trees. Therefore, as the project will not be impacting habitat for this species, the project will have No Effect on the Florida bonneted bat.
The project is located within the Core Foraging Area (CFA) of two (2) wood stork (Mycteria americana) colonies (Sawgrass Ford and Emerald Estates 1 and 2 Griffin). The CFA is defined as an 18.6-mile radius around known wood stork colonies. However, no suitable habitat exists within or adjacent to the project
Dania Beach NW 1st LAP 7 April 2026 area for the wood stork. As the project will not be impacting habitat for this species, the project will have
No Effect on the wood stork.
On-site habitat for the eastern indigo snake (Drymarchon couperi) exists within the project area. Per the
USFWS Eastern Indigo Snake Programmatic Effect Determination Key (December 2023), following A: the project is not located in open water or salt marsh; B: permit will be conditioned for the use of the Service’s most current guidance for the Standard Protection Measures for the Eastern Indigo Snake (Appendix E) during site preparation and project construction; C: the project will impact less than 25 acres of eastern indigo snake habitat; D: the project has no known holes, cavities, burrows, or other underground refugia, an effect determination of Not Likely to Adversely Affect (NLAA) was made for this species. Based on the above considerations, with the implementation of the Standard Protection Measures for the Eastern Indigo
Snake throughout (Appendix E) throughout construction, no impacts are proposed on the eastern indigo snake. If any burrows are found within the project area, they will be excavated for tortoises prior to construction.
On-site habitat for the gopher tortoise (Gopherus polyphemus) does not exist within the project area, as the area is heavily populated, mowed and maintained. Therefore, as the project will not be impacting habitat for this species, the project will have No Effect on the gopher tortoise.
On-site habitat for the Florida burrowing owl (Athene cunicularia) does not exist within the project area, as the area is heavily populated, mowed and maintained. Therefore, as the project will not be impacting habitat for this species, the project will have No Effect on the Florida burrowing owl.
Essential Fish Habitat
The project does not fall within any Essential Fish Habitat (EFH), therefore impacts on EFH are not anticipated.
Section 106 of the National Historic Preservation Act
A Cultural Resource Assessment Survey (CRAS) was completed for this project in October 2025. Based on the survey results, no archaeological sites or occurrences were identified within the archaeological Area of Potential Effects (APE), and no further archaeological investigation is recommended.
The survey identified seven (7) previously recorded resources within the APE, including three roadway segments (8BD04227 – Dixie Highway, 8BD04373 – Federal Highway, and 8BD04776 – SR A1A), one canal (8BD03221), two buildings (8BD02742 and 8BD02743), and one railroad segment (8BD04087 –
FEC Railway). Of these, the newly recorded segments of the FEC Railway (8BD04087) and Dixie Highway
(8BD04227) are recommended as eligible for listing in the National Register of Historic Places (NRHP).
Despite the presence of NRHP-eligible linear resources, all proposed activities occur within the existing right-of-way and consist of resurfacing, sidewalk harmonization, drainage connections, and minor safety improvements. Therefore, it is the opinion of FDOT that the undertaking will result in no adverse effect to archaeological or historic properties. No additional cultural resource work is required.
The Cultural Resource Assessment Survey (CRAS) report and findings have been submitted to the State
Historic Preservation Officer (SHPO) for review and concurrence. The SHPO concurred with the findings of the CRAS on December 15, 2025. All supporting documentation will be uploaded to SWEPT and PSEE, and the SHPO concurrence letter is included in Appendix F.
