About this file

This is a Justification for Brand Name Products document issued by the National Park Service (NPS) Northeast Region, dated April 13, 2026, for Project LOWE 350067 – Rehabilitate Mogan Bathrooms at the Mogan Cultural Center in Lowell, Massachusetts. The contracting office is the Boston Major Acquisition Buying Office. The NPS is justifying the limitation of competition to specify Duraflex Hybri-Flex EQ, a self-leveling broadcast quartz epoxy/aliphatic urethane topcoat seamless flooring system with integral base, for restroom flooring rehabilitation. The product was previously installed in the Park's Visitor Center and Counting House Bathrooms under Project PMIS 312999 and has demonstrated superior durability and performance compared to alternative systems. The justification is authorized under 41 U.S.C. 253(c)(1), FAR Part 11.105, and FAR 6.302-1, establishing that only one responsible source can satisfy agency requirements and that no other supplies or services will meet the needs.

The acquisition requires certified installers with ten-year experience, and Duraflex is identified as the only manufacturer of the required product. Market research using Google and industry sources (Sweets, Builder's First) was conducted to identify competing products, installation techniques, certifications, and warranty options; no alternative vendors were located. Cost estimates are based on Class A pricing from Project 312999 at $25.00 per square foot, which will be used with previous acquisition data to determine fair and reasonable pricing. The RFP will be solicited as a Total Small Business Set-Aside to ensure adequate competition, and a pre-solicitation notice will be posted on sam.gov for acquisitions exceeding $25,000. The NPS commits to continued market research to identify similar products as they become available and will pursue full and open competition for future similar acquisitions when viable alternatives emerge. The justification was signed by David Lieb, RA, COR (Contracting Officer Representative) on April 13, 2026, and Mari L. Tolleson, Contracting Officer, on April 21, 2026, with certification authority up to $50,000.

NATIONAL PARK SERVICE

NORTHEAST REGION

CONTRACTING PROGRAM

Justification for Brand Name Products

Date: April 13, 2026

Project: LOWE 350067 Rehabilitate Mogan Bathrooms

1.Identifications

a. Agency: National Park Service

b. Contracting Office: Boston Major Acquisition Buying Office

2.Description of the action being approved:

The National Park Service (NPS) shall be soliciting for the Rehabilitation of restrooms in the Mogan Cultural Center, in Lowell, MA. The documents included with the solicitation call for specific brand name products that are peculiar to one manufacturer. This written justification provides approval for limiting competition to the listed brand name products as authorized by the Federal Acquisition Regulations (FAR).

3.Description of supplies and services: The Duraflex product specified is being used on the flooring in the rest rooms for the Mogan Cultural Center and was previously installed in the Park’s Visitor Center and Counting House Bathrooms under PMIS 312999. The product is Hybri-Flex EQ, (self-leveling broadcast quartz), epoxy/aliphatic urethane topcoat seamless flooring system. It includes the flooring and integral base.

4. Authority:

a. 41 U.S.C. 253(c)(1): Only one responsible source and no other supplies or services will satisfy agency requirements.

b. FAR Part 11.105: The Brand Name products are essential to the Government’s requirements, and market research indicates other companies’ similar products do not meet and cannot be modified to meet the agency’s needs.

c. FAR 6.302-1: The use of the name brand products are essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company.

5. The description of the product’s unique qualifications or the unique nature of the acquisition:

All of the buildings in the Lowell National Historical Park, except the Visitor Center, and the Counting House have the Duraflex products. It has been shown, and the park is satisfied with the durability and finish, to provide the best performance and value to the Park over other manufactured and installed systems. It requires certified installers with ten-year experience to install the product, repairs can be made, and the manufacturer has shown the Park that it is able to review and suggest methods and means to make an installation the best it can be.

6. Efforts to obtain comPetition:

a. Efforts to ensure offers are solicited from as many potential sources as is practicable:

For acquisitions over $25,000 the solicitation will be issued on the Government’s Point of Entry, sam.gov.

b. Pre-solicitation notice per FAR 5.2:

For acquisitions over $25,000 a pre-solicitation notice shall be posted on the Government’s Point of Entry, sam.gov unless the exception noted at FAR Part 5.202(a)(13) applies.

7. Determination that costs will be fair & reasonable:

Class A estimates for project 312999 (VC and Counting House bathrooms) included pricing for this specific flooring at $25.00/sf. It will be used along with previous acquisitions for the same material to determine fair and reasonableness.

8. Description of the market research conducted:

Additional manufacturers were reviewed (google and industry – Sweets, Builder’s First) to see if new products were available to compete with the Duraflex product. Additional research performed in regard to installation techniques, certifications, and warranty issues. No vendors were located.

Other facts supporting other than full & open competition:

a. Reason why documents suitable for full & open competition have not been developed:

This product is for one part of a construction requirement to be solicited. The RFP will be solicited as Total Small Business Set-Aside to ensure adequate competition. NPS will continue to do market research to see if similar products become available in the market.

b. Data, estimated costs, or other rationale as to the extent or harm to the Government:

The Counting House currently has the Duraflex product installed. It has been shown, and the park is satisfied with the durability and finish, to provide the best performance and value to the Park over other manufactured and installed systems. This sole justification will enable the Park to save money over time and eliminate the need for future cyclic repairs. Furthermore, an A&E Firm was contracted to design the renovation of the restrooms which will be part of the upcoming RFP. The designs and specifications include the installation of this specific product.

9. Interested Sources:

- Duraflex is the only manufacturer of the required product.

10. Actions to remove barriers to competition in the future for similar acquisitions:

NPS will continue to do market research to see if similar products become available in the market or will meet the needs of the local Park.

11. Certifications:

Technical / Requirements Certification:

I certify that any supporting data that is the responsibility of technical or requirements personnel (i.e. verifying the Government’s minimum needs or schedule requirements or other rationale for other than full and open competition) and which form a basis for the justification have been certified as complete and accurate:
