About this file
This document is a Department of Veterans Affairs (VA) certification template for limitations on subcontracting compliance, specifically VAAR clause 852.219-75 (January 2023 Deviation). The certification is mandatory for all offerors responding to VA solicitations and must be completed, signed, and submitted with bids, quotations, or proposals by the deadline. Failure to include a properly completed certification will result in automatic proposal rejection, as will any incomplete or incorrect information.
The certification requires offerors to confirm compliance with subcontracting limitations based on contract type: for services contracts (excluding construction), contractors may not pay more than 50% of government payments to non-certified SDVOSB or VOSB firms; for general construction contracts, the limit is 85%; and for special trade construction contracts, the limit is 75%. All work further subcontracted by certified SDVOSB/VOSB subcontractors counts toward these thresholds. Offerors must provide their legal entity name (matching SAM.gov registration), signee name and title, authorized signature, signature date, and complete company address. The certification carries legal weight under 18 U.S.C. Section 1001, subjecting false certifications to criminal, civil, and administrative penalties. Offerors agree to provide documentation upon request to demonstrate compliance, including invoices, subcontracts, and task value lists, understanding that non-compliance may result in referral to the VA Suspension and Debarment Committee, fines, or prosecution.
