About this file
This is a Land Use Control (LUC) Remedial Design (RD) document for the Philadelphia Naval Yard Annex (PNYA) in Philadelphia, Pennsylvania, prepared by Tetra Tech under CLEAN Contract N6247016D9008 for NAVFAC Mid-Atlantic. The document establishes land use controls for nine retained areas within the former Philadelphia Naval Base (PNB) that was closed in 1995.
The LUCs specify three key restrictions: 1) groundwater from wells in PNYA retained areas cannot be used for human consumption, 2) PNYA retained areas cannot be used for permanent residential purposes, and 3) any outdoor childcare playground development must include 2 feet of clean fill material between the underlying soil and playground surface. The document details implementation actions including annual compliance inspections, documentation requirements, and notification procedures to PADEP for any changes in land use. The nine LUC areas are mapped and include the Reserve Basin, Pier 4, Pier 7, and associated facilities. The document includes inspection checklists and requires five-year reviews to evaluate the effectiveness of the controls, with the first review scheduled for 2023.

1.0 Introduction
This document constitutes the Land Use Control (LUC) Remedial Design (RD) for the retained property at the Naval Support Activity (NSA) Mechanicsburg Support Area Philadelphia Naval Yard Annex (PNYA) in Philadelphia, Pennsylvania. The document was prepared by Tetra Tech under Comprehensive Long-Term Environmental Action Navy (CLEAN) Contract N6247016D9008, Contract Task Order (CTO) N4008521F5493 on behalf of the Department of the Navy (Navy) Naval Facilities Engineering Systems Command (NAVFAC) Mid-Atlantic. The Philadelphia Naval Base (PNB) officially closed in 1995 in accordance with the 1991 Base Realignment and Closure (BRAC) process.
Portions of the complex have been transferred to civilian uses as the Philadelphia Naval Business Center, and the Navy has retained nine areas, mostly as part of the Ship Systems Engineering Station. NAVFAC Mid-Atlantic is the lead agency conducting the evaluation and cleanup of the retained parcels at PNYA. This LUC RD was developed as part of the overall remedial design to address LUC implementation actions in accordance with the Decision Document for Base-Wide Institutional Controls (Navy, 1998). This document has been prepared in accordance with the Navy Principles and Procedures for Specifying, Monitoring and Enforcement of Land Use Controls and Other Post-ROD Actions (Navy Principles) (DoD, 2003) and Sample Federal Land Use Control ROD Checklist with Suggested Language (LUC Checklist) (EPA, 2013) as agreed between the United States Environmental Protection Agency (EPA) and the Department of Defense (DoD).

2.0 Background and Site Description
On December 12, 1868, the City of Philadelphia granted title of League Island to the Navy. The League Island that the Navy acquired in the mid-1800s was mapped in 1899 as the U.S. Navy Yard. The island was enlarged over time through placement of fill material. The filling operations connected the island to the mainland and expanded it into the Delaware and Schuylkill Rivers. Fill material, predominantly dredge spoils, consisted of sand and gravel, cinders, brick, concrete, wood, and rubbish. The fill is believed to be a minimum of 5-feet thick throughout much of the Naval Base (EA, 1998).
Located in South Philadelphia at the confluence of the Delaware and Schuylkill Rivers, the PNB was one of the Navy’s largest industrial facilities. The Philadelphia Naval Complex was a major military shipyard with 4 miles of waterfront on the Delaware River.
PNYA, formerly known as the Philadelphia Naval Base and the Philadelphia Naval Shipyard, operated as a Naval base for more than 120 years, employing more than 40,000 people during its peak production period during World War II (Trevet, 2016).
The Philadelphia Naval Complex encompassed approximately 1,455 acres (Figure 2-1) (EA, 1999). The former Philadelphia Naval Shipyard accounted for about 348 acres including 25,000 linear feet of berthing space; five drydocks; and 34 fixed, floating, and track cranes. Facilities at the Base housed 23 fully equipped production shops totaling more than 7 million square feet of space. The Base officially closed in 1995 in accordance with the 1991 BRAC process, and a number of conveyance parcels and/or areas were transferred to the City of Philadelphia and were redeveloped as the Philadelphia Naval Business Center. The Navy has retained nine areas within the original parcels and continues to operate on them, mostly as part of the Ship Systems Engineering Station (V&L, 2001; Trevet, 2016).
PNYA is situated in a highly industrialized and developed area (Figure 2-1).
Transferred parcels which are part of the Philadelphia Naval Business Center are now used for office space, industrial and manufacturing processes, and research and development.
Because the Base is in a highly urbanized area and was one of the Navy’s largest industrial facilities for many years, the environmental studies have focused on requirements that assume long-term industrial/commercial reuse, rather than future residential scenarios. Environmental cleanup may not be required to meet commercial/industrial criteria; however, since the residential standards have not been applied, Institutional Controls are required to prohibit residential reuse and to maintain the industrial/commercial status (Navy, 1998).
As outlined in the Navy’s 1998 Decision Document for Base-Wide Institutional Controls, environmental investigations and remediations have been accomplished at PNYA under

various restoration and compliance programs, including the Navy Installation Restoration (IR) Program, Resource Conservation and Recovery Act Corrective Action, the Environmental Baseline Survey, and the Environmental Protection Agency’s Environmental Photographic Interpretation Center Aerial Photographic Review. Other compliance programs addressed Storage Tanks (aboveground and underground), Hazardous Materials/Waste Management, Polychlorinated Biphenyls (PCB) Management, Asbestos Surveys and Abatement, Radon Assessments, National Pollutant Discharge Elimination System Permits, Air Permits, Lead-Based Paint, Pesticide Management Practices, and the Navy Natural and Cultural Resources Program. Information developed for these programs and the City of Philadelphia Reuse Plan (City of Philadelphia, 1994) constitutes the basis for the selected Institutional Controls described Section 3.0.
2.1 IR Program Sites and Investigations within PNYA Retained
Areas
Under the Navy IR Program, a total of 15 sites were identified at the former PNB. Of these original 15 sites, the following 4 sites were located within the retained PNYA parcels:
• Site 7 – Building 546 PCB Transformer Spill Area
• Site 8 – Reserve Basin Sediment
• Site 9 – Fuel Tanks 866
• Site 14 – Building 592 Oil Spill Area
Site 7 remedial activities were outlined in the 1992 IR Program Record of Decision (ROD) Declaration for Sites 3, 6, 7 and 15 (Navy, 1992). An amended ROD for Site 7 was issued in 1996 which identified a soil cleanup level assuming a commercial and/or industrial land use scenario (Navy, 1996). Cleanup was documented in the Remedial Action Completion Report (RACR) for PCB Removal Actions IR Program Site 7, which concluded that no further remedial actions were required at Site 7 under a commercial and/or industrial land use scenario (B&R, 1996). Following removal of PCB-impacted soil at IR Site 7, the site was closed out of the IR Program (EA, 1999).
IR Site 8 encompasses sediment within the Naval Reserve Basin, which had been used for more than 100 years for storing inactive Navy vessels. Site practices resulted in release of contaminants to the sediments constituting the substrate of the basin. The Decision Document finalized in October 2006 outlined the selected remedy to address contaminated sediment at the Reserve Basin and was concurred with by Pennsylvania Department of Environmental Protection (PADEP). The selected remedy consisted of removal and off-site disposal of sediments contaminated with site-related pollutants at concentrations that posed unacceptable risks to human health and the ecosystem and
CTO N4008521F5493 Background and Site Description
27456_PHL 2-3
was consistent with the Navy’s continued use of the Reserve Basin for storage of inactive ships (Navy, 2006). Contaminants included PCBs and copper. The sediment removal remedy was part of a larger navigational dredging project which was designed and implemented by the U.S. Army Corps of Engineers (USACE) throughout the reserve basin. An estimated 56,918 cubic yards of contaminated sediments were proposed for excavation and off-site disposal. PADEP approval of the RACR for the Naval Basin sediment remedial actions was issued on October 4, 2007. As outlined in the 2007 letter, no additional remediation or sampling was warranted (PADEP, 2007).
IR Site 9 was removed from the IR Program and was managed under Pennsylvania storage tank regulations. The site was the previous location of two 88,000-gallon No. 6 fuel oil ASTs which were removed and replaced in 1995 as part of a Military Construction project. Impacted soil within the bermed area surrounding the tanks was also removed. As outlined in the 1999 BRAC Cleanup Plan (BCP), a site characterization report was prepared to address soils and groundwater outside the bermed area. Regulatory closure in accordance with the state storage tank regulations was recommended for former IR Site 9 based on the site characterization findings and detection of minimal constituents of concern (EA, 1999).
IR Program Site 14 was located along the southern border of the Naval Reserve Basin and was reportedly used for the storage of waste oil drums. Surficial soil stains were reported, and an oil spill was observed at the site in May 1988. A remedial investigation (RI) was conducted from 1990 to 1992; however, in April 1995 the Navy obtained PADEP concurrence to treat Site 14 as an oil spill site under applicable State regulations. A 1996 Site Characterization Report which included review of surface soil and subsurface soil sample data to PADEP Act 2 Pennsylvania Land Recycling Program criteria and Interim Cleanup Standards for Contaminated Soils, and groundwater results to federal drinking water Maximum Contaminant Levels (MCLs), concluded that no further action to achieve site closure was warranted. The site was subsequently removed from the IR Program (EA, 1996).
2.2 Regulatory Status and Land Use within PNYA Retained Areas
PNYA is not on the National Priorities List (NPL), and there are no current or active Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) operable units (OUs) at PNYA.
The Navy did not evaluate risk posed to future residents for parcels of PNYA since residential use was not deemed appropriate or consistent with the Community Reuse Plan (PIDC, 1994).
CTO N4008521F5493 Background and Site Description
27456_PHL 2-4
Current land use within the retained PNYA areas is industrial/commercial, and there is no residential or recreational use of the base. There are no planned or anticipated changes to the current land use in the PNYA retained areas. Should any of the property be transferred in the future, LUC provisions (i.e., deed notice and covenants) will be put in place that will prohibit future residential use, prohibit potable use of groundwater, and place restrictions on outdoor childcare. Other response actions, if required, will be described in separate decision documents for specific parcels of PNYA.
The 1998 Decision Document for Base-Wide Institutional Controls selected Institutional Controls for the Philadelphia Naval Base and addresses both retained and transferred parcels or areas (Navy, 1998). Four IR Program sites within the retained areas have been remediated and/or removed from the Navy’s IR Program. As outlined in the Decision Document, the nine PNYA retained areas are subject to the CERCLA remedy, Institutional Controls to maintain the current industrial/commercial land use.
CTO N4008521F5493 Land Use Controls
27456_PHL 3-1
3.0 Land Use Controls
LUCs are used at sites where contaminants are left in place at levels that do not allow for unrestricted use and unlimited exposure. The LUCs ensure that those contaminants do not pose an unacceptable risk to human health and the environment. LUCs can consist of institutional controls and/or engineering controls. Institutional controls such as activity restrictions and regulatory notification requirements are typically legal documents in the form of deed restrictions, easements, and restrictive covenants. In the case of an active military base, they can also consist of Base Instructions, notations on installation land use plans, or similar instruments. In the form of a legal document, the institutional controls will run with the land. Engineering controls are typically barriers, such as asphalt, engineered covers, or fencing.
The Decision Document for Base-Wide Institutional Controls selected LUCs, including institutional controls, as the remedy for the PNB, including the PNYA retained areas, to control or restrict certain types of property uses (Navy, 1998). PADEP concurred with the selected remedy (Institutional Controls). The LUCs will be maintained until concentrations of hazardous substances have been reduced to levels that allow for unlimited use and unrestricted exposure. Because implementation of this remedy will result in contaminants remaining at the site above health-based levels that allow unrestricted use (i.e., permanent residential use) of the site, a review must be conducted every five years after commencement of remedial action to ensure that the remedy remains protective of human health and the environment. The first review of the Institutional Controls in place at PNYA will be conducted in 2023. To facilitate Navy and regulatory review, the Navy has proposed that Five-Year Reviews for the PNYA retained parcels be conducted concurrent with the Five-Year Reviews for the Former Naval Station Philadelphia Transferred Parcels. LUC Areas 1 through 9 presented on Figure 3-1, represent the nine PNYA retained areas. The nine areas are based on the Parcel Plan Philadelphia Naval Base - Index Sheet (V&L, 2001), which is included in Appendix A for reference.
The LUC performance objectives for the entire PNB, including both retained (active) parcels/areas (PNYA) and transferred parcels/areas, were outlined in the 1998 PNB Decision Document. The following objectives, requirements and restrictions were included in the 1998 Decision Document:
• Groundwater withdrawn from wells situated in PNB shall not be used or made available for human consumption.
• PNB shall not be used or developed for any permanent residential uses.
CTO N4008521F5493 Land Use Controls
27456_PHL 3-2
• Any construction or development of an outdoor childcare playground, within PNB, will include placement of 2 feet of clean fill material, or other cover as approved by the PADEP, between underlying soil and the surface of the childcare playground prior to commencement of any use of the outdoor area as a playground.
LUC implementation and inspections for the transferred parcels/areas are managed/conducted by the NAVFAC Mid-Atlantic BRAC Program Management Office East. The implementation and review of LUCs for transferred areas of the former PNB were most recently addressed in the Fourth Five-Year Review Addendum, Girard Point Management Area at Former Naval Station Philadelphia (Tetra Tech, 2021).
LUC implementation and inspections for the retained parcels/areas will be managed and conducted by PNYA personnel in accordance with this LUC RD. Institutional controls for the retained areas of the former PNB, or the PNYA LUC Areas (Figure 3-1), will be implemented to ensure that the LUC performance objectives are met. These institutional controls are summarized in Table 3-1 and are discussed further in Section 4.
Implementation actions to be taken to ensure that the LUC objectives are met are discussed in the following section. Section 4.0 also defines the required notifications and authorizations and the roles and responsibilities for the implementation actions.
CTO N4008521F5493 Land Use Control Implementation Actions

4.0 Land Use Control Implementation Actions
Pursuant to the 1998 Decision Document, the Navy is responsible for implementing, maintaining, reporting on, and enforcing the institutional controls in accordance with this LUC RD. For purposes of this LUC RD, the term “implementation actions” means actions to implement, operate, maintain, and enforce the LUC component of the remedy. The Navy will perform all short- and long-term implementation actions at the PNYA in accordance with The Principles and Procedures for Specifying, Monitoring and Enforcement of Land Use Controls and Other Post-ROD Actions (DoD, 2003), the Decision Document (Navy, 1998), and applicable Navy directives. The Navy may in the future delegate or transfer authority to conduct these actions to another entity as part of property transfer agreements (i.e., deed).
As set forth in this LUC RD, the following implementation actions will be performed to ensure that the LUC objectives are met in accordance with the Decision Document:
1. Following approval of this LUC RD, boundary information (e.g., figure and coordinates) for the nine LUC areas shown on Figure 3-1 and Figures 4-1 through 4-9 will be placed in the Naval Installation Restoration Information Solution (NIRIS) database and the LUC Tracker Module for the installation. This will be completed at least 30 days prior to the initial annual inspection.
2. Follow LUC-related procedures pertaining to changes in land use in accordance with Commander, Navy Region, Mid-Atlantic Instruction 5090.2A, Installation Restoration; Land Use Controls at Navy Region, Mid-Atlantic Installations;
Establishment and Maintenance, as amended, or subsequent revisions (Navy, 2018).
3. Conduct annual inspections of the LUCs in accordance with the LUC Inspection Checklist (Appendix B) and provide a yearly report to PADEP. Yearly reports will identify all implementation actions that have been taken and need to be taken to maintain LUCs according to the 1998 Decision Document, including inconsistent land use activity at the site, any LUC failures, and the corrective action taken or proposed for each.
4. Report and notify PADEP. The notification requirements are summarized in Table 3-1 and include the following:
a) Notify PADEP 45 days in advance of any proposed change in land use that would require modifications to the LUCs to remain consistent with the LUC objectives or the selected remedy. The notice shall describe how the LUCs
CTO N4008521F5493 Land Use Control Implementation Actions
27456_PHL 4-2
will be changed and mechanisms by which the new LUCs will be implemented to maintain the protectiveness of the remedy.
b) Notify PADEP as soon as practicable, presumptively within 10 days, of the discovery of activity at the Site inconsistent with the previously stated LUC objectives (e.g., installation of potable/domestic well within LUC Area), and then promptly investigate and take appropriate corrective action. Such notice will also outline the steps to be taken to (1) evaluate the effectiveness of LUCs, (2) develop appropriate corrective action, and (3) assess lessons learned and prevent recurrence. For cases in which such inconsistent activity does not create an imminent and substantial threat to human health or the environment, investigation will normally commence within 60 days.
c) Notify PADEP at least six months in advance of any anticipated transfer, out of Navy custody and control, of real property subject to LUCs. If six months advance notice is not reasonably possible, as much advance notice will be given as is reasonably possible, but in any event not less than 60 days. The Navy shall provide a copy of the executed deed or transfer documentation to PADEP including the mechanism by which LUCs will be implemented, maintained, inspected, reported on, and enforced.
d) Submit reports of annual LUC compliance inspections to PADEP within 3 months of the completion of the inspection. The results will be used in preparation of five-year reviews to evaluate the effectiveness of the remedy.
The LUC inspection will evaluate the status of the LUCs and how any LUC deficiencies or inconsistent uses have been addressed. The LUC inspections will also address whether Navy instructions remain current in regard to LUC enforcement and whether use of the property has conformed with such restrictions and controls.
5. Notify PADEP at least 45 days in advance of proposals for changes in land use that would be inconsistent with use restrictions and exposure assumptions described in the Decision Document and this LUC RD, any anticipated action that may disrupt LUC effectiveness, or any action that may alter or negate the need for LUCs.
6. Final LUC inspection reports will be uploaded to the Navy’s NIRIS database and LUC Tracker module. The report findings will be used in the preparation of the five-year review to evaluate the effectiveness of the LUCs. Five-year review results will be submitted to PADEP.
Should the Navy fail to complete a required LUC implementation action, PADEP will notify the Navy Remedial Project Manager and seek immediate action. If the Navy fails to
CTO N4008521F5493 Land Use Control Implementation Actions
27456_PHL 4-3
complete a required LUC implementation action within a reasonable time after being so notified, PADEP may notify the Deputy Assistant Secretary of the Navy (Environment and Mission Readiness), who will ensure that necessary action is taken.
Should a subsequent owner of, or a third party at, the property fail to complete a required LUC implementation action for which such owner or party is responsible, PADEP and the Navy will consult on the appropriate enforcement action. If after the property has been transferred, the Navy fails to complete a required LUC implementation for which it is responsible, PADEP will notify the cognizant NAVFAC component, which at this time is NAVFAC Mid-Atlantic Environmental Restoration Program, located at Naval Station Norfolk. If necessary, PADEP may notify the Deputy Assistant Secretary of the Navy (Environment and Mission Readiness), who will ensure that necessary corrective action is taken.

LAND USE CONTROL ANNUAL COMPLIANCE
INSPECTION CHECKLIST
Land Use Control Annual Compliance Inspection Checklist Philadelphia Naval Shipyard Annex (PNYA) Philadelphia, Pennsylvania
INSTRUCTIONS:
A
B
C
D
E
F A separate form must be completed for each LUC Area. The LUC Area box above must be checked.
The LUC inspection consists of five parts: 1) a review of files in Navy Installation Restoration Information Solution (NIRIS) and interviews with the Navy Remedial Project Manager (RPM) and the PNYA Point of Contact (POC); 2) site walk and inspection of LUC components; 3) follow up with responsible parties regarding any deficiencies identified; 4) suggested revisions to the inspection checklist; and 5) certification by the inspection team. The completed inspection checklist shall be included in the updated LUC Inspection Report, and the Inspection Report shall be filed in the post‐Record of Decision file.
Description: The LUCs are in place to: a) require that groundwater withdrawn from wells situated in PNYA retained areas shall not be used or made available for human consumption; b) require that PNYA retained areas shall not be used or developed for any permanent residential uses; and c) require that any construction or development of an outdoor childcare playground, within PNYA retained areas, will include placement of 2 feet of clean fill material, or other cover as approved by the PADEP, between underlying soil and the surface of the childcare playground prior to commencement of any use of the outdoor area as a playground. The LUCs apply within the boundary of Navy‐retained property of PNYA (Figure 3‐1 of the LUC Remedial Design [RD]). The remedy consists of LUCs.
This checklist may only be used and submitted with a copy of Figure 3‐1 and Figures 4‐1 through 4‐9 of the LUC RD (date cited in Part 1, Question 1) depicting LUC boundaries and key remedy components.
Checking "Yes" in the responses below indicates compliance with the LUC requirements. Any question that does not have a "Yes" response must be explained in the comments section, and affected areas must be clearly noted on the accompanying copy of the appropriate figure from the LUC RD.
The site inspection portion must include a walk of open areas, visual observation of the boundary as accessible, inspection for trespass/entry, and physical inspection of every LUC component identified in the description above. Photographs should be taken to document anything that is found to be out‐of‐compliance with the LUC RD.
The inspection team (Navy and PADEP) must review the LUC RD and the prior year's LUC inspection report before conducting the inspection. The LUC RD shall be on‐hand at the time of the inspection.
