About this file
This document is a Categorical Exclusion (CE) environmental assessment prepared by the Federal Highway Administration (FHWA) Virginia Division in coordination with multiple state and federal agencies, including the Virginia Department of Environmental Quality (DEQ), Virginia Department of Game and Inland Fisheries (DGIF), and Virginia Marine Resources Commission (VMRC), for the City of Hopewell's Riverwalk Phase II project. The project involves construction of an 8-foot-wide, 1,420-linear-foot elevated timber boardwalk extending the existing Riverwalk Phase I along the Appomattox River as a pedestrian recreational trail and aesthetic amenity. The boardwalk will be ADA accessible and will connect to the eastern edge of the City Marina walkway, with a portion extending under the existing Route 10 bridge. No structural modifications to Route 10 are required. The project is funded through the Federal Highway Administration and the Fixing America's Surface Transportation (FAST) Act via the Recreational Trails Program (RTP) with federal project number VRT-316-D-170. Public meetings were held on August 2, 2018 (Planning Commission) and November 12, 2019 (City Council), with community feedback indicating positive reception and increased usage of City Park following Phase I completion.
The project requires coordination with multiple environmental and regulatory frameworks, including permits for impacts to wetlands and waters of the United States under Section 404 of the Clean Water Act and Section 10 of the Rivers and Harbors Act through a Joint Permit Application (JPA). Permanent wetland impacts total 0.03 acres with temporary impacts of 0.08 acres, both classified as de minimis under 0.1 acres. The project involves intertidal wetlands, tidal waters (Appomattox River), and temporary shading and timber pile impacts, requiring a Virginia Water Protection Permit and local wetlands board approval. Federal threatened and endangered species of concern include sensitive joint vetch and the northern long-eared bat; however, all project work will occur above mean low water to avoid Atlantic sturgeon habitat disturbance. The document confirms the project meets categorical exclusion criteria with no significant environmental impacts, though FHWA guidance was requested for final approval. Compliance with erosion and sediment control plans, stormwater management permits, and Virginia Coastal Zone Management Program requirements is mandated prior to construction initiation.

Riverwalk Phase II Trail Project City of Hopewell, DEQ #4125
FEDERAL CONSISTENCY
This project is consistent with the Virginia Coastal Zone Management Program (CZM), provided all applicable permits or approvals listed under enforceable policies are received prior to implementation of the project. Accordingly, if any of the enforceable policies apply, please contact the relevant agencies to obtain applicable permits or approvals. DEQ’s Piedmont Regional Office (DEQ PRO, 804-527-5020) administers the enforceable policies listed under DEQ’s jurisdiction. Please contact that office for assistance in meeting the requirements of applicable programs.
The following discussion is provided as a guide to the enforceable policies administered by DEQ and other agencies of the Commonwealth which could apply to the project. In addition, DEQ encourages the applicant to consider potential project impacts to the advisory policies of the Virginia CZM Program. Final determination concerning potential impacts on these programs rests with DEQ-PRO or the appropriate state agency. It is the applicant’s responsibility to coordinate development with appropriate state agencies.
1. Non-point Source Pollution Control.
1(a) Erosion and Sediment Control and Stormwater Management. A project specific erosion and sediment control (ESC) plan must be submitted to the city for review and approval pursuant to the local ESC requirements for land-disturbing activities equal to or greater than 2,500 square feet in a Chesapeake Bay Preservation Area. Depending on local requirements, the area of land disturbance requiring an ESC plan may be less.
The ESC plan must be approved by the locality prior to any land disturbing activity at the project site. All regulated land-disturbing activities associated with the project, including on- and off-site access roads, staging areas, borrow areas, stockpiles, and soil intentionally transported from the project must be covered by the project-specific ESC plan. Depending on local requirements, a Stormwater Management (SWM) plan may be required. Local ESC and SWM program requirements may be requested through the appropriate city office. [References: Virginia Erosion and Sediment Control Law, Virginia Code §62. 1-44. 15:51 et seq.; Virginia Erosion and Sediment Control Regulations, 9 VAC 25-840-10 et seq.]. Additional guidance may be obtained from DEQ's Office of Stormwater Management, Larry Gavan at (804) 698-4040 or Larry.Gavan@deq.virginia.gov.
1(b) Virginia Stormwater Management Program General Permit for Stormwater Discharges from Construction Activities. DEQ is responsible for the issuance, denial, revocation, termination, and enforcement of the Virginia Stormwater Management Program (VSMP) General Permit for Stormwater Discharges from Construction Activities related to municipal separate storm sewer systems (MS4s) and construction activities for the control of stormwater discharges from MS4s and land disturbing activities under the Virginia Stormwater Management Program. The operator or owner of a construction project involving land-disturbing activities equal to or greater than one acre is required to register for coverage under the General Permit for Discharges of Stormwater from Construction Activities and develop a project-specific https://www.deq.virginia.gov/Programs/EnvironmentalImpactReview/FederalConsistencyReviews.aspx#enforce https://www.deq.virginia.gov/Programs/EnvironmentalImpactReview/FederalConsistencyReviews.aspx#advisory mailto:Larry.Gavan@deq.virginia.gov stormwater pollution prevention plan (SWPPP). The SWPPP must be prepared prior to submission of the registration statement for coverage under the general permit, and it must address water quality and quantity in accordance with the VSMP Permit Regulations. General information and registration forms for the General Permit are available on DEQ’s website at http://www.deq.virginia.gov/Programs/Water/StormwaterManagement/VSMPPermits/Co nstructionGeneralPermit.aspx. [References: Virginia Stormwater Management Act, Virginia Code sections 62.1.44.15:24 et seq.; VSMP Permit Regulations, 9 VAC 25-870- 10 et seq.]
Additional assistance may be obtained by contacting DEQ’s Office of Stormwater Management, Holly Sepety at (804) 698-4039 or holly.sepety@deq.virginia.gov.
2. Fisheries Management. The fisheries management enforceable policy is administered by the Virginia Marine Resources Commission (VMRC) (Virginia Code Section 28.2-200 to 28.2-713) and the Department of Game and Inland Fisheries (DGIF) (Virginia Code Section 29.1-100 to 29.1-570). The program stresses the conservation and enhancement of finfish and shellfish resources and the promotion of commercial and recreational fisheries to maximize food production and recreational opportunities. In addition, the State Tributyltin (TBT) Regulatory Program is a part of the Fisheries Management program. The General Assembly amended the Virginia Pesticide Use and Application Act as it related to the possession, sale, or use of marine antifoulant paints containing TBT. The VMRC, DGIF, and Virginia Department of Agriculture and Consumer Services (VDACS) share enforcement responsibilities (Virginia Code §3.1-249.59 through §3.1-249.62).
Questions on compliance with the fisheries management enforceable policy should be directed to DGIF (Amy Ewing at Amy.Ewing@dgif.virginia.gov); VMRC (Tony Watkinson at Tony.Watkinson@deq.virginia.gov); and VDACS (Keith Tignor at Keith.Tignr@vdacs.virginia.gov) as necessary.
3. Subaqueous Lands Management. Pursuant to Section 28. 2-1204 of the Code of Virginia, the Virginia Marine Resources Commission (VMRC) has jurisdiction over any encroachments in, on, or over any state-owned rivers, streams, or creeks in the Commonwealth. Accordingly, any portion of the project involving encroachments channelward of ordinary high water along natural rivers and streams may require a permit. In addition, VMRC generally requires permits for encroachments on non-tidal streams with a drainage area greater than five square miles or with an average instream flow of at least five cubic feet per second.
VMRC serves as the clearinghouse for the Joint Permit Application (JPA) used by:
VMRC for encroachments on or over state-owned subaqueous beds as well as tidal wetlands;
U. S. Army Corps of Engineers (Corps) for issuing permits pursuant to Section
404 of the Clean Water Act and Section 10 of the Rivers and Harbors Act;
mailto:Amy.Ewing@dgif.virginia.gov mailto:Tony.Watkinson@deq.virginia.gov mailto:Keith.Tignr@vdacs.virginia.gov
DEQ for issuance of a Virginia Water Protection Permit; and Local wetlands board for impacts to wetlands.
Any jurisdictional impacts would be reviewed by VMRC during the JPA process. The applicant must coordinate with the VMRC regarding the JPA process and the potential need for a permit from VMRC for impacts to state-owned subaqueous lands. Contact the VMRC at (757) 247-2252 for additional information and coordination.
4. Wetlands Management. Federal and state governments regulate impacts to streams and wetlands. The Virginia Marine Resources Commission serves as the clearinghouse for the Joint Permit Application (JPA) used by the:
1. U.S. Army Corps of Engineers, for issuing permits pursuant to section 404 of the Clean Water Act and section 10 of the Rivers and Harbors Act;
2. Department of Environmental Quality, for issuance of Virginia Water Protection (VWP) Permits pursuant to section 401 of the Clean Water Act, Virginia Code sections 62. 1-44.2 et seq., Virginia Code section 62. 1-44. 15:20, and Virginia Administrative Code 9 VAC 25-210-10 et seq.;
3. Virginia Marine Resources Commission, for permits to encroach on or over state-owned subaqueous beds as well as tidal wetlands pursuant to Virginia Code sections 28.2-1200 through 1400; and
4. Local wetlands board, for impacts to wetlands.
In general, DEQ recommends the avoidance of stream and wetland impacts to the maximum extent practicable. For unavoidable impacts, DEQ encourages the following practices to minimize the impacts to wetlands and waterways: operate machinery and construction vehicles outside of stream-beds and wetlands; use synthetic mats when in-stream work is unavoidable; stockpile material excavated for replacement; and preserve the top 12 inches of material removed from wetlands for use as wetland seed and root stock in the excavated area.
Contact VMRC at (757) 247-2200, to obtain a JPA for streams and wetlands impacted by construction. VMRC will distribute the application to the appropriate agencies. Each agency will conduct its review and respond. Additional information on VWP permitting may be obtained by contacting DEQ-PRO, Alisson Dunaway at (804) 527-3940 or Alisson.Dunaway@deq.virginia.gov.
5. Coastal Lands Management. Under the Chesapeake Bay Preservation Act (Bay Act), localities within the state’s coastal zone have enacted programs designed to improve water quality in the Bay through mitigation of the impacts of development and redevelopment on sensitive environmental features such as streams, wetlands, floodplains, highly erodible soils, and highly permeable soils. Resource Protection Areas (RPAs) and Resource Management Areas (RMAs) have been designated in each mailto:Alisson.Dunaway@deq.virginia.gov locality; these areas consist of groupings of sensitive environmental features. RPA features (tidal wetlands, certain non-tidal wetlands, tidal shores, and buffer areas) are the most sensitive; in general, only water-dependent uses may be constructed in an RPA. RMA features (highly erodible soils, highly permeable soils, and certain non-tidal wetlands) are less sensitive than RPA features, but no less important. Development in an RMA requires that activities meet certain performance criteria designed to mitigate negative environmental impacts. To ensure compliance with the Bay Act, please contact the appropriate locality office. Additional guidance may be obtained from DEQ’s Office of Local Government Assistance Programs, Daniel Moore at (804) 698-4520 or daniel.moore@deq.virginia.gov.
ADDITIONAL ENVIRONMENTAL CONSIDERATIONS
In addition to the enforceable policies of the CZM Program, the project must comply with all other applicable federal, state and local laws and regulations. In general, to the extent practicable, construction must incorporate features that prevent significant adverse impacts on ambient air quality, water quality, wetlands, historic structures, fish and wildlife, and species of plants, animals, or insects listed by state or federal agencies as rare, threatened, or endangered.
The following discussion is provided as a guideline of programs administered by DEQ and other agencies of the commonwealth, which could be applicable. Final determinations concerning potential impacts on these programs rest with the DEQ PRO (804-527-5020) and the appropriate agency administering each program. It is the responsibility of the applicant to coordinate with these agencies.
1. Solid and Hazardous Waste Management. DEQ administers the Virginia Solid Waste Management Regulations (9 VAC 20-81) and the Virginia Hazardous Waste Management Regulations (9 VAC 20-60). The applicant may contact DEQ’s Piedmont Regional Office (Jason Miller, 804-527-5028, Jason.Miller@deq.virginia.gov) concerning the location and availability of waste management facilities in the project area or with waste-related questions pertaining to the project.
1(a) Agency Recommendations. DEQ encourages all projects and facilities to implement pollution prevention principles, including:
• the reduction, reuse and recycling of all solid wastes generated; and
• the minimization and proper handling of generated hazardous wastes.
2. Natural Heritage Resources. The Department of Conservation and Recreation’s Division of Natural Heritage (DNH) can search its Biotics data system (Biotics) for occurrences of natural heritage resources in and around project areas. Natural heritage resources are defined as the habitat of rare, threatened, or endangered animal and plant species, unique or exemplary natural communities, and significant geologic communities.
mailto:daniel.moore@deq.virginia.gov mailto:Jason.Miller@deq.virginia.gov
Under a Memorandum of Agreement established between the Virginia Department of Agriculture and Consumer Services (VDACS) and the Department of Conservation and Recreation (DCR), DCR has the authority to report for VDACS on state-listed plant and insect species. We recommend that the DNH be contacted at (804) 786-795l, to secure updated information on natural heritage resources before the project is implemented.
3. Wildlife Resources. The Department of Game and Inland Fisheries, as the Commonwealth’s wildlife and freshwater fish management agency, exercises enforcement and regulatory jurisdiction over wildlife and freshwater fish, including state or federally listed endangered or threatened species, but excluding listed insects (Virginia Code Title 29.1). The Department (hereinafter “DGIF”) is a consulting agency under the U.S. Fish and Wildlife Coordination Act (16 U.S.C. sections 661 et seq.), and provides environmental analysis of projects or permit applications coordinated through the Department of Environmental Quality and several other state and federal agencies.
DGIF determines likely impacts upon fish and wildlife resources and habitat, and recommends appropriate measures to avoid, reduce, or compensate for those impacts.
For more information, see the DGIF website at www.dgif.virginia.gov or contact Amy Ewing at (804) 367-2211.
4. Historic and Archaeological Resources. Section 106 of the National Historic and Preservation Act of 1966, as amended, requires that activities that receive federal funding must consider effects to properties that are listed or eligible for listing on the National Register of Historic Places. The Department of Historic Resources (DHR) conducts reviews of projects to determine their effect on historic structures or cultural resources. If applicable, contact DHR. In the event that archaeological resources are encountered during construction, immediately contact Roger Kirchen, DHR, at (804) 367-2323.
5. Pollution Prevention. DEQ advocates that principles of pollution prevention and sustainability be used in all construction projects as well as in facility operations.
Effective siting, planning, and on-site Best Management Practices (BMPs) will help to ensure that environmental impacts are minimized.
DEQ’s Office of Pollution Prevention provides information and technical assistance relating to pollution prevention techniques. For more information, contact DEQ’s Office of Pollution Prevention (Meghann Quinn, (804-698-4021).

ESSLog 40503; Preliminary scoping request for Riverwalk Phase II in Hopewell, VA
Our customary response to requests for preliminary scoping reviews is: Due to staffing limitations, we are typically unable to review and provide preliminary scoping comments on projects that are not currently involved in one of the regulatory review processes for which we are a formal consulting agency (see https://www.dgif.virginia.gov/environmental-programs/environmental-services-section/). If your project subsequently requires a permit or environmental review which involves our Department, we will provide comments through that process to the appropriate agencies. Thank you for soliciting our review of your project. It is customary for us to invite you to conduct your own review of your project through the Virginia Fish and Wildlife Information Service (VAFWIS) at: https://www.dgif.virginia.gov/environmental-programs/fish-and-wildlife-information-section/ and https://vafwis.dgif.virginia.gov/fwis/.
In general, we support the creation of multi-use trails and recommend using permeable surface material, to the extent practicable. Based on the project scope, location, and aerial photos, we have the following recommendations.
If tree removal or forest management is anticipated, project design and construction should adhere to our standard protocols for bat habitat assessment and protection at:
http://www.dgif.virginia.gov/wildlife/bats/little-brown-bat-tri-colored-bat-winter-habitatroosts-application/ and;
http://www.dgif.virginia.gov/wildlife/bats/northern-long-eared-bat-application/.
In addition, the project should incorporate the recommendations in the Department’s Guidance Document on Best Management Practices for Conservation of Little Brown Bats and Tri- Colored Bats, at: https://www.dgif.virginia.gov/wp-content/uploads/LBBA_TCBA_Guidance.pdf.
If the project proponent elects not to adhere to these recommendations, they may opt to prepare a Conservation Plan to address incidental take of these state-endangered bats. Subject: Riverwalk Connection – Phase II trail project Project: VRT-316-D-170 Location: City of Hopewell, VA Project Limit From: End of Riverwalk Phase I (37.309617, -77.292884) Project Limit To: Hopewell Marina (37.310923, -77.297097) To: ProjectReview@dgif.virginia.gov
Dear Department of Game and Inland Fisheries:
The City of Hopewell, Virginia is evaluating the environmental impacts of the proposed Riverwalk Connection - Phase II trail project. The project is funded through the Federal Highway Administration (FHWA) and is being developed through the Recreational Trails Program (RTP), which provides federal funding support for creating and maintaining recreational trails. In accordance with the requirements of the National Environmental Policy Act (NEPA), Section 106 of the National Historic Preservation Act (NHPA), and other federal and state laws and regulations, environmental studies assessing the project’s potential impacts will be documented in a Categorical Exclusion. The attached maps and shapefile provide the location of the project and the areas of potential effects.
Public meetings were held to discuss the scope of the project on two occasions. The Riverwalk Phase 1 public meeting was a planning commission meeting that took place on August 2, 2018. The Riverwalk Phase 2 public meeting was a city council meeting that took place on November 12, 2019. Both meetings were located at the City of Hopewell Council Chambers (300 N Main Street, Hopewell, VA 23860). The project is consistent with federal requirements for logical termini and independent utility. The majority of the Phase II trail extension is elevated on a wooden structure over intertidal wetlands on the Appomattox River. A portion of the proposed Riverwalk project extends under the existing Route 10 (W. Randolph Road) bridge, although no structural modifications will occur to Route 10 to accommodate the trail. No residential, commercial, or non-profit relocations would be required. The project will not require the purchase of property. It does include the purchase of 2 easements adjacent to North 6th Avenue for $7,500. All properties utilized by this project are owned or under easement agreement by the city.
Project Description The Hopewell Riverwalk is located just west of downtown Hopewell. The City completed the Hopewell Riverwalk (Phase I) project earlier this year. For the Hopewell Riverwalk (Phase II), the city is pursuing funding for recreation and trails to support pedestrians and other non-motorized transportation users to enjoy this waterfront access, scenic vistas, and unique recreational amenity through Hopewell. The eight-foot wide boardwalk would support pedestrians and be ADA accessible. The Riverwalk would be an elevated timber walkway to minimize trail maintenance, reduce obstacles from flooding, and allow regular access over riverbanks without disturbing the river and natural habitats along the shoreline.
Purpose and Need The Hopewell Riverwalk would extend the existing recreational trail developed by the Riverwalk Phase I project approximately 1,400 linear feet, connecting to the eastern edge of the City Marina walkway. The proposed project would vastly improve the quality of life of Hopewell’s residents and tourists, by offering residents new, healthier ways to access key destinations in Hopewell, enjoy the outdoors, and explore the riverfront. With new downtown developments, improvements to City Park, the renovated Appomattox Regional Library, and the new Boathouse at City Point restaurant, there will be higher demand for the Riverwalk now than ever before.
Attached to this document you will find a VaFWIS Initial Project Assessment, photo log, and map of the delineated project area. The VaFWIS search identifies one (1) federally listed species, Atlantic sturgeon (Acipenser oxyrinchus), with potential to occur near the project area. All project work will be above mean low water (MLW) to avoid potential disturbances to sturgeon habitat. The coordinates for the project centroid are: - 37.310082, -77.294578. A map depicting anticipated temporary or permanent impacts is also provided.
Please feel free to include any additional comments that may be appropriate. To avoid project delays, I would appreciate your comments by January 15, 2020.

(JPA) will be distributed for agency review. We will review the JPA and comment as appropriate.
This project is located within 2 miles of a documented occurrence of a state or federal threatened or endangered plant or insect species and/or other Natural Heritage coordination species. Therefore, we recommend coordination with VDCR-DNH regarding the protection of these resources. We also recommend contacting the USFWS regarding all federally listed species.
Thanks.
