Summary

This is an Invitation to Bid (ITB) document issued by the Tualatin Valley Water District (TVWD) as the Managing Agency for the Willamette Water Supply System (WWSS) for the procurement of Carbon Dioxide (CO2) in bulk quantities for delivery to the WWSS Water Treatment Plant. The District seeks to purchase approximately 400 tons of CO2 annually, with estimated usage of 2,600 lbs/day during peak summer months and 1,300 lbs/day during fall and winter months. CO2 must be delivered to the temporary WTP site located at 21309 SW 124th Ave, Sherwood, OR 97062 (with a permanent address to be assigned in 2026). All bids must be submitted electronically through Bid Locker at https://bidlocker.us/details/5264_Carbon_Dioxide_Itb_2025 by Thursday, September 4, 2025, at the Bid Closing Time. There is no pre-bid conference; however, bids will be publicly opened and read aloud by telephone conference immediately after closing. The contract will have an initial term of one year, then automatically renew for three additional one-year terms unless either party provides written notice of non-renewal by July 1 prior to the October 1 anniversary date. Deliveries must occur within five business days of order placement unless otherwise agreed, with acceptance scheduled seven days a week between 6:00 a.m. and 5:00 p.m. Pacific time.

Bidders must indicate resident or nonresident status and submit required supplemental documentation including Safety Data Sheets, NSF/ANSI Standard 60 compliance certification, a transportation plan, technical data sheets, sample bills of lading, sample invoices, and sample certificates of analysis. CO2 must meet strict quality specifications: greater than 99.5% purity by weight, water vapor less than or equal to 200 parts per million, and nonvolatile residues less than or equal to 10 parts per million. All chemicals must be NSF/ANSI/CAN 60 certified as suitable for drinking water treatment. Payment terms are net 30 days, with prices firm for the first contract year; price escalations are permitted only after the initial 12-month period with written notice at least 45 days in advance and supporting documentation. The District reserves the right to award the contract to the lowest responsible bidder, reject any or all bids, waive informalities, and negotiate with the highest-scoring bidder. Suppliers must maintain comprehensive insurance coverage, comply with all federal and state regulations, provide 24/7 customer service availability, and submit delivery notifications with specific information including driver details, vehicle information, and seal numbers at least one hour before delivery. The supplier is fully responsible for safe offloading of cryogenic gases, spill cleanup and reporting, and maintaining dedicated transportation equipment free of residue contamination.

6. Bids Must be Firm Offers

A notification that the Notice of Intent to Award has been posted will be automatically emailed to all Bidders. Per ORS 279 and the District’s procurement procedures, once Notice of Intent to Award a contract is posted, an aggrieved bidder may protest the award within the seven-day period after the Notice of Intent to Award is posted. An aggrieved bidder is a bidder who is adversely affected and has a right to protest the award. To be adversely affected, the aggrieved bidder must claim itself as lowest responsive, responsible, or best bidder and must be next in line for award. Protests received after the seven-day period will not be considered.
