About this file

This is a Darfur Contracting Act Certification form issued by the State of California Department of General Services Procurement Division. The form applies to any company that currently or has had business activities or operations outside the United States within the previous three years. Companies meeting this criterion must certify their eligibility to bid on or submit proposals for State of California contracts by completing one of two options outlined in the document.

Option #1 requires companies to certify under penalty of perjury that they are not a scrutinized company as defined in Public Contract Code Section 10476 and that the signing official is duly authorized to legally bind the company. Option #2 is available for scrutinized companies that have obtained written permission from the Department of General Services Director under Public Contract Code Section 10477(b) to submit bids or proposals on a case-by-case basis when determined to be in the best interests of the state. For both options, companies must provide their company name, Federal ID Number, authorized signature, printed name and title of the signing official, and date. Companies that have not engaged in business activities outside the United States within the previous three years are not required to complete this certification.
