Justification for Brand Name Products

This is a brand name justification document for a National Park Service procurement authorizing single-source acquisition of a specific lavatory sink product. The National Park Service, through the Boston Major Acquisition Buying Office, is soliciting for rehabilitation of restrooms at the Mogan Cultural Center in Lowell, Massachusetts (Project LOWE 350067). The required product is a Bradley Model VERGE LVQD1-WB2 lavatory sink with integrated washbar, faucet, soap dispenser, and hands-free dryer that meets ABA Accessibility Standards (ABAAS). The justification is approved for acquisitions up to $50,000 and cites authority under 41 U.S.C. 253(c)(1) and FAR Parts 11.105 and 6.302-1, establishing that only one responsible source can satisfy agency requirements and that other manufacturers' similar products do not meet or cannot be modified to meet the agency's accessibility needs.

The acquisition is justified by prior successful installation of identical Bradley units in two recent park bathroom rehabilitations—three restrooms at the Visitor Center and six restrooms at the Counting House (Boott Cotton Mill Museum)—completed under project PMIS 312999 in FY25. Market research reviewed alternative manufacturers through Google and industry resources (Sweets, Builder's First) but identified only lesser-quality products with incompatible components that would prove cost-inefficient for long-term maintenance and supply replacement. Class A estimates from the prior project valued the specific lavatory sink at approximately $7,636, with current online research showing the product priced just over $8,000 through multiple commercial vendors. The RFP will be solicited as a Total Small Business Set-Aside to ensure competition, and the NPS will continue monitoring the market for competing products. Interested sources identified include Total Restroom.com, Sustainable Supply.com, and Bradley Corporation via wholesale distributors.

United States Department of the Interior

NATIONAL PARK SERVICE

NORTHEAST REGION

CONTRACTING PROGRAM

Justification for Brand Name Products

Date: April 13, 2026

Project: LOWE 350067 Rehabilitate Mogan Bathrooms

1.Identifications

a. Agency: National Park Service

b. Contracting Office: Boston Major Acquisition Buying Office

2.Description of the action being approved:

The National Park Service (NPS) shall be soliciting for the Rehabilitation of restrooms in the Mogan Cultural Center, in Lowell, MA. The documents included with the solicitation call for specific brand name products that are peculiar to one manufacturer. This written justification provides approval for limiting competition to the listed brand name products as authorized by the Federal Acquisition Regulations (FAR).

3.Description of supplies and services: LAVATORY SINK, Bradley Model VERGE LVQD1-WB2 with Integrated Washbar, faucet, soap dispenser and dryer for hands-free accessibility in compliance with ABAAS.

4. Authority:

a. 41 U.S.C. 253(c)(1): Only one responsible source and no other supplies or services will satisfy agency requirements.

b. FAR Part 11.105: Brand Name products are essential to the Government’s requirements, and market research indicates other companies’ similar products do not meet and cannot be modified to meet the agency’s needs.

c. FAR 6.302-1: The use of the name brand products is essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company.

5. The description of the product’s unique qualifications or the unique nature of the acquisition:

The Park has installed this hands free lavatory sink unit in two recent Park bathroom rehabilitations under PMIS 312999 at the Park’s Visitor Center (3 restrooms) and Counting House (Boott Cotton Mill Museum)(6 restrooms) that have been upgraded to meet accessibility needs and codes.

6. Efforts to obtain competition:

a. Efforts to ensure offers are solicited from as many potential sources as is practicable:

For acquisitions over $25,000 the solicitation will be issued on the Government’s Point of Entry, sam.gov.

b. Pre-solicitation notice per FAR 5.2:

For acquisitions over $25,000 a pre-solicitation notice shall be posted on the Government’s Point of Entry, sam.gov unless the exception noted at FAR Part 5.202(a)(13) applies.

7. Determination that costs will be fair & reasonable:

Class A estimates for project 312999 which included pricing for the specific lavatory sink at approx. $7,636.

Additional online research conducted by the CO shows the product is sold by multiple vendors just over $8,000.00. This is a brand name specific product but is sold commercially so comparable pricing is available.

8. Description of the market research conducted:

Additional manufacturers were reviewed (google and industry – Sweets, Builder’s First) to see if new products were available to compete with the Bradley product. There are similar products of lesser quality that use different janitorial supplies, have different internal components for the “wash bar” that dispenses liquid soap, hand drying, and water that over time would not be cost efficient for purchase of replacement components and supplies as it would be the only facility for visitor use restrooms without the Bradley units.

Other facts supporting other than full & open competition:

a. Reason why documents suitable for full & open competition have not been developed:

This product is for one part of a construction requirement to be solicited. The RFP will be solicited as Total Small Business Set-Aside to ensure adequate competition. NPS will continue to do market research to see if similar products become available in the market.

b. Data, estimated costs, or other rationale as to the extent or harm to the Government:

The Counting House (6) restrooms; Visitor Center (3) restrooms currently have the Bradley product installed in the facility in order to meet accessibility and state codes. The LOWE 312999 project was completed in FY25. The Mogan Restrooms are the last phase of the parkwide bathrooms rehabilitation improvements. Furthermore, an A&E Firm was contracted to design the renovation of the restrooms which will be part of the upcoming RFP. The designs and specifications include the installation of this specific product.
