SECTION L – INSTRUCTIONS TO OFFEROR’S

L1 - INFORMATION TO OFFEROR’S

1. General Information. This solicitation is issued for the acquisition of a Multiple Award Construction Contract (MACC) to support Joint Base San Antonio (JBSA), Laughlin AFB and Goodfellow AFB, construction requirements. The Government intends to execute a Multiple Award Indefinite Delivery, Indefinite Quantity Firm Fixed Price (FFP). This acquisition is a Total Small Business set aside. Proposals may only be submitted by Small Business firms, registered in the North American Industrial Classification System Code (NAICS) of 236220. This competitive acquisition will utilize the Tradeoff source selection procedures in accordance with FAR 15.101-1 and 15.3 as supplemented by the DoD Source Selection Procedures referenced in DFARS 215.300 and the AFFARS Mandatory Procedures 5315.3 to make an integrated assessment for a best value award decision.

The Government intends to select approximately twelve (12) contractors representing the best value to the Government by meeting or exceeding the terms and conditions of the RFP. The exact number of awards will be determined by the Source Selection Team during the evaluation of proposals and will based primarily on the number and capabilities of the highest rated firms. The Government anticipates to establish an active pool with of approximately seven (7) contractors, and an inactive pool with approximately five (5) contractors. The future requirements will be competed among the pool of awardees based on the work defined in individual task orders. Nonperforming contractors may be off ramped IAW Section H of the resulting contract. If an active contractor is off ramped, an inactive contractor may be on ramped. On ramping is defined as switching a qualified inactive contract holder to active status to compete for subsequent requirements under the fair opportunity process identified at FAR 16.505.

The Government intends to evaluate proposals and award contracts without discussions with offerors (except clarifications as described in FAR 15.306(a)). Therefore, the offeror's initial proposal should contain the offeror's best terms from an experience, technical, and past performance standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary or in the best interest of the Government. The program cycle is a single ten (10) year ordering period. Awardees are required to recertify their small business status prior to the completion of the fifth year of the contract IAW FAR 52.219-28.

1.1. General Instructions: This section provides general guidance, as well as specific instructions on format and content, for preparing proposals. To assure timely and equitable evaluation of proposals, offeror’s must follow the instructions contained herein. The offeror's proposal must include all information requested and must be submitted in accordance with these instructions. Compliance with these instructions is mandatory and failure to furnish a complete proposal, at the time of proposal submission, may result in the proposal being unacceptable to the Government and may eliminate the offeror from further consideration for award. It is the offeror's responsibility to ensure the completeness of the proposal submitted.

Evaluation of a proposal will be conducted solely on the basis of the information contained within it and the Government will not assume that an offeror possesses any capabilities not specified. Inconsistencies among the parts of each proposal shall be explained. Any unexplained inconsistency may raise a fundamental question of the offeror's understanding of the requirement and/or ability to perform. Offerors are advised that their proposals are presumed to represent their best efforts and most complete responses to this solicitation. Proposals that simply reiterate the contents of this solicitation, or contain only superficial responses, may be considered unacceptable. Evidence of experience, capability, and qualifications that clearly demonstrate and support the offeror’s claims are essential. The absence of such

Offerors must clearly identify any exceptions to the solicitation terms and conditions and provide complete supporting rationale. Non-conformance with the instructions provided in these Instructions to Offerors may result in an unfavorable proposal evaluation.

1.2. Electronic Reference Documents. All referenced documents for this solicitation are available on the official U.S. Government website for making, receiving, and managing federal awards, System for Award Management web site at https://beta.sam.gov. Potential offeror’s are encouraged to subscribe for real-time e-mail notifications when information has been posted to the website for this solicitation.

1.3. Proposal Presentation and Preparations. The Government will not accept oral presentations in response to this solicitation. All proposals shall follow the proposal preparation instructions in Section L2; no electronic proposal submittals will be accepted in the absence of a hard copy. The Government is not responsible for any costs incurred or associated with preparation and submission of a proposal in response to this solicitation, or attendance to the pre-proposal conference.

1.4. Points of Contact (POC): The POCs for this acquisition are listed below. Written requests for clarification shall be sent to the CO/CS. All communication must be coordinated through the CO/CS using the following contact information:

1.5. Discrepancies and Ambiguities: If an offeror believes the requirements in these instructions contain an error, omission, ambiguity, or are otherwise unsound, the offeror shall immediately notify the Contracting Officer in writing with supporting rationale as well as the remedies the offeror is asking the CO to consider as related to the omission or error no later than five (5) calendar days after the RFP release.

1.6. Discovery of Mistakes: Mistakes in a contractor’s proposal that are disclosed after award shall be processed substantially in accordance with the procedures for mistakes in bids at FAR 14.407-4. The offeror is reminded that the Government reserves the right to award this effort based on the initial proposal, as received, without discussion. This reservation includes matters of additional or substitute pages of the initial proposal.

1.7. Team/Team Member(s)/Teaming Partner(s): The Government will consider the Offeror and all subcontractors a “team” when evidence of a signed Teaming Arrangement (TA) is submitted. This RFP will refer to the Offeror and all identified teaming subcontractors as a “team.”

a) This RFP will refer to all identified teaming subcontractors as “team members” or “teaming partners.” To be valid under this solicitation, a Teaming Arrangement (TA) must commit the parties to performance under this contract.

b) Offerors submitting a proposal as a Prime contractor are not allowed to submit a separate proposal as a teaming partner with another Prime contractor.

c) An offeror who does not submit a proposal as a Prime may serve as a teaming partner for no more than two primes.

1.8. Questions and Answers Period: All questions regarding this solicitation must be submitted in writing. All questions and subsequent answers will be posted to the beta.sam.gov website. It is the responsibility of the offeror to continuously monitor the site for updates. All questions shall be submitted electronically to the individual(s) listed in paragraph 1.4 above no later than 1:00 P.M. Local San Antonio TX time (14) fourteen calendar days after the issuance of solicitation. All questions and answers will be in written form and provided to offeror’s on https://beta.sam.gov

Information provided as a result of these questions and answers provided shall not qualify the terms and conditions of the solicitation and specifications. Terms of the solicitation and specifications remain unchanged unless the solicitation is amended in writing. If an amendment is issued, normal procedures relating to the acknowledgment and receipt of solicitation amendments shall apply.

1.9. Debriefings. The Contracting Officer (CO) will promptly notify offerors of any decision to exclude them from the Phase I or Phase II of the Evaluation Process; whereupon, they may request and receive a debriefing. Offerors excluded from Phase I or Phase II may request a pre-award debriefing or they may choose to wait until after the source selection decision to request a post-award debriefing.

However, offerors excluded from Phase I or Phase II are entitled to no more than one debriefing for each proposal. The CO will notify unsuccessful offerors who are excluded from Phase I or Phase II of the source selection decision in accordance with FAR 15.503. Upon such notification, unsuccessful offerors may request and receive a debriefing. Offerors desiring a debriefing must make their request in accordance with the requirements of FAR 15.505 or 15.506, as applicable.

1.10. In accordance with FAR Subpart 4.8 (Government Contract Files), the Government will retain one copy of all unsuccessful proposals. Unless the offeror requests otherwise, the Government will destroy extra copies of such unsuccessful proposals.

L2 - PROPOSAL PREPARATION

2. General Proposal Instructions: Proposals must be complete, self-sufficient, and respond directly to the requirements of this solicitation; alternate proposals will not be accepted. The Government ll perform a proposal review for completeness in accordance with the Attachment 12 - Proposal Completion Checklist prior to evaluation of proposals at Phase I. Proposal Completion is a prerequisite for Phase I evaluation. It is the offeror’s responsibility to verify the completeness of the proposal submitted and to ensure the executed contract documentation and supporting documentation meet the requirements of Sections L & M of this solicitation. Failure to provide a complete proposal may be grounds for elimination, further consideration and evaluation in the absence of discussions. The response shall consist of three (3) separate volumes as shown below.

Volume I – Executed Contracting Documents Volume II – Executive Experience and Technical Volume III – Past Performance

Proposals shall be complete, clearly presented, and include sufficient detail for effective evaluation as detailed in section M of this solicitation and for substantiating validity of stated claims. The proposal should not simply rephrase or restate the Government's requirements but rather provide convincing rationale to address how the offeror intends to meet these requirements. Offeror’s shall assume that the Government has no prior knowledge of the offeror’s facilities and/or experience and will rely heavily on

FA301621R0017 - Section L Page 4 of 12 the information presented in the offeror's proposal. Proposals shall be neat, indexed (cross-indexed as appropriate) and assembled in an orderly manner. Elaborate artwork and expensive visual and other presentation aids are neither necessary nor desired. Include only information that is relevant to this source selection.

2.1. Proposal Submission: Offeror’s are responsible for submitting proposals so as to reach the Government office designated in this solicitation by the time specified in this solicitation. Both an electronic and 6 original hard copies (labeled 1 through 6) are due by the proposal submission date and time. The electronic copy shall be submitted on a CD/DVD included in disk sleeve or case in Copy 1 of the proposal; no alternate electronic format other than CD/DVD will be accepted. All electronic documents must be in PDF format and shall follow the instructions in paragraphs 2.3 and 2.4 below. Title of the documents should state the corresponding proposal volume/title and include the offeror’s CAGE code (i.e. “Volume I – Contracting”).

The proposal package must be delivered to the address shown below prior to the time set for closing of proposals; see Block 13A of the SF 1442. Proposals may be delivered by mail/carrier or hand carried to the address below.

Contractors should request base access for hand carried proposal delivery NLT seventy-two (72) hours prior to the proposal due date/time by sending an email request identifying the company name and name of individual requesting access to the POCs identified in paragraph 1.4.

Any proposal, bond, amendment, or revision that is received at the designated Government office after the exact time specified for receipt of proposals will be “late” and will not be considered unless the Contracting Officer determines the criteria set forth in FAR 15.208 exists.

2.2. Communications: Exchanges of source selection information between Government and offeror’s will be controlled by the Contracting Officer. Exchanges of source selection information after submission of the initial proposal packages between the Government and offeror’s will be controlled by the Contracting Officer. Email may be used to transmit such information only if the email can be sent encrypted, and must include “Source Selection Information – See FAR 2.101 and 3.104” in the subject line of the email. Otherwise, source selection information will be transmitted via direct mail.

2.3. Format and Content: Each of the three (3) volumes specified in Section L paragraph 2 shall be separately bound in three-ring, loose-leaf binders permitting the volume to lie flat when open adhering to the specific requirements discussed further below. A cover sheet should be bound in each book, clearly marked as to volume number, title, copy number, solicitation identification, and the offeror's name. The same identifying data should be placed on the spine of each binder. To the greatest extent possible, each volume shall be written on a stand-alone basis so that its contents may be evaluated with a minimum of cross-referencing to other volumes of the proposal. Cross-referencing within a proposal volume is permitted where its use would conserve space without impairing clarity.

2.4. Page Size, Format and Limit: The proposals will be on 8 1/2” x 11” paper, white or ivory stock.

Legible tables, charts, graphs and figures shall be used wherever practical to depict organizations, systems and layout, implementation schedules, plans, etc. These displays shall be uncomplicated, legible, and

FA301621R0017 - Section L Page 5 of 12 shall not exceed 11” x 17”. Type face shall not be less than 12-font, with 1” margins on all sides. Smaller, legible font size, no smaller than 6-point, may be used for charts and tables.

A page is defined as one face of a sheet of paper containing information. This includes all appendices, charts, graphs, diagrams, tables, photographs, etc., unless placed on 11” x 17” sheets, in which case they will be counted as two (2) pages. All pages of each part shall be appropriately numbered and identified with the Request for Proposal (RFP) number (FA301621R0017). Page limitations shall be treated as maximums.

2.4.1. Indexing. Each volume shall contain a more detailed table of contents to delineate the subparagraphs within that volume. Tab indexing shall be used to identify sections. Indexing is not included in the page limitations.

2.4.2. Covers for volumes, tables of contents, indices, title pages, cross reference indices and section dividers/tables will not be included in the page count if they are inserted solely to provide ease to the reader in locating volumes/sections of the proposal. They will be counted if they contain any other information, (e.g. diagrams, extraneous data, etc). Pages marked “This page intentionally left blank” will not be counted. Pages in excess of the page count stated in the table below will not be read, and will be removed and returned to the offeror. An electronic page is defined as each face of an 8 ½” X 11” electronic sheet of paper containing information. Page limits apply to all electronic files and hard files.

VOLUME PREPARATION INSTRUCTIONS

3. Volume Instructions. Each Volume shall be specific and complete. Legibility, clarity, and coherence are very important. Your responses will be evaluated in accordance with Section M, Evaluation Factors. Using the instructions provided below, as specifically as possible provide the actual methodology you would use for accomplishing/satisfying these factors. All the requirements specified in the solicitation are mandatory. By your proposal submission, you are representing that your firm will perform all the requirements specified in the solicitation. It is not necessary or desirable for you to tell us so in your proposal. Do not merely reiterate the objectives or reformulate the requirements specified in the solicitation.

The Government will review each proposal received for completeness in accordance with Attachment 12

– Proposal Completeness Checklist. The Contracting Officer may conduct clarifications to address the completeness of the proposal. Failure to provide a complete proposal may be grounds for further consideration and evaluation in the absence of discussions.

3.1 Volume I – Executed Contracting Documents [Phase I]

The purpose of this volume is to provide information to the Government for preparing the contract document and supporting file. The volume shall be prepared in the following format and contain the following contract files.

Tab A. The offeror's proposal shall include a signed copy of the Solicitation, and Sections A through K with applicable information within each section properly filled in by the offeror.

Section A. Complete blocks 14 through 20c of the SF 1442. These sections constitute the model contract.

An authorized official of the firm submitting the offer must sign and date the SF 1442 in block 20a-c. In doing so, the offeror accedes to the contract terms and conditions as written in the RFP, Sections A through M. Complete the representations and certifications in Section K or the System for Award Management (SAM).

Section B. Offeror’s are not required to complete this section as the basis for pricing will be established at the task order level.

Section I. Complete the offeror supplied fill-in information for applicable clauses. All companies submitting a proposal to this solicitation shall comply with FAR 52.204-7 System for Award Management. Should the awardee not be located within the registry there will be a delay in contract award until there is compliance within the registry.

Section K. Complete representations, certifications, acknowledgments, and statements.

Tab B. Offeror’s are required to meet all solicitation requirements, such as terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors.

Exceptions to the Solicitation. Offeror’s must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. Each exception shall be specifically related to each paragraph and/or specific part of the solicitation to which the exception is taken. Offeror shall provide rationale in support of the exception and fully explain its impact, if any, on the performance, schedule, cost, and specific requirements of the solicitation. This information shall be provided in the format and content of the following table (see Attachment 14).

Tab C. Provide the following required information.

i. Authorized Offeror Personnel. Offeror shall provide the name, title, telephone number, and e-mail address of the company/division point of contact regarding decisions made with respect to the offeror’s proposal and who can obligate the offeror contractually. Offeror shall also identify those individuals authorized to negotiate with the Government.

ii. Company/Division Address, Identifying Codes, and Applicable Designations. Offeror shall provide the company/division's street address, county and facility code; CAGE code; DUNS code; TIN; size of business (large or small); and labor surplus area designation. This same information must be provided if the work for this contract will be performed at any other location(s). List all locations where work is to be performed and indicate whether such facility is a division, affiliate, or subcontractor, and the percentage of work to be performed at each location.

iii. Bonding Requirement. The prime contractor must provide proof of bonding capacity of at least $20.0M to support the MACC program for JBSA. To be considered, the contractor must have a letter from an approved surety on surety letterhead that states the contractor has a relationship with the company and required bonding capacity has been obtained or will be obtained upon award of a MACC contract. Provide proof of bonding capacity with bonding capability letters from an approved surety listed with the Department of Treasury. The list of approved sureties can be found at http://www.fiscal.treasury.gov/fsreports/ref/suretyBnd/c570_a-z.htm. Letters must be notarized and signed by someone who can represent the surety. Letters signed by agents are unacceptable unless accompanied by a Power of Attorney granting proper authority to the agent.

iv. Executed Teaming Agreement. Primes can team with no more than three (3) teaming partners to meet the requirements of the RFP. Proposals will be evaluated based on the team, not just the Prime contractor. All team members must have a signed Teaming Agreement (TA) or signed Partnership Agreement that commits the parties to performance under this contract.

a) If any first-tier subcontractors are projected to perform more than 20% of all construction work on the contract, then a signed TA or LOI shall be provided for that subcontractor.

b) First-tier subcontractors projected to perform less than 20% of all construction work on the contract may be included as team members at the Prime’s discretion to ensure coverage of SOW scope; however, if included as a team member, a signed TA or LOI shall be provided for that subcontractor.

c) Experience and Past Performance information submitted from subcontractors without a TA or Letter of Intent (LOI) will not be evaluated.

v. Joint Ventures. A Joint Venture (JV) will be considered a sole business entity. Offeror’s who propose as a Joint Venture (JV) are not permitted to submit a separate proposal independent of the JV. Mentor-Protégé (M-P) is a relationship and not a business entity. M-Ps require formal TAs or LOIs to qualify for consideration as a team member.

3.1.1 Volume II – Executive Experience and Technical

This volume shall address the offeror’s Executive Experience & Technical approach. Factor 1 will be evaluated during Phase I on all proposals received. Factor 2 will only be evaluated for those proposals selected for Phase II.

3.1.1.1 FACTOR 1 – Executive Experience [Phase I]

The offeror shall provide no more than six (6) project references (see Attachment 13) to address in detail their executive experience and capability for meeting or exceeding the Government’s minimum performance or capability requirements of each aspect of the executive experience factor. FA301621R0017 - Section L Page 8 of 12 required experience attributes must be supported by narrative; inferences will not be made by the Agency.

If Teaming Partners will be used, a complete, coherent presentation of team abilities must be included in the proposal.

Relevancy. For purpose of this evaluation, relevancy of projects is defined as Design-Build (DB) projects completed within the last five (5) years (from the date of issuance on this solicitation) of similar scope and complexity of those expected to be awarded on this program. In lieu of a complete project, the offeror may submit projects that are ongoing as long as (a) the project is at least 80% complete by this solicitation’s issuance date, and (b) the contractor can validate completion with a government approved progress report. For commercial contracts, an equivalent customer validation of progress completion report may be used in lieu of a government approved progress report. The project referenced shall have dollar values ranging from $750K and up to $10.0M, and include multi-discipline projects to include multiple divisions (Architectural, Structural, Mechanical, Fire Protection, Electrical, or Civil Work), multiple trades, and or sub-contractors. The projects reference shall demonstrate the contractor’s experience in new construction work, demolition, and renovation/repair of existing facilities.

Projects. A project is defined as a complete design-build effort performed under a single task order or contract. For multiple award and IDIQ type contracts, the contract as a whole shall not be submitted as a project; rather, offeror’s shall submit as a project the work performed under a single task order.

3.1.1.1.1 Experience Executing Design-Build Projects.

The government will evaluate the offeror’s construction experience on relevant projects based on the information shown below.

(a) The offeror shall submit six (6) relevant DB projects that best demonstrate experience on projects of various size, scope, and complexity (please refer to the Relevancy definition above) according to the following breakdown requirements.

i. Offeror shall submit four (4) projects valued at least $750K and not to exceed $3.0M;

1. at minimum one project with two (2) or more divisions and two (2) or more trades,

2. at minimum one project with three (3) or more divisions and three (3) or more trades.

ii. Offeror shall submit two (2) projects valued at least $3.0M and not to exceed $10.0M;

1. one project with two (2) or more divisions and two (2) or more trades,

2. one project with three (3) or more divisions and three (3) or more trades.

iii. Offerors shall submit at least three (3) of the projects performed by the Prime contractor that:

1. have concurrent period of performance to demonstrate experience managing multiple concurrent DB projects, and

2. demonstrate collaboration of the prime and any teaming partners included in response to this solicitation.

(b) If Teaming Partner projects will be submitted for evaluation of experience, the Team Experience Matrix should include a narrative describing a complete, coherent presentation of team abilities and role for task orders issued under this contract. The offeror shall submit a complete Team Experience Matrix (Attachment 17) to illustrate the experience and relationship between the Prime, Designer of Record, and Teaming Partners or First-Tier Subcontractors (projected to perform at least 20% of the work on this contract) that will perform on this contract.

(c) The design portion of the contract/project shall have been completed within the past five (5) years (from the date of issuance of this solicitation).

(d) The offeror shall complete and submit each project using the Construction & Design Experience Project Data Sheet (Attachment 13); the use of this sheet to submit project information is mandatory.

Projects submitted in other than the mandatory sheet will not be evaluated. Except as specifically requested, the government will not evaluate information submitted in addition to this form; total length for each project shall not exceed three (3) pages.

(e) If the offeror is a Joint Venture, each firm shall provide a narrative demonstrating experience relevant to their role on this program. If the offeror has multiple functions or divisions, limit the project examples to those performed by the division or unit submitting the offer or by the team member.

3.1.2 FACTOR 2 – Technical [Phase II]

3.1.2.1 Management Effectiveness and Capabilities.

The offeror shall provide a plan that shows the offeror’s overall management plan/approach, to include a narrative to describe how often and on what projects these management approaches or plans have been previously executed. The Management Plan must ensure the requirements of the specifications are met at a minimum. The Government will assign strengths for aspects of an offeror’s proposal that have merit or exceed specified performance or capability requirements in a way that will be advantageous to the Government during contract performance. At the Government’s discretion, aspects of the proposal identified as strengths will be incorporated into the resulting contract. This plan shall describe and include at minimum the following requirements:

(a) The offeror’s overall management approach with regard to organization, coordination, development, monitoring, control of the design and construction process, and process to manage multiple concurrent relevant design-build projects (relevancy as described in Factor 1) during contract performance.

(b) The offeror’s site office organization with regard to levels of management, supervisory experience, personnel authority, and specific positions required to manage requirements from design through construction to completion; and policies and procedures for effective management of subcontractors.

(c) An organizational chart with names of assigned personnel and proposed subcontractors and their areas of responsibility for each portion, along with policies and procedures for selection and management of subcontractors. The chart shall also clearly delineate on-site from off-site personnel.

(d) A narrative describing the roles of the design and construction teams in response to a task order;

processes handling of unforeseen site conditions and design errors for individual delivery orders.

(e) The offeror’s material purchasing system and capabilities, and policies and procedures for effective evaluation, selection, and competition requirements of subcontractors.

(f) The offeror’s ability to evaluate and select manpower, subcontractors, and equipment necessary to perform and manage multiple simultaneous MACC requirements.

(g) The offeror’s process for warranty/maintenance support, unforeseen site conditions, design errors, etc.

(h) A description of the offeror’s interface with home/site office, subcontractor operations, and construction teams; and Government project managers, contracting officials, inspectors, and users.

(i) A description of how the offeror intends to ensure how none of the key personnel (Superintendent, Quality Control Manager, and Site Safety and Health Officer) will hold more than one position in each project while managing multiple concurrent design-build projects.

3.1.3 Volume III – Past Performance

The Government’s evaluation of past performance information will take into account past performance information regarding predecessor companies, key personnel who have relevant experience, or subcontractors that will perform major or critical aspects (see Teaming Agreements; para 3.1, Tab C, sub-para. Iv “Executed Teaming Agreements”), when such information is relevant to the instant acquisition.

The Government will consider the recency and relevancy of the information, the source of the information, context of the data and general trends in the Offeror's performance. This evaluation is separate and distinct from the Contracting Officer's responsibility determination. The assessment of the Offeror's past performance will be used as a means of evaluating the Offeror's probability to successfully meet the requirements of the RFP. Lack of any past performance will not automatically disqualify an offeror, but it is a factor that is considered in the Best Value Subjective Tradeoff Source Selection described in this section. If the offeror claims there is no past performance, then that status must be identified to the Contracting Officer in the Volume III Past Performance Summary Page.

Offeror’s are cautioned that in conducting the Past Performance evaluation, the Government reserves the right to use both the information provided in the Offeror's Past Performance Proposal Volume and information obtained from any and all sources, including sources outside the Government. Other sources may include, but are not limited to, the Contractor Performance Assessment Reporting System (CPARS) and/or similar systems; Past Performance Information Retrieval System (PPIRS) using all CAGE/DUNS numbers of contractors who are part of the partnership or joint venture identified in the Offeror’s proposal; information obtained from government inquiries including Past Performance Questionnaires;

Federal Awardee Performance and Integrity (FAPIIS); Electronic Subcontract Reporting System; and any other known sources not provided by the Offeror.

3.1.3.1 FACTOR 3 – Past Performance [Phase II]

3.1.3.1.1 Past Performance Reports

Offeror’s must provide past performance information to establish Recency and Relevancy on all Federal contracts before State, local government or private contracts. Offeror’s shall provide adequate past performance information for completed or current contracts (including Federal, State, local government and private) considered most relevant in demonstrating the ability to perform the proposed work as identified within the Specifications. If the Offeror claims there is no past performance, then that status must be identified to the Contracting Officer in the Volume III Past Performance Summary Page.

The offeror shall provide no more than eight (8) recent and relevant past performance reports. The offeror shall provide at least four (4) recent and relevant past performance reports from the Prime contractor. The offeror shall complete Past Performance Information Form (Attachment 16) and provide the past performance information to establish Recency and Relevancy of the reference. Only references for recent and relevant past efforts/contracts will be acceptable for evaluation.

Recency. Recency is defined as active or completed project completed within the past five (5) years from the issuance date of this solicitation to include at least six (6) months of documented performance during the five-year period. In lieu of completed projects within the five years, ongoing projects may be used as long as (a) they are at least 80% complete as of the date of issuance of this solicitation and (b) the contractor provides proof of percent completion with a government approved progress report. For commercial contracts, an equivalent customer validation of progress completion report may be used in lieu of a government approved progress report.

Relevancy. In determining relevancy, the government will consider the Offeror’s role in the effort. The submitted combination of contracts/projects will be evaluated as an aggregate and result in one overall relevancy rating for each Offeror’s past performance proposal. The Government anticipates that this combination of contracts/projects will cover all of the Relevancy Primary Evaluation Areas identified below.

(a) Design-Build (DB) Construction projects with costs ranging between $750k and $10.0M.

(b) DB Construction projects similar to those relevant to this requirement to include projects for renovation, alteration and repair, and construction work elements including at least multiple disciplines, trades and divisions.

(c) DB Construction projects with concurrent performance.

Specific Content. Offeror’s are required to explain in the past performance report what aspects of the contracts are deemed relevant to requirements to be included in a MACC contract and as related to this solicitation. This may include a discussion of project complexity, technical diversity, contract/subcontract management, schedule, magnitude, description of work elements include for the renovation, alteration and repair, or construction project, and what other relevant projects were managed simultaneously.

The offeror is required to clearly demonstrate management actions employed in overcoming problems and the effects of those actions in terms of improvements achieved or problems rectified. This may allow the offeror to be considered a higher confidence candidate. For example, submittal of quality performance indicators or other management indicators that clearly support that an offeror has overcome past problems is required. Categorize the relevant information into the specific Technical factor and Cost/Price factor used to evaluate the proposal.

3.1.3.1.2 Quality

Quality refers to the overall satisfaction level of customers, job performance, and quality of completed and ongoing projects.

3.1.3.1.2.1 Quality & Satisfaction Surveys

The offeror shall be responsible to submit a Quality and Satisfaction Survey (Attachment 15) for each recent and relevant reference provided; the offeror shall only complete Sections 1 and 2 of the surveys and return to the Government. The government in turn will forward the Quality and Satisfaction Surveys to the point of contacts identified in the survey for their completion. The government will use the information obtained from these surveys to supplement the quality assessment of the offeror. The client authorization letter(s) for each commercial contract shall be included in the offeror’s Present/Past Performance submission to indicate the commercial client has been notified of the forthcoming survey.
