About this file
This document consists of two New York State Department of Taxation and Finance certification forms (ST-220-CA and ST-220-TD) required for contractors bidding on state contracts valued above $100,000. These forms are mandatory compliance documents under Tax Law Section 5-a, as amended effective April 26, 2006, and apply to the Salesforce Implementation Enterprise Agreement RFP issued by the New York State Office of Information Technology Services (ITS). The forms establish that contractors and their affiliates and subcontractors must be registered to collect New York State and local sales and compensating use taxes if they have made sales of tangible personal property or taxable services exceeding $300,000 during the four consecutive sales tax quarters preceding the certification date. Contractors must file Form ST-220-TD with the Tax Department and Form ST-220-CA with the covered agency before the contract may take effect. Form ST-220-CA must be signed by an authorized representative and notarized, certifying that the information provided on Form ST-220-TD is correct and complete.
Form ST-220-TD requires contractors to complete all sections including identification information, contract value determination, and Schedule A listing any entities exceeding the $300,000 sales threshold. The form addresses contractor registration status, affiliate registration status, and subcontractor registration status, requiring contractors to certify under penalty of perjury the tax registration compliance of all parties. Contractors must indicate whether they have made sales exceeding $300,000 in New York State, whether affiliates have done so, and whether subcontractors have done so, with appropriate documentation of registration with the New York Department of Taxation and Finance. Both forms must be completed in their entirety and signed before a notary public, with the completed ST-220-TD mailed to the NYS Tax Department Data Entry Section in Albany. Failure to file the required certifications or provide accurate information may subject contractors to civil or criminal penalties under Tax Law.
