The form must be completed and filed by contractors whose contracts exceed $100,000 in value and involve the procurement of commodities or services. The certification requirement applies to contracts awarded, amended, extended, renewed, or assigned on or after April 26, 2006, where the solicitation began on or after January 1, 2005. Contractors must affirm under penalty of perjury that they have filed the required Form ST-220-TD with the Department of Taxation and Finance or provide certification that a previously filed Form ST-220-TD remains current and accurate. The form requires completion of contractor information including name, principal place of business, federal employer identification number, sales tax ID number, and covered agency details.

The form must be signed before a notary public by an authorized representative of the contractor and includes acknowledgment sections tailored to individual contractors, corporations, partnerships, and limited liability companies. Contractors are required to file a new Form ST-220-CA with a covered agency before renewing an existing contract. The New York State Tax Department collects and maintains the personal information provided on this form to determine and administer tax liabilities and for other lawful purposes authorized by law, with failure to provide required information subject to civil or criminal penalties.
