Justification for Brand Name Products

This document is a Justification for Brand Name Products issued by the National Park Service (NPS) Northeast Region Contracting Program for a bathroom rehabilitation project at the Mogan Cultural Center in Lowell, Massachusetts. The solicitation seeks to limit competition to the Koala Kare KB310-SSWM/KB311-SSWM Surface Mounted Baby Changing Station, justified under 41 U.S.C. 253(c)(1) and FAR Part 11.105 on the basis that only one responsible source can satisfy the agency's requirements. The product is estimated at approximately $2,500, with comparable pricing available through multiple vendors including WebstaurantStore, Katom, and Island Supply Inc. The contracting office is the Boston Major Acquisition Buying Office, and the action is limited to acquisitions up to $50,000.

The justification emphasizes that the Koala Kare product is essential to meet accessibility needs and state codes, as the Park has already installed this specific model in nine restrooms across three facilities (Counting House, Visitor Center, and Kirk Street Agent's House). Market research reviewed alternative manufacturers and similar products but found them to be of lesser quality and not cost-efficient due to incompatible replacement supplies. The RFP will be solicited as a Total Small Business Set-Aside to ensure adequate competition, with a pre-solicitation notice to be posted on sam.gov. The justification was certified by David Lieb, Contracting Officer Representative (dated April 13, 2026), and Mari L. Tolleson, Contracting Officer (dated April 22, 2026).

NATIONAL PARK SERVICE

NORTHEAST REGION

CONTRACTING PROGRAM

Justification for Brand Name Products

Date: April 13, 2026

Project: LOWE 350067 Rehabilitate Mogan Bathrooms

1.Identifications

a. Agency: National Park Service

b. Contracting Office: Boston Major Acquisition Buying Office

2.Description of the action being approved:

The National Park Service (NPS) shall be soliciting for the Rehabilitation of restrooms in the Mogan Cultural Center, in Lowell, MA. The documents included with the solicitation call for specific brand name products that are peculiar to one manufacturer. This written justification provides approval for limiting competition to the listed brand name products as authorized by the Federal Acquisition Regulations (FAR).

3.Description of supplies and services: The Koala Kare KB310-SSWM / KB311-SSWM Surface Mounted Baby Changing Station.

4. Authority:

a. 41 U.S.C. 253(c)(1): Only one responsible source and no other supplies or services will satisfy agency requirements.

b. FAR Part 11.105: Brand Name products are essential to the Government’s requirements, and market research indicates other companies’ similar products do not meet and cannot be modified to meet the agency’s needs.

c. FAR 6.302-1: The use of the name brand products is essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company.

5. The description of the product’s unique qualifications or the unique nature of the acquisition:

The Park has installed this Baby Changing Station in two recent Park bathroom rehabilitations under PMIS 312999 at the Park’s Visitor Center and Counting House (Boott Cotton Mill Museum) that have been upgraded to meet accessibility needs and codes.

6. Efforts to obtain competition:

a. Efforts to ensure offers are solicited from as many potential sources as is practicable:

For acquisitions over $25,000 the solicitation will be issued on the Government’s Point of Entry, sam.gov.

b. Pre-solicitation notice per FAR 5.2:

For acquisitions over $25,000 a pre-solicitation notice shall be posted on the Government’s Point of Entry, sam.gov unless the exception noted at FAR Part 5.202(a)(13) applies.

7. Determination that costs will be fair & reasonable:

Class A estimates for project 312999 which included pricing for the specific changing station at approx.

$2,500. Additional online research conducted by the CO shows the product is sold by multiple vendors just over $2,500.00. This is a brand name specific product but is sold commercially so comparable pricing is available.

8. Description of the market research conducted:

Additional manufacturers were reviewed (google and industry – Sweets, Builder’s First) to see if new products were available to compete with the Koala Kare product. There are similar products of lesser quality that use different janitorial supplies that over time would not be cost efficient for purchase of replacement supplies (sanitary guards-disposable) as it would be the only non-Koala Kare accessories in the park.

Other facts supporting other than full & open competition:

a. Reason why documents suitable for full & open competition have not been developed:

This product is for one part of a construction requirement to be solicited. The RFP will be solicited as Total Small Business Set-Aside to ensure adequate competition. NPS will continue to do market research to see if similar products become available in the market.

b. Data, estimated costs, or other rationale as to the extent or harm to the Government:

The Counting House (6) restrooms; Visitor Center (3) restrooms, and Kirk Street Agent’s House accessible restroom currently have the Koala Kare product installed in the facility in order to meet accessibility and state codes. Furthermore, an A&E Firm was contracted to design the renovation of the restrooms which will be part of the upcoming RFP. The designs and specifications include the installation of this specific product.

9. Interested Sources:

- WebstaurantStore

- Katom

- Island Supply Inc.

10. Actions to remove barriers to competition in the future for similar acquisitions:

NPS will continue to do market research to see if similar products become available in the market or will meet the needs of the local Park.

11. Certifications:

I certify that any supporting data that is the responsibility of technical or requirements personnel (i.e. verifying the Government’s minimum needs or schedule requirements or other rationale for other than full and open competition) and which form a basis for the justification have been certified as complete and accurate:
