About this file
The document is a Forest Service Handbook (FSH) supplement for the Fremont-Winema National Forests, specifically addressing road system operations and maintenance. It details road maintenance sharing costs and responsibilities for commercial users of National Forest System Roads, establishing guidelines for maintenance fees and cost allocation.
The handbook outlines two types of road maintenance needs: traffic-generated maintenance (direct result of user traffic) and nontraffic-generated maintenance. Commercial users are required to bear the entire cost of traffic-generated maintenance and a proportional share of nontraffic-generated maintenance. The document provides specific fee rates for road use, surface rock replacement, and structure maintenance, calculated per thousand board feet (MBF) or per mile. Rates vary based on road surface type (native, aggregate, or bituminous) and include fees for bridges, retaining walls, gates, and cattleguards. The supplement was effective January 1, 2010, and is designed to implement the Forest Roads and Trails Act, ensuring commercial users perform or pay for maintenance caused by their road use.

63 - MAINTENANCE SHARING
63.41 – Responsibility and Associated Costs
The Forest Roads and Trails Act (16 USC 532-538) allows the Secretary to require commercial users of National Forest System Roads to perform or pay for maintenance made necessary by their use. The Chief requires that all commercial users perform or pay for their commensurate share of maintenance that they cause (FSM 7732.03). The Chief has delegated responsibility for implementation to the Forest Supervisor level. See FSM 7730. Forest line officers do not have delegated the authority to waive this requirement.
This requirement applies to all commercial users, not just timber purchasers. Commercial haul is performed by contractors, special use permittees, road use permittees, cost share cooperators, minerals permittees and others. Commercial entities are required to perform or pay for maintenance commensurate with their use of the road system.
There are two types of road maintenance needs for which collections may be made. They are traffic-generated maintenance (the direct result of a user's traffic--examples are surface blading and dust abatement) and nontraffic-generated (examples are brushing, logging out blown down trees, and removing landslides).
There are also two time frames for maintenance. Some activities are done concurrent with road use (again, surface blading and dust abatement are examples). Others are done once every few years (replacing rock surfacing, seal coating paved roads, and brushing for sight distance are examples).
Commercial users bear the entire cost of traffic-generated maintenance that they cause. They bear their "share" of nontraffic-generated maintenance as calculated based on the distribution of commercial versus non-commercial traffic on the road. Having commercial users perform as much of their commensurate share of maintenance as possible is preferred over collecting fees.
There are some types of work that are better handled through collections because of expense and complexity. Examples include pavement maintenance and bridge maintenance.
Often collections are made for long-term cyclical items such as brushing and surface rock replacement because of economies of scale. Take collections for the entire maintenance obligation of very small commercial operations. It is not economical to move in a piece of equipment to do $500.00 worth of maintenance obligation incurred by hauling 20 loads of logs.
Specifically for FS timber sales, there is a maintenance allowance computed as part of the appraisal process. The allowance includes all maintenance, whether traffic related, nontraffic related, done by the purchaser, or done by collections into CWFS.
DURATION: This supplement is effective until superseded or removed.
Road maintenance and surface rock replacement rates are typically calculated on a per thousand board foot (MBF) or hundred cubic feet (CCF) basis. Biomass is generally lighter in weight resulting in more volume on a truck. Rates for products other than logs will be calculated based on a conversion factor of 16,000 pounds per thousand board feet (MBF).
Surface rock replacement deposits will only be collected on aggregate-surfaced roads listed in Table 1.
Road Maintenance Deposit Rates
(Does not include the Fremont-Winema NF overhead assessment fee which is established in the annual budget direction. These rates will be adjusted for inflation each year using the consumer price index and may be subject to recalculation by the Forest Service if economic conditions warrant. These rates and costs are computed at the time the permittee requests the road use permit; Form FS-7700-41, from the Forest Service.)
1. Road Use Fee (Investment Sharing)
$/MBF/Mile Native Surfaced Roads $0.24 Aggregate and Bituminous Roads $0.69
Note: Performance of reconstruction work may be done in lieu of collecting fees for Investment Sharing and that is the preferred method. Investment sharing is only appropriate for Non-federal commercial haul (FSM 7731.3)
2. Surface Rock Replacement (Applies Only to Roads in Table 1)
Aggregate Roads $0.42
3. Road Maintenance
Native Surfaced Roads $0.65 Aggregate Surfaced Roads $0.65 Bituminous Surfaced Roads $0.61
DURATION: This supplement is effective until superseded or removed.
4. Structure Maintenance Fee (This fee covers the wear and maintenance on bridges, retaining walls, gates and cattleguards.
Bridge $0.15/mbf per bridge Retaining Wall $0.02/mbf per wall Gate/Closure Device $0.05/mbf per gate Cattleguard $0.01/mbf per cattleguard
5. Performance Bond
If a permittee is performing work on the road, collect either all fees up front as bond or $1,000.00 per mile of road rounded to the nearest thousand. Long-term permits may carry an agreed-upon balance. (FSH 7709.59, 24.11)
6. Rate for Other Products
The rate for other products may be prorated by using a weight ratio of the product weight hauled across the road. Use scale tickets. 1 MBF = 16,000 lbs. (FSH R6 Supplement 7709.59-98-1, 24.1)
7. Exception
Use a letter of authorization when the use is minor or the cost is less than $100.00. If a letter is used to authorize use, include clauses 5, 6, 7, and 8 from the standard permit (R6-FS-7700-
41) in the letter. (FSH R6 Supplement 7709.59-98-1, 24; FSM 7731.17, subsection 1)
DURATION: This supplement is effective until superseded or removed.
