Attachment B - Marco Island Ordinance 18-06
This is an ordinance document from the City of Marco Island, Florida, establishing regulatory framework for concession operations at Tigertail Beach. The ordinance governs the terms, conditions, and operational requirements for vendors providing concession services at this public beach facility located at 490 Hernando Drive on Marco Island. The facility operates year-round, 365 days annually from 8:00 a.m. to sunset, and serves over 150,000 annual visitors. Collier County's Procurement Services Division is soliciting proposals through Invitation to Negotiate No. 25-8577 for concession services under three options: Option A for food and beverage sales only (360 square feet), Option B for beach rentals including umbrellas, paddleboards, cabanas, and beach chairs (120 square feet), or Option C combining both services. A pre-proposal conference is scheduled for March 11, 2026, at 10:00 a.m. at the Procurement Services Division office in Naples, with proposals due by April 2, 2026, at 3:00 p.m. through the Collier County Procurement Services Division Online Bidding System. The initial contract term is three years with two one-year renewal options.
The Marco Island ordinance establishes the regulatory foundation and operational standards that concessionaires must meet at Tigertail Beach. Vendors are responsible for providing their own kitchen equipment, refrigeration, and all beach rental equipment while complying with all Florida food safety, health, and licensing requirements. Contract fees are structured on a flat annual basis paid in quarterly installments or monthly payments by the fifteenth of each month, with the previous concessionaire paying approximately $3,800 monthly; proposers must submit proposed annual fees per square foot with five percent annual increases during renewal years. Evaluation criteria include vendor experience and qualifications (30 points), minority/women business enterprise certification (5 points), operational plans and menu variety (35 points), food safety and health regulation compliance (20 points), and local vendor preference for businesses with current Business Tax Receipts in Collier or Lee County (10 points). All proposers must be enrolled in E-Verify, maintain comprehensive insurance coverage including Workers' Compensation at statutory limits, Commercial General Liability at $1,000,000 single limit per occurrence with $2,000,000 aggregate, Automobile Liability at $300,000 each occurrence, and submit a bid bond equal to five percent of the cost proposal.
