About this file
This document is a Bid Bond for the City of Napa Public Works Department, specifically for the Milliken Raw Water Pipeline Hardening HMGP project with the project number 9017FR20. The bid bond serves as a financial guarantee that if the bidder is awarded the contract, they will enter into the agreement and submit required documentation within ten days of the Notice of Award, including an executed contract, payment bond, performance bond, and insurance certificates. The bond is set at 10% of the maximum bid amount and remains valid for 60 days following the bid opening.
The bid bond outlines the financial and legal obligations of the bidder and surety, with specific requirements that include executing a contract for 100% of the maximum Contract Price, providing payment and performance bonds from a California-licensed surety, and submitting necessary insurance documentation. If the bidder fails to fulfill these obligations, the surety guarantees that the bidder will forfeit the bond sum to the City of Napa. The document includes signature sections for both the surety and the bidder, with a requirement to attach a notary seal and power of attorney.

________________________________________________________ (“Bidder”) has submitted a bid, dated ___________________________, 20______ (“Bid”), to the City of Napa, a California charter city (“City”), for work on the <_______________________________________________> Project (“Project”). Under this duly executed bid bond (“Bid Bond”), Bidder as Principal and ______________________________, its surety (“Surety”), are bound to City as obligee in the penal sum of ten percent of the maximum amount of the Bid (the “Bond Sum”). Bidder and Surety bind themselves and their respective heirs, executors, administrators, successors and assigns, jointly and severally, as follows:

2.1 Contract. The executed Contract, using the form provided by City in the Project contract documents (“Contract Documents”);
2.2 Payment Bond. A payment bond for 100% of the maximum Contract Price, executed by a surety licensed to do business in the State of California using the Payment Bond form included with the Contract Documents;
