About this file

This is a VA Notice of Limitations on Subcontracting Certificate of Compliance for Services and Construction, a required federal contracting form that offerors must complete and submit with their bids, quotations, or proposals.

The certificate establishes subcontracting limitations that contractors must comply with if awarded a contract. For services contracts (excluding construction), contractors cannot pay more than 50% of the government payment amount to firms that are not certified SDVOSBs or VOSBs as listed in the SBA certification database. For general construction contracts, the limitation is 85% of the amount paid by the government to non-certified SDVOSB/VOSB firms, with materials costs excluded. For special trade construction contractors, the limitation is 75% to non-certified firms, also excluding materials costs. Subcontracting work performed by similarly situated certified SDVOSB/VOSB entities counts toward these thresholds. The offeror certifies compliance under 38 U.S.C. 8127(l)(2) and acknowledges that false or fraudulent certification may result in criminal, civil, or administrative penalties, including prosecution. The Government reserves the right to request documentation or records to verify compliance at any time during performance. The form requires signature, printed name, title, date, and company name and address from an authorized representative, and responses lacking this certification will be deemed ineligible for evaluation and award.
