About this file

This is an Addendum 2 to a Design-Builder contract (C15578) that establishes the election procedures for participating in a steel materials price escalation/de-escalation program. The Design-Builder must submit a completed election form to the Agency Engineer within 45 calendar days after Notice to Proceed (NTP) if it elects to participate in the program. The form requires the Design-Builder to identify and list only those steel material items determined to be eligible and qualified for the program, completing the submission with accurate steel material descriptions and corresponding cost basis information obtained from Form TSE. The submission must be signed and dated by the Design-Builder and delivered in writing to the Agency Engineer.

The steel price escalation/de-escalation clause and program under contract sections DB195.12 through DB195.12(d) are mandatory components of the contract regardless of whether the Design-Builder elects to participate, how many price items contain qualifying steel materials, or whether any price items qualify for the program. The Design-Builder has the option to decline participation entirely, in which case no submission is required. The escalation/de-escalation program serves as the exclusive mechanism for addressing steel price fluctuations throughout the contract term, with no alternative price adjustment clauses permitted.
