About this file
This document contains a sole source justification and a solicitation for construction of a three-bay specialized hangar at Dane County Regional Airport-Truax Field in Madison, Wisconsin. The sole source justification cites the proprietary nature of the incumbent Andover Automated Controls building automation system currently used basewide for HVAC, power, and door security, stating conversion to a new system would cost over $6 million. The solicitation seeks firm fixed-price bids for demolition of an existing building and construction of a new three-bay hangar to support the F-35 mission, including fuel cell operations, indoor wash requirements, squadron-level surface coating operations, and weapons load training. The solicitation includes a base bid and two options, with a bid opening date in accordance with FAR Subpart 14.4. Brand name justifications are provided for specified security, HVAC control, and lock systems. The contract duration is 550 days, and the project value is estimated between $25-100 million. The NAICS code is 236220 and size standard is $39.5 million.

SIMPLIFIED ACQUISITION PROCEDURES (SAP)
DETERMINATION MEMORANDUM FOR SOLE SOURCE ACQUISITIONS OVER THE MICRO-PURCHASE THRESHOLD BUT NOT
EXCEEDING THE SIMPLIFIED ACQUISITION THRESHOLD FAR 13.106-3(b)(3)(i)
SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER DETERMINES THAT ONLY ONE SOURCE IS REASONABLY AVAILABLE. WHEN THE CUSTOMER DESCRIBES AN ITEM OR SERVICE, WHICH LIMITS THE AVAILABILITY TO ONE SOURCE, THE DETERMINATION MUST EXPLAIN WHY THE ITEM OR SERVICE PROVIDER IS THE ONLY ONE THAT WILL MEET THE GOVERNMENT'S REQUIREMENT. STATEMENTS SUCH AS "ONLY KNOWN SOURCE" OR "ONLY SOURCE WHICH CAN MEET THE REQUIRED DELIVERY DATE" ARE INADEQUATE TO SUPPORT A SOLE SOURCE PURCHASE. THIS FORM MAY BE USED IN LIEU OF THE DETERMINATION DESCRIBED IN FAR 13.106. THE CUSTOMER SHALL PROVIDE THE FOLLOWING INFORMATION:
QUOTE/SOLICITATION NUMBER: W50S9F-22-B-0001
ESTIMATED AMOUNT
BRAND NAME BUY YES NAME OF PROPOSED CONTRACTOR Andover Automated Controls
DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED AND THE INTENDED USE:
Andover Automated Controls is a state of the art building automation system that adds efficiency to the Heating, Ventilation and Air Conditioning (HVAC) and is used to monitor and control facility HVAC equipment. It is also used to monitor and control facility door security base wide.
UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR
SERVICES CAN BE USED:
The 115FW currently employs Andover Automated Controls equipment and systems for our base-wide HVAC, power, and door security systems.
The overall system incorporates a central reporting station that is located within the Civil Engineering Squadron with transceivers located in every building on base and communicates back to the central reporting station. Andover equipment/systems are proprietary in nature and no other manufacturer's equivalent products can communicate and support the current Andover system currently employed at this installation. To install another manufacturer's equipment/systems would require substantial duplication of cost to the Government not expected to be recovered through completion resulting in unacceptable delays in fulfilling the agency's requirements. This estimated cost for converting the entire installation to a new automated control system would be well over $6M for the 27 facilities currently implementing this system.
REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES AND DETAILED
DESCRIPTION OF MARKET RESEARCH PERFORMED:
Many other ANG installations have Andover equipment and systems in use for the same purposes. As stated above, to install another manufacturer's equipment/systems would require substantial duplication of cost to the Government not expected to be recovered through competition resulting in unacceptable delays in fulfilling the agency's requirements. It is customary industry practice for manufacturers to limit proprietary information to technicians who have been properly trained and certified on how to install, maintain, repair, and integrate their equipment and systems.
EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND OPEN
COMPETITION HAS NOT BEEN DEVELOPED OR IS NOT AVAILABLE:
Andover systems and items are already in place at the installation, and in this instance no other manufacturer's systems or items will communicate and work with the current system. The cost to convert a new system is not reasonable compared to the cost to maintain parts of the current system.
PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO
COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED:
The Government will continue to seek out vendors proposing cost-effective solutions that meet the Government's needs. Additionally, we will continue to conduct market research to find equipment/systems that are not proprietary in nature.
I certify that the supporting data under my cognizance, which are included in the justification are accurate and complete to the best of my knowledge and belief.

FAIR AND REASONABLE COST DETERMINATION
I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable based on the Independent Government Estimate (IGE). As part of the basis, certified cost or pricing data is not required per 15.403-1(b)(3).
CONTRACTING OFFICER CERTIFICATION
I CERTIFY THAT THIS JUSTIFICATION IS ACCURATE AND COMPLETE TO THE BEST OF MY KNOWLEDGE AND BELIEF, AND THAT COMPLETING THIS PURCHASE AS A SOLE SOURCE/BRAND NAME IS IN THE BEST INTEREST OF THE GOVERNMENT. ADDITIONALLY, I APPROVE THIS JUSTIFICATION TO LIMIT COMPETITION SUBJECT TO THE AVAILABILITY OF FUNDS AND PROVIDED THAT THE SERVICES OR SUPPLIES HEREIN DESCRIBED HAVE OTHERWISE
BEEN AUTHORIZED FOR ACQUISITION.
