About this file
This document is a justification for a single source award under simplified acquisition procedures for a Department of Veterans Affairs construction project. The project involves installing new building automation controls equipment at the Minneapolis VA Health Care System to prevent Legionella. The justification cites that the current controls system was installed by Johnson Controls International (JCI) and uses proprietary programming and equipment. As such, to ensure all controls can be viewed on one combined system, only JCI is authorized to provide all new controls work for the project. Installing a different contractor would require a new and separate controls system to be implemented. The solicitation will include JCI as a required sole source subcontractor for the controls work, estimated at $3 million. The contracting officer certified the single source justification as accurate and complete.

DEPARTMENT OF VETERANS AFFAIRS
Justification for Single Source Awards IAW FAR 13.106 1 For
Over Micro Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: 36C263 23 AP 0103
1. Contracting Activity: Department of Veterans Affairs, VISN 23 Ordering Activity: Minneapolis VA Health Care System (VAHCS), Facilities Engineering Department Purchase Request Number: 618 23 4 6953 0001
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: VISN 23 will be issuing an Open Market Solicitation for Project 618 18 108 Prevent Legionella Phase 3, in anticipation of awarding a single Contract for this project. The solicitation will include the requirement of a sole source subcontractor: Johnson Controls, International (JCI). JCI will be performing all the building automation work for the project. This includes all installation and controls work. The anticipated amount for this project is
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
The current building automation system has all been installed by JCI. Their programming and equipment is proprietary and other contractors are unable to access their system. Therefore, to ensure all our controls are viewed on one combined system, JCI needs to provide all controls work for this project. If another contractor were to install the new controls equipment, they would need to install a whole new head end system. Also, any controls equipment from the existing system would need to be demolished and removed from the current building automation system, which is controlled by JCI.
4. Description of market research conducted and results or statement why it was not conducted:
No further market research was performed as the use of a different contractor for the controls would need to require an entirely new and/or additional controls system for the new components installed in this project. This would include a whole new head end system, home runs back to that system, and additional work by JCI to remove their existing controls from the equipment to be demolished as a different company would not be able to get into their system.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106 1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
