SECTION 01 00 00

GENERAL REQUIREMENTS

PART 1. GENERAL

DEFINITION OF INSTALLATION

1.1.1 Installation will be defined as the property and facilities located within the jurisdiction of the particular base, post, air station, or compound where work is being accomplished. Work performed under this contract shall be bound by rules, laws, and regulations of each particular installation as well as local, state, federal, and Air Force regulations. This contract covers Air Force construction efforts at March Air Reserve Base (ARB) to include all real property assigned to the 452nd Air Mobility Wing (AMW) and its tenants.

1.2 PROJECT DESCRIPTION

1.2.1 The Contractor shall furnish all management, supervision, labor, materials, equipment, and incidentals required for a broad range of maintenance, repair, and minor construction work on various real property facilities at installations covered under this contract, including design environmental and engineering services incidental to construction. The Contracting Officer (CO) will conduct negotiations with the Contractor and issue individual Task Orders (TO) for maintenance, repair and minor construction projects identified by the Base Civil Engineer (BCE) as part of this Simplified Acquisition of Base Engineering Requirements (SABER) program. Individual TO projects will vary in size, with the majority expected to be less than $750,000. The work to be performed will require the use of multiple trades including, but not limited to trades such as carpentry, plumbing, electrical, mechanical, painting, pipe fitting, sheet metal, welding, roofing, site work, site utilities, excavation, concrete, masonry, pavement repair, asbestos abatement, lead paint removal, security hardware installation, environmental protection specialties, hazardous waste and spill response and demolition.

CONTRACT DOCUMENTS, REFERENCE STANDARDS, AND PUBLICATIONS

1.3.1 The following documents are part of the solicitation and resultant contract. The Contractor shall utilize the referenced documents in the accomplishment of task prescribed in TOs. The standards and publications listed in each section of the specifications form part of these specifications to the extent referenced. The Contractor shall conform to the provisions of the most recent issue of the all standards or publications.

1.3.1.1 SABER Master Specifications

a. Unified Facilities Guide Specifications (UFGS). UFGS standard specifications can be obtained from the Whole Building Design Guide website: (http://www.wbdg.org/ffc/DOD/unified- facilities-guide-specifications-ufgs). The Unified Facilities Guide Specifications (UFGS) and the following documents are hereby incorporated into the solicitation and any resultant contract.

b. These SABER Master Specifications are numbered and organized in accordance with the Construction Specification Institute’s (CSI) Master Format. All specifications are filed in Division 2 through 48 per CSI guidelines. The specifications are taken from the Unified Facilities Guide Specifications (UFGS).

1.3.1.2 Unit Price Book

a. The Unit Price Book (UPB) is described in Section 01 04 00. The UPB shall be furnished with each of the awarded TOs Contractors.

1.3.1.3 Unified Facilities Criteria (UFC)

a. The UFC shall be used as the standard building code for all construction under this contract. The UFC website is http://www.wbdg.org/ffc/DOD/unified-facilities-criteria-ufc. Any and all changes to the UFC will immediately become requirements of this contract. The UFC references the International Building Code (IBC) as the basic requirement. However, the current adopted version of the IBC shall be used as the minimum standard. The UFC modifies those basic requirements in UFC 01-200-01.

1.3.1.4 Building Codes

a. As a minimum, the following Building Codes shall be used for all construction under this contract. The most current editions and supplements of these standards shall apply. The contractor shall have a copy of each of these documents available for use during the term of this contract. If there is a conflict between these codes and regulations, the most stringent requirements apply at all times.

1.3.1.5 Installation Design Standards

1.3.1.6 The most current and latest Facilities Excellence Plan and Standards for March ARB shall be adhered to on all construction projects. Any possible deviations from these standards shall be brought to the Contracting Officer before implementation. March ARB Environmental Guide Specifications 01 57 19 Provides Federal, State, DoD and Air Force governing laws, regulations and codes as well as specific requirements to be followed at March ARB.

EXECUTION

1.4.1 Pre-Performance Construction Meeting

1.4.1.1 Before work begins on this contract, the Contracting Officer will arrange for a meeting with the Contractor to discuss the contract in general, including administrative matters, performance requirements, submittal procedures, approval and payment schedule, quality control expectations, Request for Proposal (RFP)/Fair-Opportunity Proposal Request(FOPR) and task order procedures, traffic control, construction access requirements, as-built criteria, performance requirements, security procedures, accident prevention, safety, and fire prevention briefings. The Contracting Officer may issue a letter to the Contractor in-lieu of holding a face-to-face Pre-Performance Construction Meeting for individual task orders.

1.4.2 Business Telephone

1.4.2.1 At the beginning of this contract, the Contractor shall provide the applicable Contracting Officers a contractor personnel telephone number, e-mail, and website for regular working hours. The Contractor shall also provide after hours (emergency) telephone numbers for Contractor’s Program Manager and Project Manager(s) as a minimum. The Contractor shall provide the Contracting Officer with an updated phone list whenever changes in personnel or phone numbers occur. The Contractor is required to provide a means of mobile communications (i.e., cellular phone and/or pager) for Contractor’s Program Manager, Project Manager(s), Superintendent, CQCM, and their respective Alternates for the life of the contract. Communications equipment, to include but not limited to landline telephones and land mobile radios, will require special coordination and clearance with installation communications authorities.

1.4.3 Work Hours

1.4.3.1 The Contractor shall complete the work of this project between the hours of 7:00 a.m. and 4:30 p.m. Pacific Standard Time (PST), excluding Saturdays, Sundays, and Federal Holidays. Access to work sites may be restricted to these hours and days. All other times shall be considered non-standard hours. Unless required by the Contracting Officer in writing or Statement of Objectives (SOO), the Government will not pay additional costs for non-standard hours. The Contractor may not work during non-standard hours unless the request and justification is approved by the Contracting Officer. The Contractor must submit a request and justification for working non-standard hours to the Contracting Officer at least three (3) working days prior to

Work that requires inspection during accomplishment or that prevents inspection of other work after accomplishment must be coordinated with and approved in advance by the Contracting Officer. Inclement weather, operational delays, and security related delays might affect the contractor’s work periods. The Contractor must make allowances for these events, as resulting lost time will not be reimbursable.

1.4.4 Federal Holidays

1.4.4.1 The Government only recognizes the following legal holidays established by federal statue:

a. New Year's Day, 1 January

b. Martin Luther King Day, third Monday in January

c. President’s Day, third Monday in February

d. Memorial Day, last Monday in May

e. Independence Day, 4 July

f. Labor Day, first Monday in September

g. Columbus Day, second Monday in October

h. Veteran's Day, 11 November

i. Thanksgiving Day, fourth Thursday in November

j. Christmas Day, 25 December

1.4.4.2 Any of the legal holidays falling on Saturday will be observed on the preceding Friday; legal holidays falling on Sunday will be observed on the following Monday. In addition, the Government may dictate the work day before or the work day after an observed holiday as a “Family Day.” and/or liberal leave day.

1.4.4.3 The Contractor should not perform work on observed legal holidays or Family Days and/or liberal leave days unless authorized by the Contracting Officer. In the event work is authorized on observed legal holidays, the Contractor shall pay all applicable overtime and/or holiday pay rates required by law.

1.4.5 Work Interruptions and Delays

1.4.5.2 The Contractor may be required to temporarily stop work for operational requirements, special events, installation exercises, or while Distinguished Visitor (DV) familiarization visits/tours are conducted. The Contractor must make allowances for these events and resulting lost time will not be reimbursable. Notification to the Contractor shall be provided by the applicable Contracting Officer.

1.4.6 Construction Wage Rate Requirements Statute

1.4.6.1 The most current Construction Wage Rate Requirements Statute wage determination will be incorporated into the contract at the time of award. This wage determination will be effective for all task orders issued during the base contract period. Concurrent with the exercise of each option, the current wage determination will be incorporated and shall be effective for all task orders issued during the option.

If a Fair Opportunity Proposal Request (FOPR) is issued prior to the exercise of an option, but not awarded until after the option is exercised, the Contractor will be given the opportunity to update its proposal to incorporate any changes caused by the update to the wage determination.

1.4.7 PERFORMANCE AND PAYMENT BONDS – APPLICABLE TO INDIVIUAL TOs

1.4.7.1 Contractors shall furnish Performance and Payment Bonds (Standard Form 25/25A) with good and sufficient surety or sureties, acceptable to the Government on all TOs regardless of dollar value.

The penal sums of the bonds, as shown below, shall be provided to the Contracting Officer for their acceptance.

a. Performance Bond: Unless the Contracting Officer determines that a lesser amount is adequate for the protection of the Government, the penal sum of the performance bonds (Standard Form 25) shall equal one hundred percent (100%) of the contract price for each

b. Payment Bond:

(1) Shall equal 100% of the contract price for each TO

(2) One of the following is required:

• A payment bond

• An irrevocable letter of credit (ILC)

• A tripartite escrow agreement. The prime contractor establishes an escrow account in a federally insured financial institution and enters into a tripartite escrow agreement with the financial institution, an escrow agent, and all of the suppliers of labor and material. The escrow agreement shall establish the terms of payment under the contractor’s escrow account, and the escrow agent distributes the payments in accordance with the agreement, or triggers the disputes resolution procedures if required

• Certificates of deposit. The contractor deposits certificates of deposit from a federally insured financial institution with the Contracting Officer, in an acceptable form, executable by the Contracting Officer

• A deposit of the types of security listed in FAR 28.204-1 and 28.204-2

c. Bonds are due within 10 days of the receipt of the TO.

1.4.8 Safety Requirements

1.4.8.1 See Section 01 35 29

1.4.9 Fire Protection

1.4.9.1 The Contractor shall be responsible for furnishing adequate and proper fire protection for all phases of the contract work in accordance with the latest and most current UFCs and National Fire Protection Agency (NFPA) standards.

1.4.10 General Environmental Requirements.

1.4.10.1 Contractor shall provide an Environmental Protection Plan consistent with the requirements of the March Environmental Guide Specification. The plan will serve as an over-riding plan to be followed during the course of the project for all work covered by the contract.

1.4.10.2 All TOs shall be required to supplement the EPP with TO specific information.

1.4.10.3 Contractor shall complete the Proponent information on AF from 813 March ARB Template, or, provide supplemental information with the original supplied with the request for proposal and submit the information with the TO proposal. Contractor shall provide

Attachment 9 Page 12 of 563 supplemental information in Section 2 of the second page for each TO to describe environmental concerns from the project, mitigation measures that may be taken to minimize adverse impacts and permits that may be applied in the course of the project. The government will complete the form AF 813 as required and provide contractor a copy of the signed AF 813 approving the document as NEPA complete. The contractor shall not perform work that is outside the work described on the AF 813 and shall not perform work without having obtained a copy of the signed AF 813. This signed form shall be kept in the TO files for each project.

1.4.10.4 Contractor shall adjust UPG to accommodate any March ARB peculiar environmental rules or requirements such as necessary best management practices to meet the MS4 General Storm Water permit, permit application and fees or best available control technology requirements of the South Coast Air Quality Management District.

1.4.10.5 Before any ground may be disturbed under any TO awarded, a March ARB Storm Water Control Certificate must be completed by the contractor; signed by a State of California qualified person or Government professional engineer, if a SWPPP is not required; and submitted and attached to the March form 103 Base Work/Dig Permit.

1.4.10.6 Contractor must inspect all work and ensure that the requirements of the March ARB Environmental Guide Specification, Federal and State requirements referenced in the guide specification are being met to include considerations for permit applications, notices and fees related to the work of each task order. All fees for permits etc.

will be paid by the contractor after receiving the signature of the March ARB Government responsible official on the permit applications or notices.

1.4.10.7 Contractor must make the following environmental submittals in advance of receiving the first TO:

• Environmental Protection Plan (EPP) The Contractor shall provide their EPP for approval to 452 MSG/CEV, 10 days prior to the start of any activities on March ARB. An EPP template will be provided to the contractor and must be followed. EPP shall include:

o Dirt and Dust Control Plan; i o Employee Environmental Training Records;

o Environmental Manager Qualifications;

o Solid Waste Management Plan;

o ECATTS Certificate Of Completion;

o Erosion and Sediment Control Inspector Qualification

Solid Waste Management Plan G [, [CEV_____]] o

Contractor must make the following environmental submittals:

• Monthly Hazardous Material (HAZMAT) usage totals (paragraph

1.08.C).

• HAZMAT Business Plan or HAZMAT Disclaimer, (paragraph

1.08.D).

1.4.10.8 Conformance with the Environmental Management System

Contractor shall be required to participate in the installation's Environmental Management System (EMS). Work may include participation in meetings, cross functional teams and other activities required to ensure that work by the contractor is fully integrated into the EMS.

Perform work in a manner that conforms to objectives and targets of the environmental programs and operational controls identified by the EMS. Support Government personnel when environmental compliance and EMS audits are conducted by escorting auditors at the Project site, answering questions, and providing proof of records being maintained.

Provide monitoring and measurement information as necessary to address environmental performance relative to environmental, energy, and transportation management goals. In the event an EMS nonconformance or environmental noncompliance associated with the contracted services, tasks, or actions occurs, take corrective and preventative actions. In addition, employees must be aware of their roles and responsibilities under the installation EMS and of how these EMS roles and responsibilities affect work performed under the contract. Coordinate with the installation's EMS coordinator to identify training needs associated with environmental aspects and the EMS, and arrange training or take other action to meet these needs.

Provide training documentation to the Contracting Officer.

The Installation Environmental Office (CEV) will retain associated environmental compliance records. Make EMS Awareness training completion certificates available to Government auditors during EMS audits and include the certificates in the Employee Training Records.

1.4.10.9 Environmental Coordination: The 452nd Mission Support Group, Base Civil Engineer, Environmental Flight (/CEV) is the single point of contact for coordination with all environmental regulatory agencies.

Prior to coordinating with any environmental regulatory agency, the contractor shall obtain approval from CEV. The Contractor shall provide copies of any regulatory agency notification, report, consultation, permit, and/or regulatory document to CEV.

• The Contractor shall comply with all permit conditions and consultation requirements.

• The Contractor shall provide all required testing analysis and monitoring.

1.5.27 Notices of Violations (NOV):

The Contractor shall be liable for any Notices of Violation (NOV), enforcement action, fine, penalty, and/or corrective action imposed by federal, state, or local environmental regulatory agencies for activities under the Contractor’s control. The Contractor shall provide verbal notification to 452 MSG/CEV and the Contracting Officer within 24-hours of receiving an NOV followed by written notification within three (3) working days.

1.4.10 Fair Opportunity Proposal Request (FOPR)

1.4.10.1 For each project or solicitation, the Contractor will be furnished with one (1) copy of the Government’s Statement of Objectives (SOO) from the Contracting Officer or his/her designated Contracting Specialist. The Contractor may be provided with one (1) set of drawings and specifications as required or applicable. The level of the design provided to the Contractor may be a 35% design (basic concept) which requires the Contractor to verify actual conditions and make any necessary corrections. Although the Contractor is given a design package, it is still the Contractor’s responsibility to verify/validate existing site conditions prior to submitting their proposal package to the Government. The Contractor may reproduce the drawings and specifications at the Contractor’s own expense if additional copies are needed. The Contractor shall check all drawings and specifications immediately upon receipt for discrepancies and notify the Contracting Officer or his/her designated representative immediately of any and all discrepancies found in the form of a Request for Information (RFI). The RFI shall be forwarded to the Contracting Officer for review and in-turn forwarded to the assigned SABER Project Manager(s) for review, clarification and response.

Enlarged plans and details shall govern where the same work is shown at smaller scales. The Contractor shall compare all drawings and verify the installation before laying out the work and shall be responsible for any errors which might have been avoided thereby.

Where drawings are not provided as part of the FOPR, the Contractor shall provide the field investigation, historical record research, design including construction drawings, engineering and constructability review necessary to ensure the drawings are complete.

1.4.10.2 The design and engineering required for this contract is at the level normally expected of a general construction contractor and considered incidental to the accomplishment of the scope of work provided by the Government. Examples of services required from the contractor include: sizing and selection of electrical and mechanical equipment and systems; sizing of electrical circuits (i.e., wiring and cable sizing; to include pole mount and pad mount transformers sizing), electrical devices, heating and ventilating air ducts, fluid piping systems and light structural framing members; lighting layout;

fire detection systems; surveying; computer aided drafting, etc. If the design requires the services of a registered architect or professional engineer, it should be considered outside the parameters of the SABER program and the Contractor shall notify the Contracting Officer immediately.

1.4.11 Project Site Visit

1.4.11.1 After the release of an FOPR, the Government and the Contractor will schedule and conduct a pre-proposal site visit for project.

Discussions held during the site visit may include, but are not limited to: scope of work, method of construction, sequence of operations, progress schedule, means of access to project site, delivery and storage of materials and equipment, work restrictions, coordination requirements, project goals, liquidated damages and potential difficulties/problems. The Contractor shall email detailed site visit minutes to the Contracting Officer within one (1) business day following the day of the site visit. The Contracting Officer or designated Contracting Specialist shall provide consolidated site visit minutes to all Contractors and the Civil Engineer Squadron (CES) SABER Project Manager(s) within two (2) business days following the site visit. The Contractor shall comply with the requirements of the clause at FAR 52.236-3, Site Investigation and Conditions Affecting the Work.

1.4.11.2 As part of meeting the requirements of this clause, the Contractor shall research all historical drawings related to the project site or facility. Historical records and drawings (if they are available) are located in the 452nd Civil Engineer, Bldg. 2403.

1.4.11.3 Any questions asked during the site visit or identified after the site visit should be submitted as a Request for Information (RFI) to the Contracting Officer and designated Contract Specialist within seven (7) calendar days after the site visit.

1.4.12 On-Site Conditions

1.4.12.1 Drawings may not be available or provided. Drawings showing the location of equipment, piping, ducts and conduit, are diagrammatic and may not show every detail required. In addition, site conditions will not always permit installation in the locations shown on the concept drawings. Drawings showing equipment, piping, ducts, conduit, etc. to be removed, altered, or installed may require deviation from the configuration of the demolition or installation drawings due to existence of conflicting ducts, conduits, hangers, light fixtures, structural items, and temporary walls, etc. All such minor details of work which are not shown on the drawings, as well as such items not specifically mentioned in the specifications, SECTION 01 00 00 - Page 9

Attachment 9 Page 16 of 563 but which are essential and necessary for the completion of the work, and to make all systems or equipment operational, shall be considered as incidental and shall be included as part of the work. When this situation occurs, the final placement of permanently installed items shall be subject to approval by the Contracting Officer. The Contractor shall be responsible for inspecting to his satisfaction all areas/items of possible conflict. Failure to verify the dimensions and locations will be at the contractor's risk and shall not relieve the Contractor from accomplishing the work required by the task order.

1.4.13 Project Proposal

1.4.13.1 For every Fair Opportunity Proposal Request (FOPR) associated with a new task order, the Contractor shall provide a written proposal describing the Contractor’s approach to the proposed project work described in the Government’s Statement of Objectives (SOO) and project drawings, if any. The proposal shall include at a minimum: a Cover Letter, a Statement of Work narrative describing their approach to the proposed project work as described in the Government’s Statement of Objectives (SOO) to include all major components of the project; a detailed cost estimate for all work to be performed and all major components of the project; an AF Form 66, Schedule of Material Submittals; a detailed project schedule in Microsoft Project, or equivalent, that includes all major components of the project, their associated costs and percentage of effort; an AF Form 3065 detailing the major components and the associated percentage of the construction effort; and any other information as needed to demonstrate a complete and thorough understanding of construction effort. The Contractor shall submit the proposal within 14 calendar days of the site visit. If the requirement is determined to be a quick response requirement by the Contracting Officer, the Contractor shall submit a Task Order Proposal to fulfill the requirement within a maximum of five (5) calendar days from written notification.

a. Cover Page. The cover page or pages shall include project title, total project cost, list of assumptions, and list of requirements, performance period, material lead times, and any special considerations such as phasing of construction. The contractor’s proposals shall be complete and concise.

b. Statement of Work (SOW). The Contractor shall provide, as part of the proposal, a SOW. The SOW shall provide a written narrative describing the Contractor’s approach and shall document the Contractor’s basic design solution to the subject project. The Contractor shall not simply re-state the goals of the Government Statement of Objectives (SOO), but provide sufficient information to demonstrate to the Government a complete and thorough understanding of the requirement and all applicable codes and regulations.

c. Design Documentation. Design incidental to accomplishing the required tasks outlined in each task order project may be required. The extent of these designs will depend upon the complexity of each task order project. Under the scope of this contract, the complexity will not require the services of a registered architect or engineer. However, the Contractor shall provide sufficient design documentation to substantiate the proposed approach for the task.

Design documentation shall provide enough detail to verify line item quantities in the cost proposal are accurate and enough detail to clearly convey to the Government what the Government will be receiving. All designs shall clearly illustrate compliance with local, state, and federal building and construction codes. After the site validation visit, the Contractor shall begin preparation of design documentation that clearly illustrates the proposed design solution, quantities, dimensions, materials etc. This documentation may include any or all of the following, but is not limited to the following:

(1) Drawings. When required, design drawings submitted by the

Contractor shall show the basic layout and planning of work. Shop drawings shall show in detail the proposed fabrication and assembly of structural elements and/or the installation (i.e., form fit, and attachment details) of materials or equipment.

Drawings must have sufficient detail to enable both the Contractor and the Government to understand the work to be accomplished.

i. For the purpose of this requirement, the term drawings includes actual construction drawings, shop drawings, fabrication drawings, erection drawings, diagrams, layouts, schematics, descriptive literature, illustrations, room finish schedules, lighting/panel schedules, lighting level analysis plans, load/distribution schedules/calculations, performance and test data, and similar materials furnished by the Contractor to explain in detail specific portions as may be required by an individual task order.

The Government may indicate minimum drawings that are necessary for each individual task order project. Typical types of drawings required on task orders include the following: Title/Location/Legend/Index Sheets, Site Plans, Grading/Landscaping Plans, Underground Utility Plan and Profiles, Demolition Floor Plans, New Work Floor Plans, Wall Sections, Building Section, Finish Schedules, Window and Door Schedules, Mechanical Plans and Equipment Schedules, Plumbing Plans and HVAC Riser Diagrams, Electrical Plans and Wiring Diagrams, Electrical Equipment and Panel Schedules, Lighting Plans and Schedules, Communications Plans, Fire Protection Plans, Structural Plans, Roofing Plans, Wall and Roof Sections, Reflected Ceiling Plans, Elevations (Interior and Exterior), and Associated details.

(2) Design Calculations. The Contractor shall provide, as part of the proposal, design calculations to substantiate appropriate equipment or material selection/sizing, component assembly, proposed layout and sizing of utilities and structural elements (i.e. HVAC Loads, Lighting, Platform Supports, etc.). The Contractor shall supply the following calculations per each task order project, as applicable:

i. Mechanical: HVAC load analysis and unit sizing, pipe sizing and duct sizing.

ii. Electrical: Electrical system capacity, conductor, conduit, protective devices and other equipment sizing.

iii. Structural: Structural system and foundation sizing.

iv. Pavement/Site Work: Area run-off quantities, drainage capacities and grading slopes.

v. Lighting: Lighting level analysis and lumen/foot-candle levels for each room or area.

vi. Energy: Provide energy savings and Return on Investment (ROI).

vii. Environmental: Provide an Erosion and Sediment Control plan to include all calculations required to show the total area disturbed, before and after flow rates and velocities IAW the requirements of the Stormwater Control Certificate or complete a SWPPP if required and submit online in the State Water Boards online system, STORM.

d. Cost Estimates

(1) All task orders shall be estimated, negotiated, and awarded based upon prices in the Unit Price Book (UPB, see Section 01 04 00).

The cost estimate portion of the Contractor’s proposals shall be prepared and produced using the cost estimating software described in Cost Estimating Software Requirements (Section 01 04 00 paragraph 1.1). This applies to all work done on SABER task orders, even if work is done by subcontractors.

(2) Items not in the UPB, known as Non Priced Items (NPI), may be proposed in accordance with the policy outlined below. The cost estimate portion of the Contractor’s proposals shall be in CSI format and shall be prepared and produced using the cost estimating software described in Unit Price Book and Software Requirements (UPB, see Section 01 04 00). Cost estimates must be logical, demonstrating a reasonable approach in construction methodology in both line items and quantities proposed. The elements of the cost estimate should correlate to the construction elements identified in the Statement of Work. Only authorized cost adjustment factors identified in Section 01 04 00 and included in the UPB shall be utilized to adjust line item costs. The Contractor shall not utilize any other cost adjustment factors.

(3) The use of an NPI should be kept to a minimum; use will be determined on a case-by-case basis by the Contracting Officer and SABER Management. For negotiating and determining the price reasonableness for the NPI, the Contractor will submit at least three (3) quotes from suppliers with their proposal for review.

The Government (assigned SABER Project Managers or SABER Management) will then select one of the suppliers from which the Contractor will be authorized to purchase the NPI. The Contractor and the Government will negotiate the labor hours required to install the NPI and any other appropriate mark-ups and the fixed co- efficient. If three (3) suppliers cannot be found, the Contractor shall submit at least one invoice with their proposal.

If the NPI has a commercially available price list, the Contractor shall submit that with the proposal. The Contracting Officer will conduct market research to determine price reasonableness. Once price reasonableness has been determined, the Contractor and the Government (to include SABER Project Managers) will negotiate the labor hours to install the NPI and any other appropriate mark-ups and the fixed co-efficient. If price reasonableness cannot be determined and the material cost is significant, the Contractor will have to break down each unit of cost the Contractor will pay for the NPI to facilitate the price reasonableness determination. If the NPI is a custom made item, the manufacturer will have to submit their itemized costs.

e. Schedule of Material Submittals

(1) The Contractor shall prepare and provide as part of the proposal package an AF Form 66, Schedule of Material Submittals, or equivalent. The AF Form 66 shall include all reports, construction materials, and documentation that have a material effect on the construction effort including, but not limited to:

large purchase items; long-lead items; required reports; and as-built drawings. Submittal requirements are identified in specification Section 01 33 00.

f. Construction Schedule

(1) The Contractor shall submit the construction schedule in two (2) formats. In accordance with FAR 36.515 and the clause at FAR 52.236-15, a progress schedule (construction schedule) is required for task order projects exceeding the simplified acquisition threshold and with a performance period greater than 60 days or more unless the Contracting Officer requests otherwise. The progress schedule shall be submitted on an AF Form 3064, Progress Schedule, and completed in accordance with the instructions on the reverse side of the form, or as directed by the Contracting Officer. In addition to the progress schedule, the Contractor shall submit a critical path Gantt chart schedule in Microsoft Project or an equivalent format, with milestones, for all projects with a performance period of 90 days or more unless the Contracting Officer requests otherwise. After task order award, the Contractor shall provide bi-weekly construction updates on an AF Form 3065, Progress Report.

(2) The construction schedule shall identify all major tasks of construction effort, their associated cost, and associated percentage of the work effort. The construction schedule should demonstrate a logical progression of the work effort from award to close-out.

1.5 TASK ORDER SELECTION PROCEDURES

1.5.1 The Government anticipates awarding one (1) SABER IDIQ contract. Task orders issued under the contract award are subject to the requirements of Federal Acquisition Regulation (FAR) 16.505, The contractors will be required to submit proposals for evaluation on every task order.

1.5.2 The selection for task order award will either be based on Lowest Price

Technically Acceptable (LPTA) or Best Value (BV) at the discretion of the Contracting Officer with CONCURRENCE of the 452nd Civil Engineer. Under LPTA, task order awards will be made to the lowest priced proposal determined technically acceptable. Proposals will be determined technical acceptable when they demonstrate a complete understanding of the task order requirement based upon a review of each of the submitted documents.

Inconsistencies and/or a lack of sufficient detail may cause task order proposals to be determined technically unacceptable. Under BV, task order awards will be made to the task order proposal which is determined to be the best value to the Government considering price and other factor. The factors used in the best value determination will be identified on the FOPR. The following factors may be considered when making a decision in the selection and may include other factors the Contracting Officer determines relevant or in the best interest of the government in selecting an awardee. All factors are considered equal, except price, with no order of precedence. Price will be considered slightly less important than all other factors. The contracting officer shall exercise broad discretion in selecting the Contractor.

1.6 TASK ORDER FUNDING

1.6.1 Proposals may be requested and processed up to the point of award, in advance of funding. Proposals processed up to award may remain on hold, pending funding, for a period of one year, or until the exercise of the next option period. It is the government’s intent to award a task order for each proposal processed up to the point of award; however, due to changes in the construction program, congressional budget changes or world events, some projects may be canceled. No compensation for cancelled projects will be granted to the contractor.
