About this file

This document is an addendum to the Federal Acquisition Regulation (FAR) clause 52.212-2 that establishes evaluation criteria for a multiple-award Blanket Purchase Agreement (BPA) solicitation for portable toilet leases at Andersen Air Force Base, Guam, issued by the 36th Contracting Squadron.

The Government intends to establish approximately three BPAs with responsible vendors offering technically acceptable quotations at fair and reasonable prices. Quotations are evaluated on a pass/fail basis using two primary factors: (1) Technical Acceptability and (2) Price Reasonableness. Technical acceptability requires quoters to demonstrate conformance to the Schedule of Items and Statement of Work specifications, and to establish capability and feasibility across four demonstration elements: source of supply/inventory access on Guam (owned inventory, leased yard, or firm subcontract), servicing capability including vacuum/pump-out vehicles and qualified operators, delivery and placement means including hauling equipment and personnel, and surge capability to support exercises and contingencies. All demonstrated capabilities must be firm and documented; general assurances or promises to locate sources after award are insufficient. Price evaluation treats lease rates as inclusive of weekly service visits per the SOW and transportation to delivery destinations. The Contracting Officer will determine contractor responsibility separately from technical evaluation, including verification of the quoter's ability to lawfully transport and dispose of waste off-installation with required hauler permitting. The Government retains discretion to adjust the final number of BPAs, establish partial agreements by line item, create multiple BPAs for the same item, or consider non-selected quoters for future on-ramping based on overall benefit and adequate item coverage.

Addendum to RFO 52.212-2, Evaluation — Commercial Products and Commercial Services

Multiple-Award BPA — Portable Toilet Leases 36th Contracting Squadron, Andersen AFB, Guam

1.0 Basis for Award

The Government will establish multiple Blanket Purchase Agreements (BPAs) under the simplified procedures at RFO 12.201-1 with responsible quoters whose quotations are determined technically acceptable and whose pricing is determined fair and reasonable, for the items each quoter offered. The Government intends to establish approximately three (3) BPAs; the number of agreements and the basis for selecting among acceptable quoters are separately addressed within this attachment.

Each quotation is evaluated on a pass/fail (acceptable/unacceptable) basis for technical acceptability, together with a determination of price reasonableness and contractor responsibility. Competition occurs at the call-order level among the resulting BPA holders.

2.0 Evaluation Factors

The Government will evaluate two factors:

• Factor 1 — Technical Acceptability (pass/fail)

• Factor 2 — Price (reasonableness)

3.0 Factor 1 — Technical Acceptability

A quotation is technically acceptable if it meets each of the following sub-factors for the items offered. A quotation that fails any sub-factor for an item is unacceptable for that item. The Government evaluates acceptability only for the items the quoter actually offered; a quoter is not penalized for offering a partial set of items.

3.1 Sub-Factor A — Conformance to the Schedule of Items and SOW

The units and accessories offered conform to the descriptions in the Schedule of Items (Attachment 2) and the requirements of the Statement of Work (Attachment 1) for the items priced.

3.2 Sub-Factor B —Capability and Feasibility

The quoter must demonstrate the feasibility of meeting the required response, delivery, and servicing timelines for the items offered. The quoter shall demonstrate each of the following:

Demonstration element What the quoter must show

a. Source of supply / inventory access

The source of the units that will fill orders for the items offered — owned inventory on Guam, a leased yard or storage on Guam, or a firm, documented subcontract or teaming arrangement with an island supplier. A statement that a source will be located after award is not sufficient.

b. Servicing capability Access to the vacuum or pump-out service vehicles, qualified operators, and consumables needed.

c. Delivery and placement means

Access to the hauling and placement equipment and qualified personnel needed to deliver, place, anchor, and remove units at Andersen AFB and any other identified locations

Demonstration element What the quoter must show

d. Surge capability The ability to support exercise, event, or contingency surge.

A quotation is acceptable under this sub-factor only if the demonstrated capability makes it feasible for the quoter to meet the SOW responsiveness standards. General assurances of capability, without a firm and documented basis, are not sufficient. Reliance on locating or negotiating a source after award does not demonstrate feasibility.

4.0 Factor 2 — Price

The Government will evaluate price for fairness and reasonableness consistent with RFO 12.204(a). Price reasonableness may be established by comparison among quotations received, comparison to the independent Government estimate, current market information, or other appropriate means.

Schedule of Items Section 1.0 lease rates are evaluated as inclusive of the weekly service visit described in SOW Section 5.1. A rate quoted without the weekly service visit is not comparable to other quotations and may be found unacceptable. Prices are evaluated inclusive of transportation to the delivery destination; prompt-payment discounts are not used in the price evaluation. Competition among BPA holders at the call-order level is the primary means of ensuring fair and reasonable pricing for individual orders.

5.0 Contractor Responsibility

Before establishing a BPA, the Contracting Officer will determine that the quoter is responsible, including having the integrity, capability, and resources (or firmly arranged resources) to perform. This includes the ability to lawfully transport and dispose of collected waste off the installation in accordance with SOW Section 5.6, including any required hauler permitting. The Government may consider the quoter's past and current performance and other responsibility information for this purpose. A responsibility determination is separate from the technical acceptability evaluation.

6.0 Establishment of Agreements

The Government intends to establish approximately three (3) BPAs with responsible vendors that provide technically acceptable quotes at fair and reasonable prices. If acceptable quotes exceed the targeted number, the Contracting Officer will compare quotes and select those offering the greatest overall benefit.

The Government may adjust the final number of BPAs—establishing more, fewer, or none—to ensure adequate item coverage while balancing administrative burden. Additionally, the Government may establish partial agreements by line item, establish multiple BPAs for the same item, or consider non-selected quoters for future on-ramping as outlined in the solicitation.
