About this file

Attachment J is a Principal Place of Business Letter required by the Florida Department of Management Services for ITB No. 25-25100000-ITB, a statewide motor vehicle procurement. Bidders must complete this form to declare whether their principal place of business is located within or outside the State of Florida. For bidders with a Florida principal place of business, completion requires only basic company information and an authorized representative signature. For out-of-state bidders, the form must be accompanied by a legal opinion from an attorney licensed to practice law in the state where the company's principal place of business is located. This legal opinion, mandated by Section 287.084(2), Florida Statutes, must address whether the bidder's home state grants any preferences to in-state business entities in public contracting. Failure to complete the out-of-state section will result in the bidder being deemed non-responsive.

The legal opinion section requires the attorney to certify their licensure in the bidder's home state and declare whether that state grants business preferences in public contracts. If preferences exist, the attorney must describe all applicable preference mechanisms with specificity. The completed form must be signed and dated by both the authorized bidder representative and the licensed attorney, with the attorney providing contact information including printed name, signature, email address, and telephone number. This document serves as a compliance mechanism to ensure Florida applies reciprocal preference policies to out-of-state bidders based on preferences their home states extend to Florida-based entities.
