Contractor is responsible for determining the appropriate means and manner of performing the Work.
b) No Conflicts. Contractor, by signature to this Contract, represents and warrants that Contractor’s performance of the Work under this Contract creates no potential or actual conflict of interest as defined by ORS 244; and no statutes, rules or regulations of any Agency of Oregon or federal agency for which Contractor currently performs work would prohibit Contractor from performing the Work under this Contract.
c) Affiliation. Contractor understands and agrees that it is not an "officer," "employee," or "agent" of the Agency of Oregon, as those terms are used in ORS 30.265 or otherwise.
d) Taxes and Benefits. Contractor is responsible for all federal or Agency taxes applicable to compensation or payments paid to Contractor under this Contract and, unless required by applicable law, Agency will not withhold from such compensation or payments any amount to cover Contractor's federal or Agency tax obligations. Contractor is not eligible for any social security, unemployment insurance or workers' compensation benefits from compensation or payments paid to Contractor under this Contract, except as a self-employed individual.
e) Contractor shall promptly, as due, make payment to any person, co-partnership, association or corporation furnishing medical, surgical and hospital care services or other needed care and attention, incident to sickness or injury, to the employees of Contractor, of all sums that Contractor agrees to pay for the services and all moneys and sums that Contractor collected or deducted from the wages of employees under any law, contract or agreement for the purpose of providing or paying for the services.

The ownership of and title to the Designated Timber will pass to Contractor as the timber is paid for, following its removal from the Area of Operations. Any right of Contractor to cut and remove the timber shall expire and end at the time this Contract, or any extension, terminates. All rights and interests of Contractor in and to timber and logs remaining on the Area of Operations shall, at that time, automatically revert to and re-vest in Agency, without compensation to Contractor.
Section 1040. Quality and Quantity of Timber. Agency makes no guarantee or warranty to Contractor as to the quality or quantity of the Designated Timber. Further, Agency makes no representation, warranty, or guarantee of the accuracy of any information either provided by Agency or made available by Agency under the Public Records Law with respect to this Contract. Contractor agrees to bear exclusive responsibility for, and to accept all risks associated with, the actual conditions on the Areas of Operations and Contractor's computation of its bid for this Contract.

In the event a T&E species is found within or in the vicinity of the operations or area(s) of operations, or Agency deems it necessary or expedient to take measures that modify operations under the Contract to prevent disturbance to T&E species or to take action in response to any pending or threatened legal action, Contractor agrees that Agency may take steps to protect the interests of Agency, including imposing restrictions on operations, contract modification, suspension, or termination.
Section 1550. Breach; Default; Remedies. Any failure by Contractor to comply with the terms and conditions of this Contract is a breach. If Contractor is in breach, Agency may, after giving written notice, suspend any further Operations of Contractor under this Contract, except those Operations necessary to remedy any breach.
If Contractor fails to remedy a breach within the time allowed by Agency, or if Contractor fails to complete work as required under any interim Contract completion date or the Contract expiration date, or if Contractor injures or severs any timber other than Designated Timber, Agency may declare Contractor to be in default by providing notice of the default.
