About this file
This is a Bid Bond Preparation Instructions document issued by the State of West Virginia, Department of Administration, Purchasing Section. The document provides detailed guidance for bidders submitting proposals in response to West Virginia state agency RFQs and RFPs. The bid bond serves as a guarantee that the principal will execute a contract in accordance with their submitted bid proposal and will furnish any required bonds, insurance, and performance obligations. The document specifies that the minimum acceptable bid bond amount is 5% of the total bid, which may be stated either as a percentage or as a specific dollar amount.
The bid bond must be executed by both the principal (bidder) and a surety company licensed to transact surety insurance in West Virginia. The surety must affix its corporate seal and provide a dated power of attorney with seal affixed to accompany the bond. The principal must be signed by the President, Vice President, or a duly authorized agent and must include the company seal. The document outlines conditions under which the bond obligation becomes null and void, specifically if the bid is rejected or if the bid is accepted and the principal enters into a contract in accordance with the proposal while performing all required obligations. The surety's liability is expressly limited to the penal amount stated in the bond, and the surety waives notice of any extension of time for bid acceptance.
