About this file
This is a Bid Bond template issued by the City of St. Petersburg, Florida for use in competitive bidding processes. The bid bond serves as a guarantee that a bidder who is awarded a contract will execute the required performance bond and enter into a written contract with the City within ten consecutive calendar days of written notice of award, or within such longer period as the City may agree. The bond requires submission of a certified check, cashier's check, or bid bond equal to five percent of the total bid amount as a prerequisite for bid submission. The document is executed by both the Principal (the bidding entity) and the Surety (the bonding company), with the Surety's representative requiring Florida licensure as an Attorney-in-Fact. The Principal must execute the bond either under its corporate seal or with two witness signatures, depending on whether it maintains a seal.
If the Principal fails to execute the contract and furnish a performance bond equal to one hundred percent of the bid amount within the specified timeframe, the bid bond amount becomes due and payable to the City as liquidated damages. The Surety agrees to pay the stated sum immediately upon demand by the City. A copy of the power of attorney authorizing the Surety's Attorney-in-Fact must be attached to the executed bond. This bid bond template applies to the City of St. Petersburg's Flow Monitor Maintenance Program, which seeks a qualified vendor to provide preventative maintenance services, repairs, and related parts for thirty city-owned Triton+ flow monitors and twenty rain gauges, including data collection, analysis, and reporting services.
