DEPARTMENT OF VETERANS AFFAIRS
Justification and Approval For
Other Than Full and Open Competition
1. Contracting Activity:
Veterans Health Administration (VHA), Program Contracting Activity Central (PCAC).
The proposed procurement for the Construct and Renovate Chronic Dialysis and Sleep Program Minor Construction project at the Martinez Outpatient Clinic.
2. Nature and/or Description of the Action Being Processed:
This justification is to support the Construct and Renovate Chronic Dialysis and Sleep Program Minor Construction project at the Martinez Outpatient Clinic, that will be awarded as a firm-fixed price contract. This justification is for other than full and open competition for the procurement of certain construction materials.
The use of a particular brand name for the items listed below accommodates standardization of these items throughout the facility.

3. Description of Supplies/Services Required to Meet the Agency’s Needs:
Construct and Renovate Chronic Dialysis and Sleep Program Minor Construction project at the Martinez Outpatient Clinic. The scope includes everything necessary to construct a functional building that meets the requirements of the Department of Veterans Affairs. There are five (5) brand name items listed for which the VA is not able to accept equal or alternate items. The value of these items is listed below and the VAAR Construction magnitude for the entire project is between .
a. Door Hardware - Lock System
i. BEST Lock Corporation
ii. Value:
iii. Description: This project will be installing new locksets on the new doors for the project (Project A, Project B and Project C) that are the same brand and quality as the existing locksets in the VA Northern California Health Care System buildings.

Description: This project will provide (a) direct-digital control system(s) as indicated on the project documents, point list, interoperability tables, drawings and as described in the specifications. The existing HVAC control for VA Martinez campus is Siemens Apogee located in Bldg 19 OPC, room 114D.

iii. Description: This project will provide new addressable fire alarm systems with voice evacuation for the Building 19 Addition, Building 20 Addition and the Building 20 Renovation project at VA Campus Martinez, California.

iii. Description: This item will provide an Electronic Safety and Security (ESS), installed, programmed, configured, documented, and tested. The security system shall include but not limited to: physical access control, duress alarms, video assessment and surveillance, video recording and storage, delayed egress, personal protection system, intercommunication system, fire alarm interface, equipment cabinetry, dedicated photo badging system and associated live camera, and uninterruptible power supplies (UPS) interface.

4. Statutory Authority Permitting Other than Full and Open Competition:

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
These items have been standardized throughout the VA Martinez Campus. Installing a different manufacturer’s system will create significant duplication in cost for the facility, and in most cases the equipment will not function properly. The specific impacts for not using the brand name items and services are listed below:
a. Door Hardware (Lock System)
i. BEST Lock Corporation
ii. Impact: The VA NCHCS has approximately 3,000 mortised locksets installed in the doors at the VA Martinez Campus and all VA NCHCS buildings. The VA Martinez currently stocks parts and extra locksets for only the Best locks series mortised locks. The medical center locksmith is trained to service these locksets and maintain them in good working condition.

If a different lockset would be introduced into the medical center it would require additional training, equipment and stock parts at an additional cost to the medical center.
i. Impact: The existing direct control system for the VA Martinez campus is a SIEMENS
Apogee Building Automation system (BAS) that controls all the HVAC system for the campus. The VA electronic controls mechanic and VA HVAC maintenance mechanic are trained to work on this type of control including logging on/off, alarm handling, producing trend reports, overriding computer control, and changing set points and other variables.
If a different Building Automation System (BAS) would be introduced into the medical center it would require additional training, equipment and stock part(s) at an additional cost to the medical center.
c. Fire Alarm System
i. Pacific Signaling
ii. Impact: The existing fire alarm system loop (all Bldgs. are Integrated) for the VA Martinez campus is being maintained by Pacific Signaling, this include the connection & programming of new devices and maintenance of all existing fire alarm panels and devices.
VA will be taking a huge risk if another contractor will do the connection and programming to our existing fire alarm panels that are being maintained by Pacific signaling. If the construction contractor has performed incorrectly in the programming and connection of their devices and panels on our existing fire alarm system, it will create an emergency status on the campus and could affect patient care. Also, during the emergency repair, we must conduct fire watch to all bldgs.
until the fire alarm system is fixed.
i. Stanley System
ii. Impact: The existing Access card system is being maintained by Stanley system, this include, installing and programming of new entrance access card devices and maintaining the existing access card system.
All VA Martinez Buildings are secured by the Stanley Access card system. For security reasons and standardization, it is not wise to introduce a different access card system. If a different access card system is into the campus would be introduced into the medical center it would require additional training for maintenance and equipment at an additional cost to the medical center.
ii. Impact: The existing Security and Burglar alarm system is being maintained by
Universal Alarm, this include, installing and programming of new alarm devices/components and maintaining the existing alarm system.
VA will be taking a huge risk if another contractor will do the connection and programming to our existing security and Burglar panels that are being maintained by Universal. Having multiple security and burglar alarm call systems within the facility is not cost effective or practical for employee and patient safety.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
In accordance with the Competition in Contracting Act (CICA), the components listed above are identified as brand name; however, the overall procurement will be competed as a Service-Disabled
Veteran-Owned Small-Business (SDVOSB) Set-Aside. This Justification for Other Than Full and Open Competition will be posted to Federal Business Opportunities with the solicitation.
7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable:
The design was completed by KF Davis Engineering, Inc. KF Davis Engineering, Inc. provided a complete government estimate. The anticipated price to the Government for the items requested to be brand name is approximately
The items for which brand name approval is being requested are subsequent components to the overall construction project. This procurement will be competed and based on competition; the Contracting Officer will make a determination of fair and reasonable pricing prior to award.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons
Market Research Was Not Conducted:
The market research for the design and equipment was conducted KF Davis Engineering, Inc. to secure prices for the government estimate, and was shared with the Contracting Officer and Contracting Officer’s Representative (COR) for further review. The Contracting Officer and COR were in concurrence with information provided in the estimate that supported the brand name items.
These sources have been identified by KF Davis Engineering, Inc. as a result of the contract to design and build this project. Approval of the items as brand name only is critical for the overall efficiency of the completed project and the facility as a whole.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition:
All the specifications and drawings associated with this project have been developed identifying the brand name items as a requirement for the project. Standardization of most facility systems according to the preponderance of long term industry data results in substantially reduced costs for parts as well as maintenance and repair labor that far outweigh the potential savings to be had by full and open competition.
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:
Not applicable. It is the responsibility of the offerors and the general contractor awarded the project to locate suppliers and obtain pricing for all materials and components, including the items listed in this justification.
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to
Competition before Making subsequent acquisitions for the supplies or services required:
There will be competition for the overall procurement. It will be the responsibility of the offerors to obtain pricing from the suppliers of the items and to submit a competitive proposal for the project.
12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona
Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
