Amendment 3 – Published Questions and Answers Summary
Amendment 3 is a questions and answers document issued by the Mississippi Department of Corrections (MDOC) and Wilkinson County Industrial Development Authority in response to inquiries submitted during the optional facility tour and formal question period for RFx 3140004482, a Request for Proposals for a Facility Operator for Wilkinson County Correctional Facility. The amendment addresses 65 questions and requests for clarification organized by tour location and topic area, covering facility infrastructure, systems, operations, staffing, and RFP requirements. An optional facility tour was conducted, with registration required by February 20, 2026, and proposals are due by 2:00 p.m. CST on March 25, 2026. The contract term is three years beginning July 1, 2026, with two optional one-year renewal periods. Key facility details disclosed include current capacity of 900 inmates (772 close custody, 128 medium and minimum custody), five restricted housing areas, a Pelco security camera system with Generic DVS control system, 32 HVAC units (15 new), a recently replaced roof with 20-year warranty, and scheduled preventive maintenance conducted monthly through the Dude Solutions work order system.
Pricing must reflect a minimum 10 percent cost reduction from the FY 2024 PEER published per diem rate for state-operated comparable facilities, with MDOC clarifying that it will only consider the current PEER model and will not provide updated rates pending the 2026 report. MDOC rejected requests for guaranteed minimum inmate populations and declined to modify mandatory staffing language or eliminate polygraph examination requirements, citing an exemption under 29 U.S. Code §2006 for private security employers. The contractor must assume responsibility for preventive maintenance and repairs up to $150,000 per incident, with costs exceeding this threshold borne by the Authority. MDOC confirmed that Amendment 2, Appendix F requirements supersede Amendment 1 language regarding performance bond requirements set at $500,000 within 10 days of contract execution. No recent litigation involving the current operator was identified by MDOC during the past three months.

QUESTION AND REQUESTS FOR CLARIFICATION TO AGENCY
58. Section 4. Proposal Requirements, Subsection 4.9 Contents of Management Plan
This section has some incorrect numbering, and 4.9.1 repeats itself. Could MDOC please correct this section?
MDOC issued Amendment #4, which provides the correct numbering for this section.
59. Section 4. Proposal Requirements, Subsection 4.5 Submission Format
This section specifies that offerors are to use half-inch margins. To ensure readability and accommodate printing and binding, is it permissible for offerors to use slightly larger margins (e.g., 0.75" or 1").
Yes. Offerors may use up to a 1” margin. All other submission formats in section 4.5 of the RFP remain unchanged and are as follows:
Proposals must be type-written on 8.5” x 11” paper (charts or graphs may be provided on legal-sized paper) using Times New Roman font type, and font size 12.
See Section 4.5 – Submission Format.
7 | A m e n d m e n t # 3
60. Section 4. Proposal Requirements, Subsection 4.7 Cost Requirements
Question relating to PEER: The RFP requires pricing that reflects at least a 10% reduction from the PEER published per diem for the operation of a comparable MDOC facility. However, the most recent PEER report was published in December 2024, and is substantially outdated. Since its publication, MDOC has provided substantial raises to its correctional staff and otherwise increased its own costs of operation. Additionally, legislation passed in 2025 substantially changed the manner in which the PEER per diem is to be calculated.
Rather than provide one flat rate cost per inmate per day rate that applies across all facilities, regardless of classification level, PEER is now required to adopt a new cost-based model that accounts for classification level and provide distinct cost per inmate per day rates based on different classifications levels. Under the 2025 legislation, the facility size, layout, bed capacity, and the classification type of inmates assigned/housed at a facility MUST be used in determining an acceptable cost per inmate per day rate. The calculations in the 2024 PEER report do not meet the new statutory requirement. Will MDOC be providing an updated PEER per diem rate to reflect the changes in MDOC's costs and the calculations required in the new legislation, to be used for purposes of this procurement? If not, has MDOC considered postponing the procurement until after the 2026 PEER report has been published, so an appropriate procurement based on more recent data and legal requirements can be conducted?
The Joint Legislative Committee on Performance Evaluation and Expenditure Review (PEER) releases the State of Mississippi inmate cost per day every two (2) years. The Mississippi Department of Corrections’ FY 2024 Cost Per Inmate Day is the current model and should be referenced by Offerors.
See Section 4.7 – Cost Requirements.
61. Section 4. Proposal Requirements, Subsection 4.7 Cost Requirements
Question relating to the guaranteed minimum. The RFP materials do not account for a guaranteed
No. MDOC will only consider factors outlined in this RFP.
See Appendix D – Cost Proposal.
8 | A m e n d m e n t # 3 minimum population at the facility. Is MDOC willing to agree to a minimum guaranteed population in order to ensure that the fixed cost of operation can be covered by the contract? If so, what percentage of the facility's total capacity is MDOC willing to guarantee?
62. Section 4. Proposal Requirements, Subsection
4.8.6.10 Video Surveillance System
The RFP requires the operator of the facility to use and maintain a camera system with specifications that are not consistent with the camera system currently installed at the facility. Is MDOC intending to upgrade the camera system at its cost prior to the start of the new contract? Or are bidders expected to incorporate the costs of the upgraded camera system into their proposals. If the later, how will the costs of the camera system be accounted for in evaluating the proposed per diem against PEER?
Offeror must demonstrate its ability to perform all operational services required in Section 5-Scope of Services and Requirements.
Responses must address, at a minimum the ability to meet camera coverage standards, eliminate blind spots, retain footage for 90-180 days, and provide MDOC immediate access.
See Section 4.8.6 – Operational Service Delivery Capability, Subsection 4.8.6.10 – Video Surveillance System.
63. Section 5. Scope of Services, Subsection 5.18.1 Staffing
The contract language attached to the RFP contains mandatory position language that is substantially changed from the mandatory position/mandatory post language contained within Section 5.2(c) of the current operating agreement. Will MDOC agree to substitute the language in Section 5.18.1 of the contract language in the RFP with the mandatory post/mandatory position language in Section 5.2(c) of the current operating agreement?
No. see Section 5 – Scope of Service and Requirement, Subsection 5.18.1.
64. Section 5. Scope of Services, Subsection 5.20 - Background Check and Polygraph Examination
An exemption to 29 U.S. Code § 2006 is provided in 29 U.S.
Code § 2006, (e)(1) “… this chapter shall not prohibit the use
9 | A m e n d m e n t # 3
Purports to require the offerors to "conduct polygraph examinations for all facility leadership, including the warden, deputy warden, major, and CERT team member, in accordance with MDOC policies." However, the Employee Polygraph Protection Act, 29 U.S. Code Sec. 2002, et al. (the "EPPA"), expressly prohibits a private employer from administering such lie detector tests. See 29 U.S.
Code Sec. 2002 making it unlawful for "any employer in or affecting commerce or in the production of goods for commerce . . . directly or indirectly, to require, request, suggest, or cause any employee or prospective employee to take or submit to any lie detector test." Can MDOC cite any statutory or other legally recognized exceptions to the EPPA that would be applicable to a private correctional facility operator? If not, will MDOC modify Section 5.2 to eliminate the polygraph requirements?
of polygraph tests on prospective employees by any private employer whose primary business purpose consists of providing…uniformed or plainclothes security personnel and whose function includes protection of (A) facilities…or operations having a significant impact on the health or safety of any State or political subdivision”.

65. APPENDIX J - Sample Management Agreement with Facility Operator, Subsection 3.8 Occupation, Maintenance and Modification of the Facility
Would it be possible for MDOC to reduce the preventive maintenance, repair, and replacement program cost responsibility from $150,000 per incident to the current threshold of $75,000 per incident?
No. MDOC will require the Contractor to implement a preventive maintenance, repair, and replacement program on plumbing, electrical, mechanical, wiring, and heating, and will be responsible for the cost of such program up to one hundred fifty thousand dollars ($150,000) per incident.
See Appendix J – Sample Management Agreement with Facility Operator, Section 3.8 – Occupation, Maintenance and Modification of the Facility.
