About this file
This is a Davis-Bacon and Related Acts (DBRA) Labor Standards compliance document issued by the Commonwealth of Virginia for the Boardwalk construction project, specifically the construction of the Hopewell Riverwalk to connect the existing phase II terminus to the Hopewell City Marina. The document establishes federal labor standards requirements and prevailing wage obligations applicable to all construction work performed under the contract. All laborers and mechanics employed on-site must be paid prevailing wage rates and fringe benefits as determined by the Secretary of Labor and included in the applicable Davis-Bacon Wage Decision. The contractor and all subcontractors must submit weekly certified payroll reports using DOL Form WH-347 or an approved equivalent and maintain payroll records for a minimum of three years after project completion. Apprentices and trainees may only be employed through DOL-approved programs with proper registration and approved ratios; unregistered workers must receive full prevailing wage rates.
The project is funded in whole or in part through federal financial assistance provided by the U.S. Department of Housing and Urban Development (HUD) under the Community Development Block Grant (CDBG) Program, subjecting the work to 40 U.S.C. 3141-3148 and 29 C.F.R. Parts 1, 3, and 5. Contractors must comply with the Contract Work Hours and Safety Standards Act (CWHSSA) regarding overtime compensation at one and one-half times the regular rate for hours exceeding forty per workweek. The prime contractor is responsible for ensuring all subcontractors comply with DBRA requirements and must include applicable wage decisions and labor standards clauses in all subcontracts. Non-compliance constitutes material breach and may result in payment withholding, contract termination, cost disallowance, liquidated damages, debarment, or other remedies available under federal law, HUD regulations, and the Virginia Public Procurement Act. Bidders must acknowledge familiarity with and agreement to comply with all DBRA labor standards by submitting a completed compliance affidavit.
