About this file

This file contains attachments from a NAVFAC "NSWC Package 2" project, including a NAVFAC Red Zone checklist, security requirements, standard finishes, emergency exit plans, and multiple asbestos/lead testing reports from 2017-2023. The documents primarily focus on Building 77H at the Philadelphia Navy Yard.

The testing reports show asbestos was found in roof flashing materials (6-10% chrysotile) and lead was detected in multiple painted surfaces including metal parapets, roof components, I-beams, trusses and structural steel (ranging from 0.014% to 2.1% by weight). The NAVFAC Red Zone checklist details critical activities required for Beneficial Occupancy Date (BOD) including contractor, client and NAVFAC responsibilities. Security requirements specify protocols for identification badges, installation access, and handling of Unclassified Naval Nuclear Propulsion Information (U-NNPI). The NSWC standard finishes document provides detailed specifications for flooring, wall coverings, paint colors and other interior finishes. Multiple asbestos air sampling reports from 2020 show levels were below established Occupational Exposure Limits.

Balancing Report, due to outside temperature constraints, an additional Field Acceptance Testing event is required.

NAVFAC Red Zone (NRZ) Checklist/POAM

The NRZ Checklist/POAM is a tool to track the status of critical activities required for BOD to help ensure their timely completion to prevent delays with the facility acceptance and turnover.

The critical activities are organized by section according to the responsible party (i.e. Contractor, Client, and

NAVFAC)

Critical items missing from this list should be added as necessary to ensure the list is comprehensive.

Likewise, unnecessary items should be deleted.

Any critical items left off the NRZ Checklist that are later identified after initial NRZ meeting is conducted should be added immediately so their progress can be tracked.

A copy of the NRZ Checklist/POAM shall be maintained in the contract file.

PART 6 – ATTACHMENT B

NAVAL SURFACE WARFARE CENTER (NSWC) SECURITY REQUIREMENTS

1. Contractor Requirements for Identification Badges and Installation

Access

1.1 Citizenship Requirements

Work under this contract is restricted to U.S. citizens. No employee or representative of the Contractor will be admitted to the work site unless he/she furnishes satisfactory proof that he/she is a citizen of the United

States. Contractor personnel with dual citizenship of any other nation are considered foreign nationals and will not be approved for badges or authorized for admittance to the site of work.

1.2 Application for Contractor Identification Badges

The Contractor's employees or representatives who will be working inside

NSWCPD facilities or secure perimeters must obtain a Contractor's ID badge.

All required paperwork should be submitted to Contracting Officer’s

Representative (COR) by the Prime Contract’s FSO for the contract.

For Contractor employees or representatives that do not have a CONFIDENTIAL or higher security clearance, the Contractor shall provide a completed

SECNAV 5512/1 (DoN Local Population ID Card/Base Access Pass Registration

Form) for each employee or representative to the COR at least ten (10) business days prior to visit for Commander, Navy Region Mid-Atlantic

(CNRMA) vetting, review and approval. Contractor employees or representatives that possess a Common Access Card (CAC), Transportation

Worker Identification Card (TWIC), or other Federal Personal Identify

Verification (PIV) card, should identify the type of card and card number in Box 14 under the OTHER APPROVED IDENTITY SOURCE DOCUMENTS section of their SECNAV 5512/1 form to have the card enrolled for use at NSWCPD.

For Contractor employees or representatives that do have a CONFIDENTIAL or higher security clearance, the Contractor’s company or office must submit a

Defense Information System for Security (DISS) request. The Security

Management Office (SMO) code for NSWCPD is 64498.

Upon notification of approval, the Contractor employees or representatives will report to NSWCPD Security (Building 29) for issuance of an ID badge and given the appropriate access. The Contractor must bring with them (1) a

State ID/Driver’s license, (2) all forms of identification listed by the

Contractor on their individual SECNAV 5512/1 form, and (3) if already in possession, their CAC, TWIC, or other Federal PIV. The Contractor must obtain the required employee ID badges from the Government at his own expense. The Government is not responsible for any cost or lost time associated with obtaining or using ID badges.

One-Day Visitor Badges: The Contractor's employees or representatives can obtain a daily Visitor's badge from the Security desk inside NSWCPD facilities, however, a Government escort will be required at all times and

NSWC Reachback Support Package 2 Work Order Number

PART 6 – ATTACHMENT B

the badge will only be valid for the facility where the badge was issued.

The use of daily visitor's ID badge is not recommended as a Government escort must be scheduled in advance and escort's availability is limited and granted on a case-by-case basis (i.e. availability is not guaranteed).

There is a limit of three (3) days for signed visitors. Contractor employees or representatives planning to use One Day Visitor Badges to access Building 633 or Building 87 for any purpose, including pre-quotation or preproposal site visits, must submit a SECNAV 5512/1 (at least ten (10) days prior to visit) or DISS request and receive approval for admittance to the facility in advance. The Government is not responsible for any cost or lost time associated with escort availability in conjunction with the use of Visitor’s badges for the Contractor’s employees or representatives.

1.3 General Access Requirements and Restrictions

The following access requirements and restrictions apply to work at any

NSWCPD facility or secured perimeter.

a. No Contractor employee or representative will be admitted to the site of the work unless he/she has satisfactorily completed the Application for

Contractor Identification Badge process as determined and communicated directly by COR and has furnished satisfactory proof that he/she is a citizen of the United States. U.S. citizens with dual citizenship of any other nation are considered foreign nationals and will not be approved for badges or authorized for admittance to the site of work. Contractor employees or representatives will not be authorized admittance to the site of work until their application is approved by the Government.

b. The Contractor is responsible to collect and account for all identification badges issued to his/her personnel within 5 calendar days of the expiration of the contract, expiration of the badge, employee leaving the Contractor’s service or when no longer required. Collected badges must be returned by the Contractor to the COR. Failure to return NSWCPD property

(i.e. identification badges) can result in denial of future access.

c. Comply with all security regulations currently in force as determined and communicated directly by the Government Security personnel and as conveyed by the COR.

d. Employees or representatives of the Contractor, while working at

NSWCPD, must display the Government issued badge over the front of their outer clothing at all times. Contractors must carry at all times on their person one of the following forms of picture ID to be presented to Security personnel upon request while working in NSWCPD facilities: State

ID/Driver’s license, passport, CAC, DBIDS, TWIC, or other Federal PIV.

e. Roll up/garage doors may only be opened by Government personnel or

Contractors that meet the following requirements:

1. Signed a Roll up Door Access Request Form.

2. Completed NSWCPD Roll up door training.

NSWC Reachback Support Package 2 Work Order Number

PART 6 – ATTACHMENT B

3. Received brief from Security on responsibilities for Roll up door operation and control. Failure to follow roll up door security rules can result in loss of access to the site.

f. Fence gates may only be opened by Government personnel or Access

Control Personnel (ACP). The ACP or Government personnel must guard the gate during the entire time the gate is un-secured. The gate must be secured immediately following its use, unless otherwise permitted by the

Command Security Director. Coordinate gate access 48 hours in advance of requiring access through the gate.

g. Commercial vehicles (with company logo on both sides of vehicle), including cranes, that are required to enter the fence line perimeter or enter the building at any NSWCPD facility must be inspected by CNRMA Police at the Motor Vehicle Inspection Team (MVIT) station prior to each instance of entering the property. No personally owned vehicles are permitted within the fence line perimeter of any NSWCPD facility. Commercial vehicle drivers must be vetted by submission of either a SECNAV 5512/1 form or DISS request. Coordinate vehicle inspection location and procedures with the

COR. The Government is not responsible for any cost or lost time associated with vehicle inspections.

h. No Contractor or personally owned cameras are allowed inside NSWCPD facilities. Additionally, pictures by contractor-owned or carried cell phones are not allowed. If photographs are required for design or construction records, submit a written request to Security to have photographs taken by a Government Official using a Government camera.

Photographs taken by the Government will be reviewed by NSWCPD Security and

NSWCPD Public Affairs Office before release to the Contractor.

i. If a security alarm is required to be temporarily disabled for a construction activity, the Contractor must submit a completed Request to

Mask Security Alarm form to the COR at least three business days in advance of the required date. The COR will coordinate with the NSWCPD Security

Office to obtain approval for the request.

j. Use of Contractor-owned laptop computers within NSWCPD facilities requires submission of an Authorization Request for Operation of Non-DoD

Portable Electronic Devices form to the COR at least three business days in advance; NSWCPD Security shall be copied on all submissions and approvals/denials of Non-DoD Portable Electronic Device forms. The

Government is not responsible for any cost or lost time associated with authorization requests for Portable Electronic Devices.

k. Commercial and personally owned vehicle (POV) parking in Government parking lots are restricted to Government employees. Unauthorized parking in Government parking lots may result in DoN Police ticketing and/or Towing as well as denial of access to NSWCPD facilities.

1.4 General

Security Classification Guidance, when invoked in individual task orders, must be in accordance with the following:

a. Level of safeguarding required: Confidential.

NSWC Reachback Support Package 2 Work Order Number

PART 6 – ATTACHMENT B

b. Access to information and equipment: classified at the Confidential

National Security Information (C-NSI) level, when providing industrial support services within facilities that actively support the Navy Nuclear

Propulsion Program (NNPP).

c. All Contractor personnel accessing classified information or classified material, associated with the performance work relative to the resultant contract, must be United States citizens, (no dual citizens or foreign nationals) and must have and maintain at a minimum a final Confidential security clearance, at time of task order award.

d. The Contractor is responsible for completing all required Government mandated training to maintain security and network access to Government sites and IT systems, as necessary to support.

e. A DoD Contract Security Classification Specification DD Form 254 will be provided to the Contractor when the contract is classified and/or the scope of work requires the generation, distribution, contact with or access to classified information, documents, material or equipment or the contract requires classification guidance and handling procedures.

1.5 Unclassified Naval Nuclear Propulsion Information (U-NNPI)

1.5.1 Purpose

Documents (specifications, drawings, etc.) that are marked as containing

NOFORN sensitive information, must be controlled pursuant to Federal law.

The information contained therein and generated as part of the inquiry must be used only for the purpose stated in the task order, and must in no case be transmitted outside the company, (unless such transmittals comply with the detailed guidance of the contract) or to any foreign national within the company. While in use, the documents must be protected from unauthorized observation, and must be kept secure so as to preclude access by anyone not having a legitimate need to view them. The documents must not be copied unless done in conformance with the detailed guidance of the contract. All the documents must be promptly returned in their entirety, unless authorized for proper disposal or retention, following completion of the task order.

1.5.2 Specific Requirements for Protecting U-NNPI

The following requirements apply to the protection of U-NNPI:

a. Only U.S. citizens who have a Need to Know (NTK) required to execute the contract will be allowed access to U-NNPI.

b. When not in direct control of an authorized individual, U-NNPI must be secured in a locked container (e.g., file cabinet, desk, safe). Access to the container must be such that only authorized persons can access it, and compromise of the container would be obvious at sight. Containers should have no labels that indicate the contents. If removed from the site, U-NNPI must remain in the personal possession of the individual. At no time should

U-NNPI be left unsecured (e.g., in a home or automobile, or unattended in a motel room or sent with baggage).

NSWC Reachback Support Package 2 Work Order Number

PART 6 – ATTACHMENT B

c. U-NNPI documents will have the word NOFORN at the top and bottom of each page. The cover sheet will have the warning statement shown below.

Documents originated in the course of work that reproduce, expand or modify marked information must be marked and controlled in the same way as the original. Media such as video tapes, disks, etc., must be marked and controlled similar to the markings on the original information.

d. U-NNPI may not be processed on networked computers with outside access unless approved by CNO (N00N). If desired, the company may submit a proposal for processing NNPI on company computer systems. Personally owned computing systems, such as personal computers, laptops, personal digital assistants, and other portable electronic devices are not authorized for processing NNPI. Exceptions require the specific approval of the cognizant

DAA and CNO (N00N).

e. U-NNPI may be faxed within the continental United States and Hawaii provided there is an authorized individual waiting to receive the document and properly control it. U-NNPI may not be faxed to facilities outside the continental United States, including military installations, unless encrypted by means approved by CNO (N00N).

f. U-NNPI may be sent within the continental United States and Hawaii via first class mail in a single opaque envelope that has no markings indicating the nature of the contents.

g. Documents containing U-NNPI must be disposed of as classified material.

h. Report any attempts to elicit U-NNPI by unauthorized persons to the appropriate security personnel.

i. Report any compromises of U-NNPI to the appropriate security personnel.

This includes intentional or unintentional public release via such methods as theft, improper disposal (e.g., material not shredded, disks lost), placement on Web site, transmission via email, or violation of the information system containing U-NNPI.

NOFORN: This document is subject to special export controls and each transmittal to foreign governments or foreign nationals may be made only with the prior approval of the Naval Sea Systems Command.

AMA Job #: 18339

Re: Hazardous Material Investigation for the “NSWC Building 77H Roof Repair Design” project at the Philadelphia Navy Yard in Philadelphia, Pennsylvania 19112.

Dear Mr. Chang:

On June 15th, 2018, representatives from Aerosol Monitoring & Analysis, Inc. (AMA) were on-site at Building #77H of the Philadelphia Navy Yard, located in Philadelphia, PA. AMA was onsite to perform a hazardous materials investigation for the “NSWC Building 77H Roof Repair Design” project. The purpose of the work was to identify asbestos-containing materials (ACM) and components finished with lead containing paint or surface coatings (LCP) that may be disturbed by the proposed renovations. AMA conducted bulk material sampling, and on-site evaluations to report our findings. In addition, AMA utilized an existing hazardous materials report, generated by AMA in January 2015 for the “DDG-51 Cut-Out Roof and Gutter System” project at Building 77H.

AMA representatives Mr. Douglas Ferry, Mr. Ron Stallard and Mr. Pat Dincher performed the onsite investigation for the “NSWC Building 77H Roof Repair Design” project at Building #77H at the Philadelphia Navy Yard, in Philadelphia, Pennsylvania:

Please refer to Appendix C for copies of the certifications and licenses for Mr. Ferry, Mr. Stallard and Mr. Dincher. Please note that Mr. Ferry is an employee of Briggs Associates, and was sub-contracted by AMA to perform the asbestos bulk sampling, since he is a City of Philadelphia Asbestos Investigator.

ACM INVESTIGATION

AMA's scope of work included the visual evaluation, quantification, sampling, testing, and laboratory analysis of accessible suspect ACM associated with the “NSWC Building 77H Roof Repair Design” project at Building #77H.

“NSWC Building 77H Roof Repair Design” Project

AMA, Inc. 3

Note:

1. The Roof Flashing membrane tar/ parapet wall tar from the 2014 report and the roof flashing from the 2018 investigation are one in the same and are homogeneous on east and west side lower roofs.

2. The east elevation location for gutter system improvement project was not accessible to conduct an investigation per on-site Navy Yard personnel at the time of inspection.

REGULATORY COMPLIANCE FOR ACM

The identified asbestos containing roof flashing associated with the Building 77H “NSWC Building 77H Roof Repair Design” project, at the Philadelphia Navy Yard, is regulated and categorized by the Occupational Safety and Health Administration (OSHA) 29 CFR 1926.1101 as Class II work. Disturbance and/or removal of the asbestos containing roof flashing must be performed in accordance with the requirements set forth in 29 CFR 1926.1101 for Class II work as well as any specifications generated for the project.

A regulated asbestos-containing material (RACM) is defined by the EPA’s National Emissions Standards for Hazardous Air Pollutants (NESHAP), Asbestos Regulations (40 CFR 61, Subpart M), as follows:

Regulated asbestos-containing material (RACM) means (a) Friable asbestos material, (b) Category I nonfriable ACM that has become friable, (c) Category I non-friable ACM that will be or has been subjected to sanding, grinding, cutting, or abrading, or (d) Category II non-friable ACM that has a high probability of becoming or has become crumbled, pulverized, or reduced to powder by the forces expected to act on the material in the course of demolition or renovation operations regulated by this subpart. The identified ACM associated with the Building 77H “Roof Replacement Project” at the Naval Support Activity in Philadelphia is categorized as Category I non-friable ACM.

By this definition the identified non-friable asbestos containing roof flashing must be abated prior to demolition or renovation, if these activities will cause these materials to become disturbed, crumbled, pulverized, or reduced to powder.

In addition to the Federal Regulations discussed above, Commonwealth of Pennsylvania (Asbestos Occupations Accreditation and Certification Act, Act of 1990, P.L. 805, No. 194) and City of Philadelphia (Asbestos Control Regulation of the Board of Health, Title 6 Health Code, of the Philadelphia Code 6-600, Asbestos Projects, adopted June 26, 1986) would be the primary regulations impacting the work, must be adhered to if the identified ACM associated with the Café HVAC Replacement Project of Building #3 at the Naval Support Activity, will be impacted.

It should be noted that additional materials maybe located throughout Building 77H that were not investigated as part of the “NSWC Building 77H Roof Repair Design” project. If additional suspect materials are observed during renovation activities, they should be by sampled an accredited asbestos inspector, who is a Philadelphia asbestos Investigator and Commonwealth of Pennsylvania certified asbestos Inspector, and submitted for laboratory analysis or treated as an

ACM.

LEAD PAINT INVESTIGATION

The paint chip samples were collected in a manner conforming to the procedures developed by the Department of Housing and Urban Development (HUD) in the HUD Guidelines Appendix 13.2 Part 3 “Paint Sample Collection.” All construction related work involving paint, which contains a detectable amount of lead, is regulated by the Occupational Safety and Health Administration (OSHA), “Lead in Construction Standard,” (29 CFR1926.62). The samples were collected by scoring the surface with a razor blade and then placing the paint chips in sterilized “whirl-pak” bags. After each sample was collected, the sample was assigned a unique identifier, which was recorded on the bags and the bulk sampling survey sheet.

During the field investigation, a total of five (5) lead paint chips were collected, and submitted to AMA Analytical Services, Inc. for analysis by Atomic Absorption Spectroscopy (AAS) following the EPA method 600/R-93/200 (M)-7420. AMA Analytical Inc. analyzed the paint chip for lead content by atomic absorption spectroscopy (AAS) in accordance with EPA method SW846- 3050A-7420. AMA Analytical Inc. is accredited by the American Industrial Hygiene Association (AIHA) for lead bulk analysis. A LCP by bulk paint chip sample is any dried paint film which contains in excess of 0.009% lead by weight by laboratory analysis, using Atomic Absorption Spectroscopy (AAS) following the EPA method 600/R-93/200 (M)-7420. This level has been established by the Consumer Product Safety Commission (CPSC) in the Consumer Product Safety Improvement Act of 2008 (CPSIA) (Public Law 110-314).

The results of the laboratory analysis determined that four (4) of the five (5) paint chip samples collected on June 15th, 2018 for the Building 77H “NSWC Building 77H Roof Repair Design” project, at the Philadelphia Navy Yard in Philadelphia contained a measurable amount of lead. The following components were determined to contain a measurable amount of lead by previous documentation and the current investigation by laboratory analysis:

Red Metal Parapet/Gutter Wall (December 2014 report)

Red Metal Roof (June 2018 report) White Metal I-Beam (June 2018

Report)

White Metal Truss (June 2018 Report) White Metal Structural Steel (June 2018

Report)

REGULATORY COMPLIANCE FOR LEAD

For projects, which will disturb lead containing paint, the component must be handled in accordance with the requirements established by the EPA, OSHA, the Commonwealth of Pennsylvania, and the City of Philadelphia.

If a LCP will be disposed of during renovation/demolition activities, the waste stream must be tested, using the Toxic Characteristic Leachate Procedure (TCLP) analysis for lead, to determine the disposal requirements, following the requirements of the Resource Conservation and Recovery Act (RCRA) and any other applicable federal, Commonwealth and local laws and regulations. Contractors must be made aware of the existence of lead containing paint, surface coating, or any component containing lead in detectable amounts, so their workers can be adequately protected.

AMA, Inc. 5

It is also required that contractors be made aware of the existence of LCP, so their workers can be adequately protected. The OSHA does not recognize threshold levels of lead; therefore the regulations established in the OSHA “Lead in Construction Standard” (29 CFR 1926.62) must be adhered to during demolition and renovation of components containing lead in detectable amounts.

The Occupational Safety and Health Administration (OSHA) does not recognize threshold levels of lead; therefore the regulations established in the OSHA’s “Lead in Construction Standard” (29 CFR 1926.62), and any Commonwealth of Pennsylvania, and the City of Philadelphia laws/regulations must be adhered to during the demolition and renovation of all painted components or surface coatings.
