About this file

This attachment is a New York State procurement requirement document addressing the encouragement and use of New York State businesses in contract performance. The document establishes expectations that bidders and proposers utilize New York State businesses as subcontractors, suppliers, and partners in fulfilling contract requirements across commodities, services, and technology. All authorized contract users are strongly encouraged to procure from responsible and responsive New York State businesses when offerings are of equal quality and functionality to alternatives. The State emphasizes that such partnerships will create private sector jobs, support infrastructure development, and maximize economic activity while enhancing contractor performance and public sector program outcomes. Bidders and proposers must continue to comply with existing State law requirements regarding small, minority-owned, and women-owned business utilization.

The document requires bidders and proposers to respond to a declarative question regarding whether New York State businesses will be used in contract performance and, if affirmative, to identify such businesses and provide supporting documentation. Signatories must include their printed name, title, and date on the response form. This requirement applies uniformly across all procurement types and does not establish financial set-asides or pricing adjustments but rather reflects a policy commitment to leveraging State contracts as economic development tools that benefit both contractors and their New York State business partners.
