About this file
This document is a Certificate of Compliance with the Buy American Act for a Utility Energy Services Contract (UESC) solicitation (W912DY-24-R-0047) issued by the U.S. Army Corps of Engineers (USACE), Huntsville Center.
The certificate serves to confirm that the prime contractor, (UTILITY NAME), and its subcontractors will only use products, materials, and supplies that are compliant with the Buy American Act, unless a specific waiver has been granted. It outlines the criteria for determining BAA compliance, including requirements for commercial off-the-shelf (COTS) items and domestic component cost thresholds. The contractor acknowledges that any non-compliant items used without a waiver will require corrective action. The certificate must be signed by an authorized company representative.
