About this file

This document consists of a Department of the Army Permit (SAJ-2018-02904(SP-AWP)) issued by the U.S. Army Corps of Engineers, Jacksonville District, to Brevard County Natural Resources Management Department for dredging operations in the Indian River Lagoon. The permit authorizes the removal of approximately 812,650 cubic yards of organic-rich fine-grained sediment (muck) from approximately 241 acres of the Indian River adjacent to the Eau Gallie River and Causeway in Brevard County, Florida. The dredging will be accomplished using small- to medium-sized hydraulic dredges (12- to 18-inch diameter) with sediments pumped via pipeline to the existing Florida Inland Navigation District (FIND) Dredge Material Management Area (DMMA) BV-52 in Palm Bay. The permit was issued on February 21, 2019, with an original completion deadline of February 26, 2024. Ancillary authorization documents include a Florida Department of Environmental Protection Environmental Resource Permit (ERP 0368832-001 EI) issued on October 26, 2018, with a construction phase expiration date of October 26, 2023, which also authorizes the same dredging and disposal activities under state sovereignty submerged lands authorization.

The permit incorporates extensive environmental and operational conditions across general and special provisions, including mandatory compliance with National Marine Fisheries Service Project Design Criteria for in-water activities, sea turtle and smalltooth sawfish construction conditions, standard manatee conditions, and eastern indigo snake protection measures. The permittee must monitor and control turbidity to not exceed 29 Nephelometric Turbidity Units above natural background conditions with a mixing zone not to exceed 150 meters, submit weekly turbidity reports, and install appropriate erosion and turbidity control devices. Additional requirements include providing dedicated manatee observers during in-water work, conducting baseline and post-construction seagrass monitoring within the seagrass growing season (April 1 through October 31), submitting as-built drawings certified by a registered professional engineer within 60 days of completion, and performing post-construction hydrographic surveys of the federal channel. The permit conditions require strict adherence to vessel operation protocols, prohibition on polymers or flocculants, daily pipeline inspections, navigation safety lighting, and archaeological/cultural resource discovery procedures. The permittee must maintain satisfactory evidence of sufficient upland interest and comply with all applicable Federal, State, and local laws and regulations, including the Marine Mammal Protection Act, Endangered Species Act, and Florida Manatee Sanctuary Act, with civil and criminal penalties specified for violations.

These sites shall be established on a transect extending down current from the turbidity source.

Samples shall be collected from surface and mid-depth and one foot above bottom. Mid-depth samples are sufficient in water that is less than five feet deep. Sampling will be restricted to the axis of the visible plume. Samples will be collected at the intersection of the mixing zone boundary and a line parallel with the water current and extending from the source of turbidity if a plume is not visible.

Background samples shall be collected at two sites 500 meters upstream. These samples will be collected at surface, mid-depth, and one-foot above bottom. The two background sites will be marked by temporary buoys and shall be maintained for the duration of the sampling program; these sites shall not be changed without specific written authorization by the Department.

Samples shall be collected with a Kemmerer, Van Dorn or a similar sampler that is designed to collect in situ water samples. Samples shall be analyzed immediately after collection with a turbidimeter that produces results in Nephelometric measurements. The field sample results shall be accurately recorded to the precision capabilities (decimal place) of the instrument. Field turbidimeter results shall be rounded to the next whole number (ex. 15.23 NTUs shall be recorded; however the results shall be interpreted as
