About this file
This is an SDVOB Utilization Plan form issued by the New York State Department of Labor, Purchase & Contracts division, located at the Harriman State Office Campus in Albany. The form is designed for bidders and contractors to document their commitment to utilizing New York State Certified Service-Disabled Veteran-Owned Businesses (SDVOBs) as subcontractors and suppliers on state contracts. Bidders must provide detailed descriptions of the supplies and services to be performed by each SDVOB subcontractor, including the subcontractor's contact information, federal identification number, and either the dollar value or estimated percentage of contract work to be performed. The form requires bidders to identify specific individuals contacted at each SDVOB and to list multiple subcontractors and suppliers as needed using additional sheets.
Bidders and contractors are required to make good faith efforts to meet SDVOB utilization goals as specified in the solicitation or contract, and submission of the plan constitutes a binding commitment to those goals. The form explicitly warns that providing false information or demonstrating lack of good faith in the utilization plan is prohibited by law and may result in penalties including contract termination for cause, loss of future bidding eligibility, and payment withholding. If unable to meet the stated SDVOB goals, bidders must submit a separate waiver request. All listed subcontractors and suppliers will be verified by the Department of Labor, and firms that do not perform commercially useful functions cannot be counted toward SDVOB utilization requirements. A directory of certified SDVOBs is available at the New York State Office of General Services online portal.
